(1) There is created within the General Fund a restricted account known as the “Cannabinoid Proceeds Restricted Account.”

Terms Used In Utah Code 59-31-401

  • Appropriation: The provision of funds, through an annual appropriations act or a permanent law, for federal agencies to make payments out of the Treasury for specified purposes. The formal federal spending process consists of two sequential steps: authorization
  • City: includes , depending on population, a metro township as defined in Section 10-3c-102. See Utah Code 68-3-12.5
  • Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
  • Town: includes , depending on population, a metro township as defined in Section 10-3c-102. See Utah Code 68-3-12.5
(2) The Cannabinoid Proceeds Restricted Account consists of:

     (2)(a) revenue collected from the tax imposed by Section 59-31-301; and
     (2)(b) amounts appropriated by the Legislature.
(3) Subject to appropriation, money in the account may be used for the following:

     (3)(a) enforcement of Title 4, Chapter 41, Hemp and Cannabinoid Act by the Department of Agriculture and Food;
     (3)(b) investigations described in Section 77-39-101, regarding cannabinoid products;
     (3)(c) the Industrial Hemp Grant Program created in Section 63N-3-1302; and
     (3)(d) provided to counties, cities, and towns in proportion to the county’s, city‘s, or town‘s distribution under Section 59-12-205 for the preceding fiscal year.
