Terms Used In West Virginia Code > Chapter 31A > Article 8E - Interstate Branching by De Novo Entry and Acquisition of Branches

  • Acquisition of a branch: means the acquisition of a branch located in a host state, without either engaging in an "interstate merger transaction" as defined in article eight-d of this chapter or acquiring all or substantially all of the assets of another bank by merger or purchase. See West Virginia Code 31A-8E-2
  • Assets: (1) The property comprising the estate of a deceased person, or (2) the property in a trust account.
  • Bank: has the meaning set forth in 12 U. See West Virginia Code 31A-8E-2
  • Bank holding company: has the meaning set forth in 12 U. See West Virginia Code 31A-8E-2
  • Bank supervisory agency: means :

    (1) Any agency of another state with primary responsibility for chartering and supervising banks. See West Virginia Code 31A-8E-2

  • Board: means the West Virginia Board of Banking and Financial Institutions. See West Virginia Code 31A-1-2
  • Branch: has the meaning set forth in subsection (f), section two, article one of this chapter. See West Virginia Code 31A-8E-2
  • Commissioner: means the West Virginia commissioner of banking then in office and, where appropriate, all of his or her successors and predecessors in office. See West Virginia Code 31A-8E-2
  • Contract: A legal written agreement that becomes binding when signed.
  • Control: shall be construed consistently with the provisions of 12 U. See West Virginia Code 31A-8E-2
  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • De novo branch: means a branch of a bank located in a host state which: (i) Is originally established by the bank as a branch. See West Virginia Code 31A-8E-2
  • division: means the Division of Banking of West Virginia. See West Virginia Code 31A-1-2
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • Federal Deposit Insurance Corporation: A government corporation that insures the deposits of all national and state banks that are members of the Federal Reserve System. Source: OCC
  • Federal Reserve System: The central bank of the United States. The Fed, as it is commonly called, regulates the U.S. monetary and financial system. The Federal Reserve System is composed of a central governmental agency in Washington, D.C. (the Board of Governors) and twelve regional Federal Reserve Banks in major cities throughout the United States. Source: OCC
  • Home state: means :

    (1) With respect to a state bank, the state by which the bank is chartered. See West Virginia Code 31A-8E-2

  • Home state regulator: means , with respect to an out-of-state state bank, the bank supervisory agency of the state in which the bank is chartered. See West Virginia Code 31A-8E-2
  • Host state: means a state, other than the home state of a bank, in which the bank maintains, or seeks to establish and maintain, a branch. See West Virginia Code 31A-8E-2
  • in writing: includes any representation of words, letters, or figures, whether by printing, engraving, writing, or otherwise. See West Virginia Code 2-2-10
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • Laws of the state: includes the Constitution of the State of West Virginia and the Constitution of the United States, and treaties and laws made in pursuance thereof. See West Virginia Code 2-2-10
  • National Bank: A bank that is subject to the supervision of the Comptroller of the Currency. The Office of the Comptroller of the Currency is a bureau of the U.S. Treasury Department. A national bank can be recognized because it must have "national" or "national association" in its name. Source: OCC
  • Out-of-state bank: means a bank whose home state is a state other than West Virginia. See West Virginia Code 31A-8E-2
  • Out-of-state state bank: means a bank chartered under the laws of any state other than West Virginia. See West Virginia Code 31A-8E-2
  • Public law: A public bill or joint resolution that has passed both chambers and been enacted into law. Public laws have general applicability nationwide.
  • State: means any state of the United States, the District of Columbia, any territory of the United States, Puerto Rico, Guam, the Virgin Islands and American Samoa. See West Virginia Code 31A-8E-2
  • West Virginia state bank: means a bank chartered under the laws of West Virginia. See West Virginia Code 31A-8E-2
