Terms Used In Michigan Laws 773.5

  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • Magistrate: means a judge of the district court or a judge of a municipal court. See Michigan Laws 761.1
   An oath or affirmation to the following effect shall be administered to each witness by the magistrate: “You do solemnly swear, or affirm, that the evidence you shall give at this inquest, concerning the death of the deceased, shall be the truth, the whole truth, and nothing but the truth”.
