A. A notarial officer may refuse to perform a notarial act if the notarial officer is not satisfied that either:

  • Notarial officer: means a notary public or other individual who is authorized to perform a notarial act. See Arizona Laws 41-251
  • Record: means information that is either:

    (a) Inscribed on a tangible medium. See Arizona Laws 41-251

  • Signature: means a tangible symbol or an electronic signature that evidences the signing of a record. See Arizona Laws 41-251

1. The individual executing the record is competent or has the capacity to execute the record.

2. The individual’s signature is knowingly and voluntarily made.

B. A notarial officer may refuse to perform a notarial act unless refusal is prohibited by any law other than this article.
