- Power of attorney: A written instrument which authorizes one person to act as another's agent or attorney. The power of attorney may be for a definite, specific act, or it may be general in nature. The terms of the written power of attorney may specify when it will expire. If not, the power of attorney usually expires when the person granting it dies. Source: OCC
- Signature: includes the mark of a person unable to write, and "subscribe" includes the making of such a mark. See Texas Government Code 312.011
A statutory durable power of attorney is legally sufficient under this subtitle if:
(1) the wording of the form complies substantially with the wording of the form prescribed by § 752.051;
(2) the form is properly completed; and
(3) the signature of the principal is acknowledged.
