Terms Used In Kansas Statutes 38-2338

  • Residence: means the place which is adopted by a person as the person's place of habitation and to which, whenever the person is absent, the person has the intention of returning. See Kansas Statutes 77-201
  • Summons: Another word for subpoena used by the criminal justice system.

(a) Summons, notice of hearing or other process may be served pursuant to Kan. Stat. Ann. § 60-303, and amendments thereto, or as provided in subsection (b).

(b) Service may be made by first-class mail, addressed to the individual to be served at the usual place of residence of the person with postage prepaid, and is completed upon the person appearing before the court in response thereto. If the person fails to appear when served by first-class mail, the summons, notice or other process shall be pursuant to Kan. Stat. Ann. § 60-303, and amendments thereto.
