Whenever the board has established groundwater discharge limitations pursuant to § 34A-2-24, 34A-2-27, or 34A-2-36, and monitoring data indicate that the ambient groundwater quality has been degraded up to onehalf of any permitted increase in pollutant concentration above the ambient concentration, the operator shall submit to the board a preventative action plan which includes an analysis of the discharge in relation to the increasing pollutant concentrations and any preventative actions to be taken to ensure that groundwater limitations will not be violated. A violation of this section is subject to § 34A-2-75.
