Terms Used In Tennessee Code > Title 63 > Chapter 10 - Pharmacy

  • Administer: means the direct application of a drug to a patient or research subject by injection, inhalation, ingestion, topical application or by any other means. See Tennessee Code 63-10-204
  • Agriculture: means :
    1. The land, buildings and machinery used in the commercial production of farm products and nursery stock. See Tennessee Code 1-3-105
    2. Animal: means a domesticated living creature or a wild creature previously captured. See Tennessee Code 39-14-201
    3. Benefit: means anything reasonably regarded as economic gain, enhancement or advantage, including benefit to any other person in whose welfare the beneficiary is interested. See Tennessee Code 39-11-106
    4. Board: means the board of pharmacy. See Tennessee Code 63-10-501
    5. Board: means the Tennessee board of pharmacy. See Tennessee Code 63-10-204
    6. Bodily injury: includes a cut, abrasion, bruise, burn or disfigurement, and physical pain or temporary illness or impairment of the function of a bodily member, organ, or mental faculty. See Tennessee Code 39-11-106
    7. Certification: means a voluntary process by which a practitioner's training, experience and knowledge are identified as meeting or surpassing a standard, defined or approved by the board beyond that required for licensure or registration. See Tennessee Code 63-10-204
    8. Code: includes the Tennessee Code and all amendments and revisions to the code and all additions and supplements to the code. See Tennessee Code 1-3-105
    9. Collaborative pharmacy practice agreement: is a written and signed agreement entered into voluntarily between one (1) or more licensed pharmacists in this state, and one (1) or more prescribers licensed in this state, each of whom is in active practice in this state providing patient care services in this state, that provides for collaborative pharmacy practice, as defined by law. See Tennessee Code 63-10-204
    10. Compounding: means the preparation, mixing, assembling, packaging or labeling of a drug or device:

      1. As the result of a prescription order or initiative based on the prescriber-patient-pharmacist relationship in the course of professional practice. See Tennessee Code 63-10-204
      2. Continuing education: means planned, organized learning experiences and activities beyond the basic educational or preparatory program. See Tennessee Code 63-10-204
      3. Continuous quality improvement program: means a system of standards and procedures to identify and evaluate quality-related events and to improve patient care. See Tennessee Code 63-10-204
      4. Contract: A legal written agreement that becomes binding when signed.
      5. Controlled substance: means a drug, substance or immediate precursor identified, defined or listed in title 39, chapter 17, part 4 and title 53, chapter 11. See Tennessee Code 63-10-204
      6. Conviction: A judgement of guilt against a criminal defendant.
      7. Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
      8. Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
      9. Debit card: means any real or forged instrument, writing or other evidence known by any name issued with or without a fee by an issuer for the use of a depositor in obtaining money, goods, services or anything else of value, payment of which is made against funds previously deposited in an account with the issuer. See Tennessee Code 39-14-102
      10. Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
      11. Defendant: means a person accused of an offense under this title and includes any person who aids or abets the commission of such offense. See Tennessee Code 39-11-106
      12. delivery: means the actual, constructive or attempted transfer from one person to another whether or not there is an agency relationship. See Tennessee Code 63-10-204
      13. Department: means the department of health. See Tennessee Code 63-10-501
      14. Device: means an instrument, apparatus, implement, machine, contrivance, implant, in vitro reagent or other similar or related article, including any component part or accessory, that is required under federal or state law to be ordered or prescribed by a person duly authorized. See Tennessee Code 63-10-204
      15. Dietary supplement: means a product, other than tobacco, intended to supplement the diet that bears or contains one (1) or more of the following ingredients: a vitamin, mineral, herb or other botanical, amino acid, dietary substance for use by humans to supplement the diet by increasing the total dietary intake, or a concentrate, metabolite, constituent, extract or combination of any of these ingredients and any other products designated as dietary supplements by federal or state law.       16. Director: means the director of the health related boards. See Tennessee Code 63-10-204
      17. Discovery: Lawyers' examination, before trial, of facts and documents in possession of the opponents to help the lawyers prepare for trial.
      18. Dispense: means preparing, packaging, compounding or labeling for delivery and actual delivery of a prescription drug, nonprescription drug or device in the course of professional practice to a patient or the patient's agent, to include a licensed health care practitioner or a health care facility providing services or treatment to the patient or patients, by or pursuant to the lawful order of a prescriber. See Tennessee Code 63-10-204
      19. distribution: means the sale, purchase, trade, delivery, handling, storage, or receipt of a product or the arrangement of the sale, purchase, trade, delivery, handling, storage, or receipt of a product through third parties. See Tennessee Code 63-10-204
      20. Distributor: means a person engaged in the distribution of drugs or devices. See Tennessee Code 63-10-204
      21. Division: means the division of health related boards. See Tennessee Code 63-10-204
      22. Donor: means a person, a pharmacy, or medical facility as well as any drug manufacturer or wholesaler licensed by the board of pharmacy, who donates prescription drugs to a repository program approved pursuant to this part. See Tennessee Code 63-10-501
      23. Donor: The person who makes a gift.
      24. Drug: means any of the following:

        1. Articles recognized as drugs or drug products in any official compendium or supplement thereto. See Tennessee Code 63-10-204
        2. Eligible individual: means an indigent person or an uninsured person who meets all other criteria established by board rule. See Tennessee Code 63-10-501
        3. Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
        4. Executive director: means the executive director of the Tennessee board of pharmacy. See Tennessee Code 63-10-204
        5. Fair Credit Reporting Act: A federal law, established in 1971 and revised in 1997, that gives consumers the right to see their credit records and correct any mistakes. Source: OCC
        6. Government: means the state or any political subdivision of the state, and includes any branch or agency of the state, a county, municipality or other political subdivision. See Tennessee Code 39-11-106
        7. Indigent: means a person with an income that is below two hundred percent (200%) of the federal poverty level as defined by the most recently revised poverty income guidelines published by the United States department of health and human services. See Tennessee Code 63-10-501
        8. Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
        9. Knowing: means that a person acts knowingly with respect to the conduct or to circumstances surrounding the conduct when the person is aware of the nature of the conduct or that the circumstances exist. See Tennessee Code 39-11-106
        10. Label: means any written, printed or graphic matter on the immediate container of a drug or device. See Tennessee Code 63-10-204
        11. Labeling: means the process of affixing all labels and other written, printed or graphic matter:

          1. Upon any article or any of its containers or wrappers. See Tennessee Code 63-10-204
          2. Law enforcement officer: means an officer, employee or agent of government who has a duty imposed by law to:

            1. Maintain public order. See Tennessee Code 39-11-106
            2. Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC
            3. Licensure: means the process by which an agency of government grants permission to an individual to engage in a given occupation upon finding that the applicant has attained the minimal degree of competency necessary to ensure that the public health, safety and welfare will be reasonably protected. See Tennessee Code 63-10-204
            4. Lien: A claim against real or personal property in satisfaction of a debt.
            5. Litigation: A case, controversy, or lawsuit. Participants (plaintiffs and defendants) in lawsuits are called litigants.
            6. Manufacturer: means any person, except a pharmacist compounding in the normal course of professional practice, engaged in the commercial production, preparation, propagation, conversion or processing of a drug, either directly or indirectly, by extraction from substances of natural origin or independently by means of chemical synthesis, or both, and includes any packaging or repackaging of a drug or the labeling or relabeling of its container and the promotion and marketing of such drugs or devices. See Tennessee Code 63-10-204
            7. Medical facility: means any of the following:

              1. A physician's office. See Tennessee Code 63-10-501
              2. Medical order: means a lawful order of a prescriber for a specific patient that may or may not include a prescription order, such orders subject to rules and regulations as may be promulgated from time to time by the respective boards that license the persons who are authorized to prescribe drugs. See Tennessee Code 63-10-204
              3. Medication therapy management program: means the distinct pharmacist-provided service or group of services that optimize therapeutic outcomes for individual patients. See Tennessee Code 63-10-204
              4. Minor: means any person who has not attained eighteen (18) years of age. See Tennessee Code 1-3-105
              5. National Credit Union Administration: The federal regulatory agency that charters and supervises federal credit unions. (NCUA also administers the National Credit Union Share Insurance Fund, which insures the deposits of federal credit unions.) Source: OCC
              6. Nonprescription drug: means a drug that may be sold or dispensed without a prescription and that is labeled and packaged in compliance with applicable state or federal law. See Tennessee Code 63-10-204
              7. Outsourcing facility: means a facility engaged in the compounding of sterile drugs that has elected to register as an outsourcing facility with the U. See Tennessee Code 63-10-204
              8. Oversight: Committee review of the activities of a Federal agency or program.
              9. Owner: means a person, other than the defendant, who has possession of or any interest other than a mortgage, deed of trust or security interest in property, even though that possession or interest is unlawful and without whose consent the defendant has no authority to exert control over the property. See Tennessee Code 39-11-106
              10. Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
              11. Patient education: means the communication of information to the patient or caregiver by the pharmacist. See Tennessee Code 63-10-204
              12. Person: means any individual, partnership, association, corporation and the state, its departments, agencies and employees, and the political subdivisions of Tennessee and their departments, agencies and employees, except the department of health and local health departments. See Tennessee Code 63-10-204
              13. Person: includes the singular and the plural and means and includes any individual, firm, partnership, copartnership, association, corporation, governmental subdivision or agency, or other organization or other legal entity, or any agent or servant thereof. See Tennessee Code 39-11-106
              14. Pharmacist: means an individual health care provider licensed by the state, pursuant to parts 4-6 of this chapter, to practice the profession of pharmacy. See Tennessee Code 63-10-204
              15. pharmacist review committee: means any committee, board, commission or other entity of any national, state or local professional association or society, including an impaired pharmacist peer review committee, a drug utilization review committee or a committee of any pharmacy benefits management organization, health care provider network, licensed health care institution or any health care organization, system or foundation, the function of which, or one of the functions of which, is to review, evaluate and improve the quality of pharmacy-related services provided by pharmacists or pharmacy auxiliary personnel, to provide intervention, support or rehabilitative referrals or services or to determine that pharmacy-related services rendered by pharmacists or pharmacy auxiliary personnel were professionally indicated or were performed in compliance with applicable quality standards, or that the cost of pharmacy-related services rendered by pharmacists or pharmacy auxiliary personnel was reasonable. See Tennessee Code 63-10-204
              16. Pharmacist-in-charge: means the supervisory pharmacist who has the authority and responsibility for compliance with laws and rules pertaining to the practice of pharmacy at the practice site of the pharmacist-in-charge. See Tennessee Code 63-10-204
              17. Pharmacy: means a pharmacy as defined in §. See Tennessee Code 63-10-501
              18. Pharmacy: means a location licensed by this state where drugs are compounded or dispensed under the supervision of a pharmacist, as defined in the rules of the board and where prescription orders are received or processed. See Tennessee Code 63-10-204
              19. Pharmacy drug disposal program: means any voluntary drug disposal program located at, or implemented by, a Tennessee-licensed pharmacy located in this state, in accordance with all state and federal rules and regulations. See Tennessee Code 63-10-702
              20. Pharmacy intern: means an individual enrolled in or a graduate of a recognized school or college of pharmacy under rules established by the board who is serving a period of time of practical experience under the supervision of a pharmacist, as defined in the rules of the board. See Tennessee Code 63-10-204
              21. Pharmacy technician: means an individual who is specifically trained and designated to assist pharmacists in the practice of pharmacy. See Tennessee Code 63-10-204
              22. Practice of pharmacy: means a patient-oriented health service profession in which pharmacists interact and consult with patients and other health care professionals to enhance patients' wellness, prevent illness, and optimize outcomes. See Tennessee Code 63-10-204
              23. Prescriber: means an individual authorized by law to prescribe drugs. See Tennessee Code 63-10-204
              24. Prescription drug: means the same as defined in §. See Tennessee Code 63-10-501
              25. Prescription drug: means a drug that under federal or state law is required to be dispensed only pursuant to a prescription order or is restricted to use by prescribers and that under federal law must be labeled with either the symbol "Rx only" or the statement "Caution: Federal law restricts this drug to use by, or on the order of, a licensed veterinarian". See Tennessee Code 63-10-204
              26. Prescription order: means and includes any order, communicated through written, verbal, or electronic means by a physician, certified physician assistant, pharmacist in accordance with a collaborative pharmacy practice agreement pursuant to this section, dentist, veterinarian, optometrist authorized pursuant to §. See Tennessee Code 63-10-204
              27. Probable cause: A reasonable ground for belief that the offender violated a specific law.
              28. Property: includes both personal and real property. See Tennessee Code 1-3-105
              29. Property: means anything of value, including, but not limited to, money, real estate, tangible or intangible personal property, including anything severed from land, library material, contract rights, choses-in-action, interests in or claims to wealth, credit, admission or transportation tickets, captured or domestic animals, food and drink, electric or other power. See Tennessee Code 39-11-106
              30. Quality assurance program: means a system for identifying problems in patient care that are resolved via administrative, clinical or educational actions to ensure that final products and outcomes meet applicable specifications. See Tennessee Code 63-10-204
              31. Quorum: The number of legislators that must be present to do business.
              32. Receiving: includes , but is not limited to, acquiring possession, control, title or taking a security interest in the property. See Tennessee Code 39-14-102
              33. Record: means information that is inscribed on a tangible medium or that is stored in an electronic or other medium and is retrievable in a perceivable form. See Tennessee Code 1-3-105
              34. Remainder: An interest in property that takes effect in the future at a specified time or after the occurrence of some event, such as the death of a life tenant.
              35. Reporter: Makes a record of court proceedings and prepares a transcript, and also publishes the court's opinions or decisions (in the courts of appeals).
              36. Representative: when applied to those who represent a decedent, includes executors and administrators, unless the context implies heirs and distributees. See Tennessee Code 1-3-105
              37. Restitution: The court-ordered payment of money by the defendant to the victim for damages caused by the criminal action.
              38. Services: includes labor, skill, professional service, transportation, telephone, mail, gas, electricity, steam, water, cable television, entertainment subscription service or other public services, accommodations in hotels, restaurants or elsewhere, admissions to exhibitions, use of vehicles or other movable property, and any other activity or product considered in the ordinary course of business to be a service, regardless of whether it is listed in this subdivision (a)(37) or a specific statute exists covering the same or similar conduct. See Tennessee Code 39-11-106
              39. Settlement: Parties to a lawsuit resolve their difference without having a trial. Settlements often involve the payment of compensation by one party in satisfaction of the other party's claims.
              40. signed: includes a mark, the name being written near the mark and witnessed, or any other symbol or methodology executed or adopted by a party with intention to authenticate a writing or record, regardless of being witnessed. See Tennessee Code 1-3-105
              41. State: when applied to the different parts of the United States, includes the District of Columbia and the several territories of the United States. See Tennessee Code 1-3-105
              42. Statute: A law passed by a legislature.
              43. Subpoena: A command to a witness to appear and give testimony.
              44. Supplies: means the supplies necessary to administer the prescription drugs donated. See Tennessee Code 63-10-501
              45. Third-party logistics provider: means a person who provides or coordinates warehousing or other logistics services of a drug or device on behalf of a manufacturer, wholesale distributor, or dispenser of the drug or device, but does not take ownership of the drug or device, nor has responsibility to direct the sale or disposition of the drug or device. See Tennessee Code 63-10-204
              46. Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence.
              47. United States: includes the District of Columbia and the several territories of the United States. See Tennessee Code 1-3-105
              48. Unprofessional conduct: means the conduct of a pharmacist, pharmacy intern or pharmacy technician that is detrimental to patients or to the profession of pharmacy. See Tennessee Code 63-10-204
              49. Venue: The geographical location in which a case is tried.
              50. Wholesale distribution: means the distribution of a drug or device to persons other than the patient or consumer, or the receipt of a drug or device by persons other than the patient or consumer. See Tennessee Code 63-10-204
              51. written: includes printing, typewriting, engraving, lithography, and any other mode of representing words and letters. See Tennessee Code 1-3-105
              52. Year: means a calendar year, unless otherwise expressed. See Tennessee Code 1-3-105
