Terms Used In Tennessee Code > Title 65 > Chapter 17 - Wind Energy Facility Siting

  • Agriculture: means :
    1. The land, buildings and machinery used in the commercial production of farm products and nursery stock. See Tennessee Code 1-3-105
    2. Amendment: A proposal to alter the text of a pending bill or other measure by striking out some of it, by inserting new language, or both. Before an amendment becomes part of the measure, thelegislature must agree to it.
    3. Arrest: Taking physical custody of a person by lawful authority.
    4. Bail: Security given for the release of a criminal defendant or witness from legal custody (usually in the form of money) to secure his/her appearance on the day and time appointed.
    5. Baseline: Projection of the receipts, outlays, and other budget amounts that would ensue in the future without any change in existing policy. Baseline projections are used to gauge the extent to which proposed legislation, if enacted into law, would alter current spending and revenue levels.
    6. Department: means the department of environment and conservation. See Tennessee Code 65-17-101
    7. Dismissal: The dropping of a case by the judge without further consideration or hearing. Source:
    8. Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
    9. Forgery: The fraudulent signing or alteration of another's name to an instrument such as a deed, mortgage, or check. The intent of the forgery is to deceive or defraud. Source: OCC
    10. Injunction: An order of the court prohibiting (or compelling) the performance of a specific act to prevent irreparable damage or injury.
    11. Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
    12. Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC
    13. Local government: means any county, municipality, city, or other political subdivision of this state. See Tennessee Code 65-17-101
    14. Local legislation: means any ordinance, resolution, motion, amendment, regulation, or rule adopted by a local government. See Tennessee Code 65-17-101
    15. Local legislative body: means the governing body of a local government. See Tennessee Code 65-17-101
    16. Non-participating landowner: means a landowner not under a lease or other property agreement with the owner or operator of a wind turbine facility. See Tennessee Code 65-17-101
    17. Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
    18. Person: means any natural person, corporation, limited liability company, partnership, joint venture, or other private business entity except for corporations transacting business in this state pursuant to chapter 25 of this title. See Tennessee Code 65-17-101
    19. Plea: In a criminal case, the defendant's statement pleading "guilty" or "not guilty" in answer to the charges, a declaration made in open court.
    20. Preliminary hearing: A hearing where the judge decides whether there is enough evidence to make the defendant have a trial.
    21. Probable cause: A reasonable ground for belief that the offender violated a specific law.
    22. redevelopment: means the process of replanning, reconstructing, or redesigning a wind energy facility, including the acquisition, clearance, development, or disposal, or any combination of these activities, of a wind energy facility. See Tennessee Code 65-17-101
    23. Restitution: The court-ordered payment of money by the defendant to the victim for damages caused by the criminal action.
    24. Wind energy facility expansion: means any activity that:
      1. Adds or substantially modifies a wind energy facility, including increasing the height or the number of the turbines, transmission facilities, or other equipment. See Tennessee Code 65-17-101
