4-37-202. Acquisition of aquatic animals for use in aquaculture facilities.
(1) |
Live aquatic animals intended for use in aquaculture facilities may be purchased or acquired only from:
Terms Used In Utah Code 4-37-202- Aquaculture: means the controlled cultivation of aquatic animals. See Utah Code 4-37-103
- Aquaculture facility: means any tank, canal, raceway, pond, off-stream reservoir, or other structure used for aquaculture. See Utah Code 4-37-103
- Department: means the Department of Agriculture and Food created in Chapter 2, Administration. See Utah Code 4-1-109
- Person: means a natural person or individual, corporation, organization, or other legal entity. See Utah Code 4-1-109
- State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 68-3-12.5
(a) |
aquaculture facilities within the state that have a license and health approval number; |
(b) |
public aquaculture facilities within the state that have a health approval number; or |
(c) |
sources outside the state that are health approved as provided in 5. |

(2) |
A person holding a license for an aquaculture facility shall submit annually to the department a record of each purchase of live aquatic animals and transfer of live aquatic animals into the facility. This record shall include the following information:
(a) |
name, address, and health approval number of the source; |
(b) |
date of transaction; and |
(c) |
number and weight by species. |

(3) |
The records required by Subsection (2) shall be submitted to the department before a license is renewed or a subsequent license is issued. |
