Terms Used In Tennessee Code 42-1-107

  • Aeronaut: includes aviator, pilot, balloonist, and every other person having any part in the operation of aircraft while in flight. See Tennessee Code 42-1-101
  • Aircraft: includes balloon, airplane, hydroplane, and every other vehicle used for navigation through the air. See Tennessee Code 42-1-101
  • Passenger: includes any person riding in an aircraft but having no part in its operation. See Tennessee Code 42-1-101
  • State: when applied to the different parts of the United States, includes the District of Columbia and the several territories of the United States. See Tennessee Code 1-3-105
  • Tort: A civil wrong or breach of a duty to another person, as outlined by law. A very common tort is negligent operation of a motor vehicle that results in property damage and personal injury in an automobile accident.

All crimes, torts, and other wrongs committed by or against an aeronaut or passenger while in flight over this state shall be governed by the laws of this state; and the question whether damage occasioned by or to an aircraft while in flight over this state constitutes a tort, crime, or other wrong by or against the owner of the aircraft shall be determined by the laws of this state.
