Sec. 8. A court may find that a child is not a child in need of services under IC 31-34-1-1 if the court finds, based on credible evidence presented by the child’s parent, guardian, or custodian, that the parent, guardian, or custodian:

(1) is financially unable to supply the child with necessary food, clothing, or shelter; and

Terms Used In Indiana Code 31-34-12-8

  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
(2) has not failed, refused, or demonstrated an inability to seek financial or other reasonable means to do so.
