(1) Any liquid nicotine container that is sold at retail shall be packaged in accordance with the child-resistant effectiveness standards set forth in 16 C.F.R. § 1700.15, as in effect on June 28, 2016, as determined through testing in accordance with the method described in 16 C.F.R. § 1700.20, as in effect on June 28, 2016.

(2) Any person that engages in retail sales of liquid nicotine containers in violation of this section is guilty of a gross misdemeanor.
