An officer shall detain a driver without a warrant, as provided in § 40-7-103, and bring the driver before a committing magistrate if the driver:

(1) Is involved in an accident resulting in:

  • accident: includes any collision or crash, regardless of the degree of care exercised by the drivers involved or whether it was the result of criminal conduct. See Tennessee Code 55-10-101
  • Driver: means :
    (A) For purposes of a conventionally operated vehicle, every person who drives or is in actual physical control of a vehicle. See Tennessee Code 55-8-101
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
(A) Serious bodily injury, as defined in § 55-50-502; or
(B) Death; and
(2) Does not have a valid driver license; and
(3) Does not have evidence of financial responsibility as required by § 55-12-139.
