(1) The procedures contained in this section govern when the Congress of the United States:
Terms Used In Utah Code 20A-15-101
- Amendment: A proposal to alter the text of a pending bill or other measure by striking out some of it, by inserting new language, or both. Before an amendment becomes part of the measure, thelegislature must agree to it.
- Convention: means the political party convention at which party officers and delegates are selected. See Utah Code 20A-1-102
- State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 68-3-12.5
- United States: includes each state, district, and territory of the United States of America. See Utah Code 68-3-12.5
(1)(a) proposes an Amendment to the Constitution of the United States; and
(1)(b) directs that the amendment be ratified by conventions in each state.
(2) If Congress prescribes the manner in which the conventions shall be constituted and does not except those states that have established procedures for constituting ratification conventions:
(2)(a) this chapter is inoperative;
(2)(b) the convention shall be constituted and shall operate as the congressional resolution or Act of Congress directs; and
(2)(c) all state officers who are authorized or directed to take any action to constitute a ratification convention in Utah shall do so.
