Terms Used In Iowa Code 633A.4605

  • Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
  • person: means individual, corporation, limited liability company, government or governmental subdivision or agency, business trust, estate, trust, partnership or association, or any other legal entity. See Iowa Code 4.1
  • property: includes personal and real property. See Iowa Code 4.1
  • Trustee: A person or institution holding and administering property in trust.
633A.4605 Liability for wrongful taking, concealing, or disposing of trust property.
A person who, in bad faith, wrongfully takes, conceals, or disposes of trust property is
liable for twice the value of the property, attorney fees, court costs, and where consistent with existing law, punitive damages, recoverable in an action by a trustee for the benefit of the trust.
