Section 92A. On written petition of any person, corporation or municipality aggrieved by the refusal or neglect to supply gas in bulk at reasonable rates by any person, corporation or municipality engaged, subject to the provisions of this chapter, in the manufacture, transmission or sale of gas, the department may, after notice to such last-mentioned person, corporation or municipality to appear at a time and place therein named to show cause why the prayer of such petition should not be granted, issue an order directing and requiring him or it to supply the petitioner with gas, upon such terms and conditions as are legal and reasonable; provided, that such order shall not be made where it appears that compliance therewith would result in permanent financial loss to such person, corporation or municipality.

  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.

Grants of locations in streets, lanes and highways for pipes or lines necessary to the supplying of gas in pursuance of such order shall be subject to the provisions of sections eighty-six to ninety-one, inclusive.
