Terms Used In South Carolina Code 56-21-50

  • Bail: Security given for the release of a criminal defendant or witness from legal custody (usually in the form of money) to secure his/her appearance on the day and time appointed.
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
The recorder, judge or the magistrate having jurisdiction within the area where such State institution is situate shall have jurisdiction to hear, try and determine violations of the provisions of §§ 56-21-10 to 56-21-60. The county treasurer who receives fines or bail forfeitures collected by the recorder, judge or magistrate for violations of the provisions of §§ 56-21-10 to 56-21-60 shall remit such fines or forfeitures to the institutions concerned.
