I. Any common carrier by rail which is subject to the provisions of 49 U.S.C. § 11301 shall be subject to the provisions of N.H. Rev. Stat. § 228:82 but shall not be subject to any of the other provisions of this subdivision.
II. Any common carrier which is subject to N.H. Rev. Stat. Chapter 359-T or N.H. Rev. Stat. Chapter 376 shall not be subject to the provisions of this subdivision.
