Terms Used In Texas Government Code 411.164

  • Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
  • Discovery: Lawyers' examination, before trial, of facts and documents in possession of the opponents to help the lawyers prepare for trial.

In accordance with department rule, the attorney representing the state in a criminal action shall designate the defendant or the defendant’s attorney, as appropriate, as an individual who is authorized to access and use the crime laboratory portal under § 411.162 to request any crime laboratory records that are subject to discovery under Article 39.14, Code of Criminal Procedure.
