Terms Used In Louisiana Revised Statutes 40:2254.7

  • Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.

A party to a cooperative agreement may appeal, in the manner provided in the Administrative Procedure Act, a final decision by the department to deny an application for a certificate or a decision by the department to revoke a certificate.  A revocation of a certificate pursuant to La. Rev. Stat. 40:2254.6 does not become final until the time for appeal has expired.  If a decision to revoke a certificate is appealed, the decision is stayed pending resolution of the appeal by the courts.
