Terms Used In Iowa Code 805.11

  • Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
805.11 Other penalties.
If the defendant is convicted of a scheduled violation, the penalty is the scheduled fine,
without suspension of the fine prescribed in § 805.8A, 805.8B, or 805.8C together with costs assessed and distributed as prescribed by § 602.8106, unless it appears from the evidence that the violation was of the type set forth in § 805.10, subsection 1, paragraph “”a”” or “”c””, in which event the scheduled fine does not apply and the penalty shall be increased within the limits provided by law for the offense.
