Terms Used In Vermont Statutes Title 23 Sec. 2041

  • Dealer: means a person as defined in subdivision 4(8) of this title. See
  • Lien: A claim against real or personal property in satisfaction of a debt.
  • Security interest: means an interest in a vehicle reserved or created by agreement and which secures payment or performance of an obligation. See
  • State: means a state, territory, or possession of the United States, the District of Columbia, the commonwealth of Puerto Rico, or a province of the Dominion of Canada. See
  • Statute: A law passed by a legislature.
  • Vehicle: means a motor vehicle as defined by section 4 of this title. See

§ 2041. Certain liens and security interests not affected

This chapter does not apply to or affect:

(1) a lien given by statute or rule of law to a supplier of services or materials for the vehicle;

(2) a lien given by statute to the United States, this State, or any political subdivision of this State;

(3) a security interest in a vehicle created by a manufacturer or dealer who holds the vehicle for sale, but a buyer in the ordinary course of trade from the manufacturer or dealer takes free of the security interest. (Added 1969, No. 297 (Adj. Sess.), § 1, eff. Sept. 1, 1971.)
