4-41a-102.1. Temporary governance over medical cannabis pharmacies.
| (1) |
As used in this section:
Terms Used In Utah Code 4-41a-102.1
| (a) |
“Pharmacy provisions” means the provisions contained in the following parts:

| (b) |
“Transition period” means the period of time beginning on July 1, 2023, and ending on January 1, 2024. |
|
| (2) |
During the transition period:
| (a) |
the department may request:
| (i) |
the Department of Health and Human Services to carry out the duties described in the pharmacy provisions; and |
| (ii) |
technical assistance from the Department of Health and Human Services related to carrying out the duties described in the pharmacy provisions; |
|
| (b) |
the department may terminate or limit the scope of the Department of Health and Human Services’ power to carry out duties described in the pharmacy provisions; and |
| (c) |
if the department requests the Department of Health and Human Services to carry out duties described in the pharmacy provisions, the department may make personnel available to the Department of Health and Human Services for carrying out the duties. |

| (3) |
Upon the request of the department under this section, the Department of Health and Human Services has the authority to carry out any duties:
| (a) |
within the scope of the request; and |
| (b) |
if related to the pharmacy provisions. |
|
| (4) |
Notwithstanding any other provision of law, the Department of Health and Human Services may use funds from the Qualified Patient Enterprise Fund, created in Section 26B-1-310, to cover any costs of Department of Health and Human Services personnel related to carrying out duties requested by the department under this section. |
