Terms Used In Ohio Code > Chapter 9 - Miscellaneous

  • abused child: includes any child who:

    (A) Is the victim of "sexual activity" as defined under Chapter 2907 of the Revised Code, where such activity would constitute an offense under that chapter, except that the court need not find that any person has been convicted of the offense in order to find that the child is an abused child;

    (B) Is endangered as defined in section 2919. See Ohio Code 2151.031

  • Accelerant: means a fuel or oxidizing agent, such as an ignitable liquid, used to initiate a fire or increase the rate of growth or spread of a fire. See Ohio Code 2929.01
  • Account: means an arrangement under a terms-of-service agreement in which a custodian carries, maintains, processes, receives, or stores a digital asset of the user or provides goods or services to the user. See Ohio Code 2137.01
  • Acquittal:
    1. Judgement that a criminal defendant has not been proved guilty beyond a reasonable doubt.
    2. A verdict of "not guilty."
     
  • Act charged: means the act that is identified in a complaint, indictment, or information alleging that a child is a delinquent child. See Ohio Code 2152.02
  • Active duty service member: means any member of the armed forces of the United States performing active duty under title 10 of the United States Code. See Ohio Code 2913.01
  • Adequate parental care: means the provision by a child's parent or parents, guardian, or custodian of adequate food, clothing, and shelter to ensure the child's health and physical safety and the provision by a child's parent or parents of specialized services warranted by the child's physical or mental needs. See Ohio Code 2151.011
  • Adjourn: A motion to adjourn a legislative chamber or a committee, if passed, ends that day's session.
  • Adjournment sine die: The end of a legislative session "without day." These adjournments are used to indicate the final adjournment of an annual or the two-year session of legislature.
  • Adjudicated a delinquent child for committing a sexually oriented offense: includes a child who receives a serious youthful offender dispositional sentence under section 2152. See Ohio Code 2950.01
  • Administrative child support order: means any order issued by a child support enforcement agency for the support of a child pursuant to section 3109. See Ohio Code 3119.01
  • Administrative release: means a termination of jurisdiction over a particular sentence or prison term by the adult parole authority for administrative convenience. See Ohio Code 2967.01
  • administrative-related appeal: means an appeal to a court of the final order of an administrative officer, agency, board, department, tribunal, commission, or other instrumentality. See Ohio Code 2505.01
  • Admitted to a department of youth services facility: includes admission to a facility operated, or contracted for, by the department and admission to a comparable facility outside this state by another state or the United States. See Ohio Code 2152.02
  • Adult: means an individual who is eighteen years of age or older. See Ohio Code 2151.011
  • Adult: means an individual who is eighteen years of age or older. See Ohio Code 2112.01
  • Adulterate: means to cause a drug to be adulterated as described in section 3715. See Ohio Code 2925.01
  • Affidavit: A written statement of facts confirmed by the oath of the party making it, before a notary or officer having authority to administer oaths.
  • Affirmed: In the practice of the appellate courts, the decree or order is declared valid and will stand as rendered in the lower court.
  • Agent: means a person granted authority to act for a principal under a power of attorney, whether denominated as agent, attorney in fact, or otherwise. See Ohio Code 2137.01
  • Agreement for temporary custody: means a voluntary agreement authorized by section 5103. See Ohio Code 2151.011
  • agriculture: includes farming; ranching; aquaculture; algaculture meaning the farming of algae; apiculture and related apicultural activities, production of honey, beeswax, honeycomb, and other related products; horticulture; viticulture, winemaking, and related activities; animal husbandry, including, but not limited to, the care and raising of livestock, equine, and fur-bearing animals; poultry husbandry and the production of poultry and poultry products; dairy production; the production of field crops, tobacco, fruits, vegetables, nursery stock, ornamental shrubs, ornamental trees, flowers, sod, or mushrooms; timber; pasturage; any combination of the foregoing; the processing, drying, storage, and marketing of agricultural products when those activities are conducted in conjunction with, but are secondary to, such husbandry or production; and any additions or modifications to the foregoing made by the director of agriculture by rule adopted in accordance with Chapter 119 of the Revised Code. See Ohio Code 1.61
  • Allegation: something that someone says happened.
  • Alleged juvenile offender: means a child who is alleged to have committed a delinquent act in a police report or in a complaint in juvenile court that charges the commission of a delinquent act and that provides the basis for the delinquency proceeding and all subsequent proceedings to which this chapter makes reference. See Ohio Code 2930.01
  • Alternative residential facility: includes a community alternative sentencing center or district community alternative sentencing center when authorized by section 307. See Ohio Code 2929.01
  • Alternative response: means the public children services agency's response to a report of child abuse or neglect that engages the family in a comprehensive evaluation of child safety, risk of subsequent harm, and family strengths and needs and that does not include a determination as to whether child abuse or neglect occurred. See Ohio Code 2151.011
  • Amendment: A proposal to alter the text of a pending bill or other measure by striking out some of it, by inserting new language, or both. Before an amendment becomes part of the measure, thelegislature must agree to it.
  • Ancillary administration: Probate administration of property (usually real property) owned in a State other than the one in which the decedent had his (her) principal residence at the time of death.
  • Anhydrous ammonia: is a compound formed by the combination of two gaseous elements, nitrogen and hydrogen, in the manner described in this division. See Ohio Code 2913.01
  • Annuity: A periodic (usually annual) payment of a fixed sum of money for either the life of the recipient or for a fixed number of years. A series of payments under a contract from an insurance company, a trust company, or an individual. Annuity payments are made at regular intervals over a period of more than one full year.
  • Another: when used to designate the owner of property which is the subject of an offense, includes not only natural persons but also every other owner of property. See Ohio Code 1.02
  • Answer: The formal written statement by a defendant responding to a civil complaint and setting forth the grounds for defense.
  • anything of value: includes :

    (A) Money, bank bills or notes, United States treasury notes, and other bills, bonds, or notes issued by lawful authority and intended to pass and circulate as money;

    (B) Goods and chattels;

    (C) Promissory notes, bills of exchange, orders, drafts, warrants, checks, or bonds given for the payment of money;

    (D) Receipts given for the payment of money or other property;

    (E) Rights in action;

    (F) Things which savor of the realty and are, at the time they are taken, a part of the freehold, whether they are of the substance or produce thereof or affixed thereto, although there may be no interval between the severing and taking away;

    (G) Any interest in realty, including fee simple and partial interests, present and future, contingent or vested interests, beneficial interests, leasehold interests, and any other interest in realty;

    (H) Any promise of future employment;

    (I) Every other thing of value. See Ohio Code 1.03

  • Appeal: means all proceedings in which a court reviews or retries a cause determined by another court, or by an administrative officer, agency, board, department, tribunal, commission, or other instrumentality. See Ohio Code 2505.01
  • Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
  • Appellate: About appeals; an appellate court has the power to review the judgement of another lower court or tribunal.
  • Applicant: means , as context requires, a person who makes the filing under section 2717. See Ohio Code 2717.01
  • Application: means , as context requires, an application under section 2717. See Ohio Code 2717.01
  • Appraisal: A determination of property value.
  • Appropriation: The provision of funds, through an annual appropriations act or a permanent law, for federal agencies to make payments out of the Treasury for specified purposes. The formal federal spending process consists of two sequential steps: authorization
  • Aquatic device: means any vessel, or any water skis, aquaplane, or similar device. See Ohio Code 2930.01
  • Arbitral award: means any decisions of the arbitral tribunal on the substance of the dispute submitted to it and includes an interim, interlocutory, or partial arbitral award. See Ohio Code 2712.01
  • Arbitral tribunal: means a sole arbitrator or a panel of arbitrators. See Ohio Code 2712.01
  • Arbitration: means any arbitration, whether or not administered by a permanent arbitral institution. See Ohio Code 2712.01
  • Arbitration agreement: means an agreement by the parties to submit to arbitration all or certain disputes that have arisen or that may arise between them in respect of a defined legal, contractual or other relationship. See Ohio Code 2712.01
  • Arraignment: A proceeding in which an individual who is accused of committing a crime is brought into court, told of the charges, and asked to plead guilty or not guilty.
  • Arrest: Taking physical custody of a person by lawful authority.
  • Asset forfeiture: A procedure by which a person's property is seized to pay judgments levied by the court.
  • Assets: (1) The property comprising the estate of a deceased person, or (2) the property in a trust account.
  • Attachment: A procedure by which a person's property is seized to pay judgments levied by the court.
  • Attorney-in-fact: A person who, acting as an agent, is given written authorization by another person to transact business for him (her) out of court.
  • award: means an award made under sections 2743. See Ohio Code 2743.01
  • Bail: Security given for the release of a criminal defendant or witness from legal custody (usually in the form of money) to secure his/her appearance on the day and time appointed.
  • Bailiff: a court officer who enforces the rules of behavior in courtrooms.
  • Bankruptcy: Refers to statutes and judicial proceedings involving persons or businesses that cannot pay their debts and seek the assistance of the court in getting a fresh start. Under the protection of the bankruptcy court, debtors may discharge their debts, perhaps by paying a portion of each debt. Bankruptcy judges preside over these proceedings.
  • Basic probation supervision: includes basic parole supervision and basic post-release control supervision. See Ohio Code 2929.01
  • Beneficiary: A person who is entitled to receive the benefits or proceeds of a will, trust, insurance policy, retirement plan, annuity, or other contract. Source: OCC
  • Bequeath: To gift property by will.
  • Bequest: Property gifted by will.
  • Bet: means the hazarding of anything of value upon the result of an event, undertaking, or contingency, but does not include a bona fide business risk. See Ohio Code 2915.01
  • Bingo: means either of the following:

    (1) A game with all of the following characteristics:

    (a) The participants use bingo cards or sheets, including paper formats and electronic representation or image formats, that are divided into twenty-five spaces arranged in five horizontal and five vertical rows of spaces, with each space, except the central space, being designated by a combination of a letter and a number and with the central space being designated as a free space. See Ohio Code 2915.01

  • Bingo game operator: means any person, except security personnel, who performs work or labor at the site of bingo, including, but not limited to, collecting money from participants, handing out bingo cards or sheets or objects to cover spaces on bingo cards or sheets, selecting from a receptacle the objects that contain the combination of letters and numbers that appear on bingo cards or sheets, calling out the combinations of letters and numbers, distributing prizes, selling or redeeming instant bingo tickets or cards, selling or redeeming electronic instant bingo tickets, credits, or vouchers, accessing an electronic instant bingo system other than as a participant, supervising the operation of a punch board, selling raffle tickets, selecting raffle tickets from a receptacle and announcing the winning numbers in a raffle, and preparing, selling, and serving food or beverages. See Ohio Code 2915.01
  • Bingo session: means a period that includes both of the following:

    (1) Not to exceed five continuous hours for the conduct of one or more games described in division (O)(1) of this section, instant bingo, and electronic instant bingo;

    (2) A period for the conduct of instant bingo and electronic instant bingo for not more than two hours before and not more than two hours after the period described in division (S)(1) of this section. See Ohio Code 2915.01

  • Bingo supplies: means bingo cards or sheets; instant bingo tickets or cards; electronic bingo aids; raffle tickets; punch boards; seal cards; instant bingo ticket dispensers; electronic instant bingo systems; and devices for selecting or displaying the combination of bingo letters and numbers or raffle tickets. See Ohio Code 2915.01
  • Bond: includes an undertaking. See Ohio Code 1.02
  • Bookmaking: means the business of receiving or paying off bets. See Ohio Code 2915.01
  • Cable television service: means any services provided by or through the facilities of any cable television system or other similar closed circuit coaxial cable communications system, or any microwave or similar transmission service used in connection with any cable television system or other similar closed circuit coaxial cable communications system. See Ohio Code 2913.01
  • Capital offense: A crime punishable by death.
  • Carries: means engages in the transmission of an electronic communication. See Ohio Code 2137.01
  • Case: means a delinquency proceeding and all related activity or a criminal prosecution and all related activity. See Ohio Code 2930.01
  • Case law: The law as laid down in cases that have been decided in the decisions of the courts.
  • Cash medical support: means an amount ordered to be paid in a child support order toward the ordinary medical expenses incurred during a calendar year. See Ohio Code 3119.01
  • Catalogue of electronic communications: means information that identifies each person with which a user has had an electronic communication, the time and date of the communication, and the electronic address of the person. See Ohio Code 2137.01
  • Category one offense: means any of the following:

    (1) A violation of section 2903. See Ohio Code 2152.02

  • Category two offense: means any of the following:

    (1) A violation of section 2903. See Ohio Code 2152.02

  • Certificate of limited partnership: means the certificate referred to in section 1782. See Ohio Code 1782.01
  • Certified foster home: means a foster home, as defined in section 5103. See Ohio Code 2151.011
  • Certified grievance committee: means a duly constituted and organized committee of the Ohio state bar association or of one or more local bar associations of the state of Ohio that complies with the criteria set forth in Rule V, section 6 of the Rules for the Government of the Bar of Ohio. See Ohio Code 2925.01
  • Certified nurse practitioner: means an advanced practice registered nurse who holds a current, valid license issued under Chapter 4723 of the Revised Code and is designated as a certified nurse practitioner in accordance with section 4723. See Ohio Code 1.64
  • Certified nurse-midwife: means an advanced practice registered nurse who holds a current, valid license issued under Chapter 4723 of the Revised Code and is designated as a certified nurse-midwife in accordance with section 4723. See Ohio Code 1.64
  • Chambers: A judge's office.
  • Charge to the jury: The judge's instructions to the jury concerning the law that applies to the facts of the case on trial.
  • Charitable bingo game: means any bingo game described in division (O)(1) or (2) of this section that is conducted by a charitable organization that has obtained a license pursuant to section 2915. See Ohio Code 2915.01
  • Charitable instant bingo organization: means an organization that is exempt from federal income taxation under subsection 501(a) and described in subsection 501(c)(3) of the Internal Revenue Code and is a charitable organization as defined in this section. See Ohio Code 2915.01
  • charitable organization: means either of the following:

    (1) An organization that is exempt from federal income taxation under subsection 501(a) and described in subsection 501(c)(3) of the Internal Revenue Code;

    (2) A volunteer rescue service organization, volunteer firefighter's organization, veteran's organization, fraternal organization, or sporting organization that is exempt from federal income taxation under subsection 501(c)(4), (c)(7), (c)(8), (c)(10), or (c)(19) of the Internal Revenue Code. See Ohio Code 2915.01

  • Charitable purpose: means that the net profit of bingo, other than instant bingo or electronic instant bingo, is used by, or is given, donated, or otherwise transferred to, any of the following:

    (1) Any organization that is described in subsection 509(a)(1), 509(a)(2), or 509(a)(3) of the Internal Revenue Code and is either a governmental unit or an organization that is tax exempt under subsection 501(a) and described in subsection 501(c)(3) of the Internal Revenue Code;

    (2) A veteran's organization that is a post, chapter, or organization of veterans, or an auxiliary unit or society of, or a trust or foundation for, any such post, chapter, or organization organized in the United States or any of its possessions, at least seventy-five per cent of the members of which are veterans and substantially all of the other members of which are individuals who are spouses, widows, or widowers of veterans, or such individuals, provided that no part of the net earnings of such post, chapter, or organization inures to the benefit of any private shareholder or individual, and further provided that the net profit is used by the post, chapter, or organization for the charitable purposes set forth in division (B)(12) of section 5739. See Ohio Code 2915.01

  • Charity: An agency, institution, or organization in existence and operating for the benefit of an indefinite number of persons and conducted for educational, religious, scientific, medical, or other beneficent purposes.
  • Chief executive: means the chief executive of the municipal corporation in which a municipal court, other than a county-operated municipal court, is located, and means the respective chairman of the board of county commissioners of the county in which a county-operated municipal court is located. See Ohio Code 1901.03
  • Child: means a person who is under eighteen years of age, except that the juvenile court has jurisdiction over any person who is adjudicated an unruly child prior to attaining eighteen years of age until the person attains twenty-one years of age, and, for purposes of that jurisdiction related to that adjudication, a person who is so adjudicated an unruly child shall be deemed a "child" until the person attains twenty-one years of age. See Ohio Code 2151.011
  • Child: means a person who is under eighteen years of age, except as otherwise provided in divisions (C)(2) to (8) of this section. See Ohio Code 2152.02
  • Child: includes child by adoption. See Ohio Code 1.59
  • Child: means an individual, whether over or under the age of majority, who is or is alleged to be owed a duty of support by the individual's parent or who is or is alleged to be the beneficiary of a support order directed to the parent. See Ohio Code 3115.102
  • Child care cost: means annual out-of-pocket costs for the care and supervision of a child or children subject to the order that is related to work or employment training. See Ohio Code 3119.01
  • child support enforcement agency: means a child support enforcement agency designated under former section 2301. See Ohio Code 3119.01
  • Child support order: means either a court child support order or an administrative child support order. See Ohio Code 3119.01
  • Child-support order: means a support order for a child, including a child who has attained the age of majority under the law of the issuing state or foreign country. See Ohio Code 3115.102
  • Child-victim offender: means a person who is convicted of, pleads guilty to, has been convicted of, has pleaded guilty to, is adjudicated a delinquent child for committing, or has been adjudicated a delinquent child for committing any child-victim oriented offense. See Ohio Code 2950.01
  • Child-victim oriented offense: means any of the following violations or offenses committed by a person, regardless of the person's age, when the victim is under eighteen years of age and is not a child of the person who commits the violation:

    (1) A violation of division (A)(1), (2), (3), or (5) of section 2905. See Ohio Code 2950.01

  • Circumstantial evidence: All evidence except eyewitness testimony.
  • City treasurer: means the treasurer of the municipal corporation in which a municipal court, other than a county-operated municipal court, is located. See Ohio Code 1901.03
  • City treasury: means the treasury of the municipal corporation in which a municipal court, other than a county-operated municipal court, is located. See Ohio Code 1901.03
  • Civil forfeiture: The loss of ownership of property used to conduct illegal activity.
  • claim: means a claim for an award of reparations made under sections 2743. See Ohio Code 2743.01
  • Clerk of court: An officer appointed by the court to work with the chief judge in overseeing the court's administration, especially to assist in managing the flow of cases through the court and to maintain court records.
  • Clinical nurse specialist: means an advanced practice registered nurse who holds a current, valid license issued under Chapter 4723 of the Revised Code and is designated as a clinical nurse specialist in accordance with section 4723. See Ohio Code 1.64
  • Cocaine: means any of the following:

    (1) A cocaine salt, isomer, or derivative, a salt of a cocaine isomer or derivative, or the base form of cocaine;

    (2) Coca leaves or a salt, compound, derivative, or preparation of coca leaves, including ecgonine, a salt, isomer, or derivative of ecgonine, or a salt of an isomer or derivative of ecgonine;

    (3) A salt, compound, derivative, or preparation of a substance identified in division (X)(1) or (2) of this section that is chemically equivalent to or identical with any of those substances, except that the substances shall not include decocainized coca leaves or extraction of coca leaves if the extractions do not contain cocaine or ecgonine. See Ohio Code 2925.01

  • Codicil: An addition, change, or supplement to a will executed with the same formalities required for the will itself.
  • Coin machine: means any mechanical or electronic device designed to do both of the following:

    (1) Receive a coin, bill, or token made for that purpose;

    (2) In return for the insertion or deposit of a coin, bill, or token, automatically dispense property, provide a service, or grant a license. See Ohio Code 2913.01

  • Commercial purpose: means the use of or reference to an aspect of an individual's persona in any of the following manners:

    (1) On or in connection with a place, product, merchandise, goods, services, or other commercial activities not expressly exempted under this chapter;

    (2) For advertising or soliciting the purchase of products, merchandise, goods, services, or other commercial activities not expressly exempted under this chapter;

    (3) For the purpose of promoting travel to a place;

    (4) For the purpose of fundraising. See Ohio Code 2741.01

  • Commit: means to vest custody as ordered by the court. See Ohio Code 2151.011
  • Common disaster: A sudden and extraordinary misfortune that brings about the simultaneous or near-simultaneous deaths of two or more associated persons, such as husband and wife.
  • Common law: The legal system that originated in England and is now in use in the United States. It is based on judicial decisions rather than legislative action.
  • Community control sanction: includes probation if the sentence involved was imposed for a felony that was committed prior to July 1, 1996, or if the sentence involved was imposed for a misdemeanor that was committed prior to January 1, 2004. See Ohio Code 2929.01
  • Community-based correctional facility: means a community-based correctional facility and program or district community-based correctional facility and program developed pursuant to sections 2301. See Ohio Code 2929.01
  • commutation of sentence: means the substitution by the governor of a lesser for a greater punishment. See Ohio Code 2967.01
  • Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
  • Computer: includes , but is not limited to, all input, output, processing, storage, computer program, or communication facilities that are connected, or related, in a computer system or network to an electronic device of that nature. See Ohio Code 2913.01
  • Computer network: means a set of related and remotely connected computers and communication facilities that includes more than one computer system that has the capability to transmit among the connected computers and communication facilities through the use of computer facilities. See Ohio Code 2913.01
  • Computer program: means an ordered set of data representing coded instructions or statements that, when executed by a computer, cause the computer to process data. See Ohio Code 2913.01
  • Computer software: means computer programs, procedures, and other documentation associated with the operation of a computer system. See Ohio Code 2913.01
  • Computer system: means a computer and related devices, whether connected or unconnected, including, but not limited to, data input, output, and storage devices, data communications links, and computer programs and data that make the system capable of performing specified special purpose data processing tasks. See Ohio Code 2913.01
  • Conciliation: means any conciliation, whether or not administered by a permanent conciliation institution. See Ohio Code 2712.01
  • Conduct: means to back, promote, organize, manage, carry on, sponsor, or prepare for the operation of bingo or a game of chance, a scheme of chance, or a sweepstakes. See Ohio Code 2915.01
  • Confinement: includes , but is not limited to, a community residential sanction imposed pursuant to section 2929. See Ohio Code 2950.01
  • Conform: means to make a person's legal name consistent in all official identity documents by correcting a misspelling, inconsistency, or other error in an official identity document. See Ohio Code 2717.01
  • Content of an electronic communication: means information concerning the substance or meaning of the communication that meets all of the following conditions:

    (1) It has been sent or received by a user. See Ohio Code 2137.01

  • Continuance: Putting off of a hearing ot trial until a later time.
  • Continuous alcohol monitoring: means the ability to automatically test and periodically transmit alcohol consumption levels and tamper attempts at least every hour, regardless of the location of the person who is being monitored. See Ohio Code 2929.01
  • Contract: A legal written agreement that becomes binding when signed.
  • Contribution: means any cash, property, services rendered, or promissory note or other binding obligation to contribute cash or property or to perform services, that a partner contributes to a limited partnership in his capacity as a partner. See Ohio Code 1782.01
  • Convention: means the convention on the international recovery of child support and other forms of family maintenance, concluded at The Hague on November 23, 2007. See Ohio Code 3115.102
  • Convict: means a person who has been convicted of a felony under the laws of this state, whether or not actually confined in a state correctional institution, unless the person has been pardoned or has served the person's sentence or prison term. See Ohio Code 2967.01
  • Conviction: A judgement of guilt against a criminal defendant.
  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • Counseling: includes both of the following:

    (a) General counseling services performed by a public children services agency or shelter for victims of domestic violence to assist a child, a child's parents, and a child's siblings in alleviating identified problems that may cause or have caused the child to be an abused, neglected, or dependent child. See Ohio Code 2151.011

  • Counterclaim: A claim that a defendant makes against a plaintiff.
  • Counterfeit controlled substance: means any of the following:

    (1) Any drug that bears, or whose container or label bears, a trademark, trade name, or other identifying mark used without authorization of the owner of rights to that trademark, trade name, or identifying mark;

    (2) Any unmarked or unlabeled substance that is represented to be a controlled substance manufactured, processed, packed, or distributed by a person other than the person that manufactured, processed, packed, or distributed it;

    (3) Any substance that is represented to be a controlled substance but is not a controlled substance or is a different controlled substance;

    (4) Any substance other than a controlled substance that a reasonable person would believe to be a controlled substance because of its similarity in shape, size, and color, or its markings, labeling, packaging, distribution, or the price for which it is sold or offered for sale. See Ohio Code 2925.01

  • Counterfeit telecommunications device: includes , but is not limited to, a clone telephone, clone microchip, tumbler telephone, or tumbler microchip; a wireless scanning device capable of acquiring, intercepting, receiving, or otherwise facilitating the use of telecommunications service or information service without immediate detection; or a device, equipment, hardware, or software designed for, or capable of, altering or changing the electronic serial number in a wireless telephone. See Ohio Code 2913.01
  • County-operated municipal court: means the Auglaize county, Brown county, Carroll county, Clermont county, Columbiana county, Crawford county, Darke county, Erie county, Hamilton county, Hocking county, Holmes county, Jackson county, Lawrence county, Madison county, Miami county, Montgomery county, Morrow county, Ottawa county, Portage county, Putnam county, or Wayne county municipal court and, effective January 1, 2018, also includes the Perry county municipal court, and, effective January 1, 2020, also includes the Paulding county municipal court, and, effective January 1, 2024, also includes the Fulton county municipal court. See Ohio Code 1901.03
  • Court: means a court of common pleas, juvenile court, municipal court, or county court. See Ohio Code 2930.01
  • Court: means a body or an organ of the judicial system of a state. See Ohio Code 2712.01
  • Court: means the probate court for all matters in which the court has exclusive jurisdiction under section 2101. See Ohio Code 2137.01
  • Court child support order: means any order issued by a court for the support of a child pursuant to Chapter 3115 of the Revised Code, section 2151. See Ohio Code 3119.01
  • Court of common pleas: means the court of common pleas of the county of this state described in or selected pursuant to section 2712. See Ohio Code 2712.01
  • Court reporter: A person who makes a word-for-word record of what is said in court and produces a transcript of the proceedings upon request.
  • Court support order: means either a court child support order or an order for the support of a spouse or former spouse issued pursuant to Chapter 3115 of the Revised Code, section 3105. See Ohio Code 3119.01
  • Court-ordered parenting time: means the amount of parenting time a parent is to have under a parenting time order or the amount of time the children are to be in the physical custody of a parent under a shared parenting order. See Ohio Code 3119.01
  • CPI-U: means the consumer price index for all urban consumers, published by the United States department of labor, bureau of labor statistics. See Ohio Code 3119.01
  • Credit card: includes , but is not limited to, a card, code, device, or other means of access to a customer's account for the purpose of obtaining money, property, labor, or services on credit, or for initiating an electronic fund transfer at a point-of-sale terminal, an automated teller machine, or a cash dispensing machine. See Ohio Code 2913.01
  • Criminal offense: means an alleged act or omission committed by a person that is punishable by incarceration and is not eligible to be disposed of by the traffic violations bureau. See Ohio Code 2930.01
  • Cultivate: includes planting, watering, fertilizing, or tilling. See Ohio Code 2925.01
  • Curfew: means a requirement that an offender during a specified period of time be at a designated place. See Ohio Code 2929.01
  • Custodial agency: means one of the following:

    (1) The entity that has custody of a defendant or an alleged juvenile offender who is incarcerated for a criminal offense, is under detention for the commission of a delinquent act, or who is detained after a finding of incompetence to stand trial or not guilty by reason of insanity relative to a criminal offense, including any of the following:

    (a) The department of rehabilitation and correction or the adult parole authority;

    (b) A county sheriff;

    (c) The entity that administers a jail, as defined in section 2929. See Ohio Code 2930.01

  • Custodian: means a person who has legal custody of a child or a public children services agency or private child placing agency that has permanent, temporary, or legal custody of a child. See Ohio Code 2151.011
  • Custodian: means a person that carries, maintains, processes, receives, or stores a digital asset of a user. See Ohio Code 2137.01
  • Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
  • Data: means a representation of information, knowledge, facts, concepts, or instructions that are being or have been prepared in a formalized manner and that are intended for use in a computer, computer system, or computer network. See Ohio Code 2913.01
  • Day reporting: means a sanction pursuant to which an offender is required each day to report to and leave a center or other approved reporting location at specified times in order to participate in work, education or training, treatment, and other approved programs at the center or outside the center. See Ohio Code 2929.01
  • Deal: means a single game of instant bingo tickets, or a single game of electronic instant bingo tickets, all with the same serial number. See Ohio Code 2915.01
  • Debt scheduling: means counseling and assistance provided to a consumer by a budget and debt counseling service under all of the following circumstances:

    (a) The counseling and assistance is manifested in an agreement between the consumer and the service under which the consumer regularly pays that portion of the consumer's income to the service that has been determined not to be required for the maintenance of health or the essentials of life. See Ohio Code 2716.03

  • Decedent: A deceased person.
  • Deception: means knowingly deceiving another or causing another to be deceived by any false or misleading representation, by withholding information, by preventing another from acquiring information, or by any other conduct, act, or omission that creates, confirms, or perpetuates a false impression in another, including a false impression as to law, value, state of mind, or other objective or subjective fact. See Ohio Code 2913.01
  • Deed: The legal instrument used to transfer title in real property from one person to another.
  • Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
  • Defendant: means a person who is alleged to be the perpetrator of a criminal offense in a complaint, indictment, or information that charges the commission of a criminal offense and that provides the basis for the criminal prosecution and subsequent proceedings to which this chapter makes reference. See Ohio Code 2930.01
  • defense: means the defense against criminal charges in a criminal prosecution or the defense against a delinquent child complaint in a delinquency proceeding. See Ohio Code 2930.01
  • Defense attorney: Represent defendants in criminal matters.
  • Defraud: means to knowingly obtain, by deception, some benefit for oneself or another, or to knowingly cause, by deception, some detriment to another. See Ohio Code 2913.01
  • Delinquency proceeding: means all proceedings in a juvenile court that are related to a case in which a complaint has been filed alleging that a child is a delinquent child. See Ohio Code 2930.01
  • Delinquent act: means an alleged act committed by a child, regardless of whether the child is competent, that does any of the following and is not disposed of by the juvenile traffic violations bureau serving the court under Traffic Rule 13. See Ohio Code 2930.01
  • Delinquent child: includes any of the following:

    (1) Any child, except a juvenile traffic offender, who violates any law of this state or the United States, or any ordinance of a political subdivision of the state, that would be an offense if committed by an adult;

    (2) Any child who violates any lawful order of the court made under this chapter, including a child who violates a court order regarding the child's prior adjudication as an unruly child for being an habitual truant;

    (3) Any child who violates any lawful order of the court made under Chapter 2151 of the Revised Code other than an order issued under section 2151. See Ohio Code 2152.02

  • Dependent: A person dependent for support upon another.
  • dependent child: means any child:

    (A) Who is homeless or destitute or without adequate parental care, through no fault of the child's parents, guardian, or custodian;

    (B) Who lacks adequate parental care by reason of the mental or physical condition of the child's parents, guardian, or custodian;

    (C) Whose condition or environment is such as to warrant the state, in the interests of the child, in assuming the child's guardianship;

    (D) To whom both of the following apply:

    (1) The child is residing in a household in which a parent, guardian, custodian, or other member of the household committed an act that was the basis for an adjudication that a sibling of the child or any other child who resides in the household is an abused, neglected, or dependent child. See Ohio Code 2151.04

  • Deposition: An oral statement made before an officer authorized by law to administer oaths. Such statements are often taken to examine potential witnesses, to obtain discovery, or to be used later in trial.
  • Deprive: means to do any of the following:

    (1) Withhold property of another permanently, or for a period that appropriates a substantial portion of its value or use, or with purpose to restore it only upon payment of a reward or other consideration;

    (2) Dispose of property so as to make it unlikely that the owner will recover it;

    (3) Accept, use, or appropriate money, property, or services, with purpose not to give proper consideration in return for the money, property, or services, and without reasonable justification or excuse for not giving proper consideration. See Ohio Code 2913.01

  • Designated recipient: means a person chosen by a user using an online tool to administer digital assets of the user. See Ohio Code 2137.01
  • Detention: means the temporary care of children pending court adjudication or disposition, or execution of a court order, in a public or private facility designed to physically restrict the movement and activities of children. See Ohio Code 2151.011
  • Devise: To gift property by will.
  • Differential response approach: means an approach that a public children services agency may use to respond to accepted reports of child abuse or neglect with either an alternative response or a traditional response. See Ohio Code 2151.011
  • Digital asset: means an electronic record in which an individual has a right or interest. See Ohio Code 2137.01
  • Disabled adult: means a person who is eighteen years of age or older and has some impairment of body or mind that makes the person unable to work at any substantially remunerative employment that the person otherwise would be able to perform and that will, with reasonable probability, continue for a period of at least twelve months without any present indication of recovery from the impairment, or who is eighteen years of age or older and has been certified as permanently and totally disabled by an agency of this state or the United States that has the function of so classifying persons. See Ohio Code 2913.01
  • Disciplinary counsel: means the disciplinary counsel appointed by the board of commissioners on grievances and discipline of the supreme court under the Rules for the Government of the Bar of Ohio. See Ohio Code 2925.01
  • Discovery: Lawyers' examination, before trial, of facts and documents in possession of the opponents to help the lawyers prepare for trial.
  • Discretionary serious youthful offender: means a person who is eligible for a discretionary SYO and who is not transferred to adult court under a mandatory or discretionary transfer. See Ohio Code 2152.02
  • Discretionary SYO: means a case in which the juvenile court, in the juvenile court's discretion, may impose a serious youthful offender disposition under section 2152. See Ohio Code 2152.02
  • Discretionary transfer: means that the juvenile court has discretion to transfer a case for criminal prosecution under division (B) of section 2152. See Ohio Code 2152.02
  • Dismissal: The dropping of a case by the judge without further consideration or hearing. Source:
  • Distributor: means any person who purchases or obtains bingo supplies and who does either of the following:

    (1) Sells, offers for sale, or otherwise provides or offers to provide the bingo supplies to another person for use in this state;

    (2) Modifies, converts, adds to, or removes parts from the bingo supplies to further their promotion or sale for use in this state. See Ohio Code 2915.01

  • Docket: A log containing brief entries of court proceedings.
  • Donee: The recipient of a gift.
  • Donor: The person who makes a gift.
  • Dower: A widow
  • Drug abuse offense: means any of the following:

    (1) A violation of division (A) of section 2913. See Ohio Code 2925.01

  • Drug and alcohol use monitoring: means a program under which an offender agrees to submit to random chemical analysis of the offender's blood, breath, or urine to determine whether the offender has ingested any alcohol or other drugs. See Ohio Code 2929.01
  • Drug treatment program: means any program under which a person undergoes assessment and treatment designed to reduce or completely eliminate the person's physical or emotional reliance upon alcohol, another drug, or alcohol and another drug and under which the person may be required to receive assessment and treatment on an outpatient basis or may be required to reside at a facility other than the person's home or residence while undergoing assessment and treatment. See Ohio Code 2929.01
  • Duty of support: means an obligation imposed or imposable by law to provide support for a child, spouse, or former spouse, including an unsatisfied obligation to provide support. See Ohio Code 3115.102
  • Economic loss: means any economic detriment suffered by a victim as a direct and proximate result of the commission of an offense and includes any loss of income due to lost time at work because of any injury caused to the victim, any property loss, medical cost, or funeral expense incurred as a result of the commission of the offense, and the cost of any accounting or auditing done to determine the extent of loss if the cost is incurred and payable by the victim. See Ohio Code 2929.01
  • Economic loss: means any economic detriment suffered by a victim of a delinquent act or juvenile traffic offense as a direct and proximate result of the delinquent act or juvenile traffic offense and includes any loss of income due to lost time at work because of any injury caused to the victim and any property loss, medical cost, or funeral expense incurred as a result of the delinquent act or juvenile traffic offense. See Ohio Code 2152.02
  • Education or training: includes study at, or in conjunction with a program offered by, a university, college, or technical college or vocational study and also includes the completion of primary school, secondary school, and literacy curricula or their equivalent. See Ohio Code 2929.01
  • Elderly person: means a person who is sixty-five years of age or older. See Ohio Code 2913.01
  • Electronic: means relating to technology having electrical, digital, magnetic, wireless, optical, electromagnetic, or similar capabilities. See Ohio Code 2137.01
  • Electronic bingo aid: means an electronic device used by a participant to monitor bingo cards or sheets purchased at the time and place of a bingo session and that does all of the following:

    (a) It provides a means for a participant to input numbers and letters announced by a bingo caller. See Ohio Code 2915.01

  • electronic device: means a mechanical, video, digital, or electronic machine or device that is capable of displaying information on a screen or other mechanism and that is owned, leased, or otherwise possessed by any person conducting a scheme of chance, or by that person's partners, affiliates, subsidiaries, or contractors. See Ohio Code 2915.01
  • Electronic instant bingo: means a form of bingo that consists of an electronic or digital representation of instant bingo in which a participant wins a prize if the participant's electronic instant bingo ticket contains a combination of numbers or symbols that was designated in advance as a winning combination, and to which all of the following apply:

    (a) Each deal has a predetermined, finite number of winning and losing tickets and a predetermined prize amount and deal structure, provided that there may be multiple winning combinations in each deal and multiple winning tickets. See Ohio Code 2915.01

  • Electronic instant bingo system: means both of the following:

    (1) A mechanical, electronic, digital, or video device and associated software to which all of the following apply:

    (a) It is used by not more than one player at a time to play electronic instant bingo on a single screen that is physically connected to the device;

    (b) It is located on the premises of the principal place of business of a veteran's or fraternal organization that holds a type II or type III bingo license to conduct electronic instant bingo at that location issued under section 2915. See Ohio Code 2915.01

  • Electronic monitoring: means monitoring through the use of an electronic monitoring device. See Ohio Code 2929.01
  • Electronic monitoring device: means any of the following:

    (1) Any device that can be operated by electrical or battery power and that conforms with all of the following:

    (a) The device has a transmitter that can be attached to a person, that will transmit a specified signal to a receiver of the type described in division (UU)(1)(b) of this section if the transmitter is removed from the person, turned off, or altered in any manner without prior court approval in relation to electronic monitoring or without prior approval of the department of rehabilitation and correction in relation to the use of an electronic monitoring device for an inmate on transitional control or otherwise is tampered with, that can transmit continuously and periodically a signal to that receiver when the person is within a specified distance from the receiver, and that can transmit an appropriate signal to that receiver if the person to whom it is attached travels a specified distance from that receiver. See Ohio Code 2929.01

  • Electronic-communication service: means a custodian that provides to a user the ability to send or receive an electronic communication. See Ohio Code 2137.01
  • Embezzlement: In most states, embezzlement is defined as theft/larceny of assets (money or property) by a person in a position of trust or responsibility over those assets. Embezzlement typically occurs in the employment and corporate settings. Source: OCC
  • Emergency: means a circumstance that makes it reasonably certain that immediate action is required to prevent significant injury to a respondent's health, safety, welfare, or property and for which the appointment of a guardian or issuance of a protective order is necessary because no other person has authority and is willing to act on the respondent's behalf. See Ohio Code 2112.01
  • Emergency call: means a call to duty, including, but not limited to, communications from citizens, police dispatches, and personal observations by peace officers of inherently dangerous situations that demand an immediate response on the part of a peace officer. See Ohio Code 2744.01
  • Employee: includes any elected or appointed official of a political subdivision. See Ohio Code 2744.01
  • Employer: means a person who is required to withhold taxes out of payments of personal earnings made to a judgment debtor. See Ohio Code 2716.01
  • Enter: means the act by which a person becomes eligible to receive any prize offered in a sweepstakes. See Ohio Code 2915.01
  • Entitlement: A Federal program or provision of law that requires payments to any person or unit of government that meets the eligibility criteria established by law. Entitlements constitute a binding obligation on the part of the Federal Government, and eligible recipients have legal recourse if the obligation is not fulfilled. Social Security and veterans' compensation and pensions are examples of entitlement programs.
  • Entity: means any of the following:

    (1) A for profit corporation organized under the laws of this state or any other state;

    (2) Any of the following organizations existing under the laws of this state, the United States, or any other state:

    (a) A business trust or association;

    (b) A real estate investment trust;

    (c) A common law trust;

    (d) An unincorporated business or for profit organization, including a general or limited partnership;

    (e) A limited liability company. See Ohio Code 1782.01

  • Entry: means one event from the initial activation of the sweepstakes terminal device until all the sweepstakes prize results from that activation are revealed. See Ohio Code 2915.01
  • Equitable: Pertaining to civil suits in "equity" rather than in "law." In English legal history, the courts of "law" could order the payment of damages and could afford no other remedy. See damages. A separate court of "equity" could order someone to do something or to cease to do something. See, e.g., injunction. In American jurisprudence, the federal courts have both legal and equitable power, but the distinction is still an important one. For example, a trial by jury is normally available in "law" cases but not in "equity" cases. Source: U.S. Courts
  • Escheat: Reversion of real or personal property to the state when 1) a person dies without leaving a will and has no heirs, or 2) when the property (such as a bank account) has been inactive for a certain period of time. Source: OCC
  • Escrow: Money given to a third party to be held for payment until certain conditions are met.
  • Event of withdrawal of a general partner: means an event that causes a person to cease to be a general partner as provided in section 1782. See Ohio Code 1782.01
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • Ex officio: Literally, by virtue of one's office.
  • Executor: A male person named in a will to carry out the decedent
  • Expenses: means the reasonable amount of gross profit actually expended for all of the following:

    (1) The purchase or lease of bingo supplies;

    (2) The annual license fee required under section 2915. See Ohio Code 2915.01

  • Extradition: The formal process of delivering an accused or convicted person from authorities in one state to authorities in another state.
  • Extraordinary medical expenses: means any uninsured medical expenses incurred for a child during a calendar year that exceed the total cash medical support amount owed by the parents during that year. See Ohio Code 3119.01
  • Fair market value: The price at which an asset would change hands in a transaction between a willing, informed buyer and a willing, informed seller.
  • Federal Deposit Insurance Corporation: A government corporation that insures the deposits of all national and state banks that are members of the Federal Reserve System. Source: OCC
  • Federal Reserve System: The central bank of the United States. The Fed, as it is commonly called, regulates the U.S. monetary and financial system.   • Fee simple: Absolute title to property with no limitations or restrictions regarding the person who may inherit it.
  • Felony drug abuse offense: means any drug abuse offense that would constitute a felony under the laws of this state, any other state, or the United States. See Ohio Code 2925.01
  • Fentanyl-related compound: means any of the following:

    (1) Fentanyl;

    (2) Alpha-methylfentanyl (N-[1-(alpha-methyl-beta-phenyl)ethyl-4- piperidyl]propionanilide; 1-(1-methyl-2-phenylethyl)-4-(N-propanilido) piperidine);

    (3) Alpha-methylthiofentanyl (N-[1-methyl-2-(2-thienyl)ethyl-4- piperidinyl]-N-phenylpropanamide);

    (4) Beta-hydroxyfentanyl (N-[1-(2-hydroxy-2-phenethyl-4-piperidinyl] -N-phenylpropanamide);

    (5) Beta-hydroxy-3-methylfentanyl (other name: N-[1-(2-hydroxy-2- phenethyl)-3-methyl-4-piperidinyl]-N- phenylpropanamide);

    (6) 3-methylfentanyl (N-[3-methyl-1-(2-phenylethyl)-4-piperidyl]-N- phenylpropanamide);

    (7) 3-methylthiofentanyl (N-[3-methyl-1-[2-(thienyl)ethyl]-4- piperidinyl]-N-phenylpropanamide);

    (8) Para-fluorofentanyl (N-(4-fluorophenyl)-N-[1-(2-phenethyl)-4- piperidinyl]propanamide;

    (9) Thiofentanyl (N-phenyl-N-[1-(2-thienyl)ethyl-4-piperidinyl]- propanamide;

    (10) Alfentanil;

    (11) Carfentanil;

    (12) Remifentanil;

    (13) Sufentanil;

    (14) Acetyl-alpha-methylfentanyl (N-[1-(1-methyl-2-phenethyl)-4- piperidinyl]-N-phenylacetamide); and

    (15) Any compound that meets all of the following fentanyl pharmacophore requirements to bind at the mu receptor, as identified by a report from an established forensic laboratory, including acetylfentanyl, furanylfentanyl, valerylfentanyl, butyrylfentanyl, isobutyrylfentanyl, 4-methoxybutyrylfentanyl, para-fluorobutyrylfentanyl, acrylfentanyl, and ortho-fluorofentanyl:

    (a) A chemical scaffold consisting of both of the following:

    (i) A five, six, or seven member ring structure containing a nitrogen, whether or not further substituted;

    (ii) An attached nitrogen to the ring, whether or not that nitrogen is enclosed in a ring structure, including an attached aromatic ring or other lipophilic group to that nitrogen. See Ohio Code 2925.01

  • Fiduciary: A trustee, executor, or administrator.
  • Fiduciary: means an original, additional, or successor agent, guardian, personal representative, or trustee. See Ohio Code 2137.01
  • Final release: means a remission by the adult parole authority of the balance of the sentence or prison term of a parolee or prisoner or the termination by the authority of a term of post-release control of a releasee. See Ohio Code 2967.01
  • Financial institution: means a bank, credit union, savings and loan association, or a licensee or registrant under Chapter 1321 of the Revised Code. See Ohio Code 2981.01
  • First degree felony mandatory prison term: means one of the definite prison terms prescribed in division (A)(1)(b) of section 2929. See Ohio Code 2925.01
  • Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
  • Fixed Rate: Having a "fixed" rate means that the APR doesn't change based on fluctuations of some external rate (such as the "Prime Rate"). In other words, a fixed rate is a rate that is not a variable rate. A fixed APR can change over time, in several circumstances:
    • You are late making a payment or commit some other default, triggering an increase to a penalty rate
    • The bank changes the terms of your account and you do not reject the change.
    • The rate expires (if the rate was fixed for only a certain period of time).
  • Foreclosure: A legal process in which property that is collateral or security for a loan may be sold to help repay the loan when the loan is in default. Source: OCC
  • Foreign country: means a country, including a political subdivision of the country, other than the United States, that authorizes the issuance of support orders to which at least one of the following applies:

    (1) It has been declared under the law of the United States to be a foreign reciprocating country;

    (2) It has established a reciprocal arrangement for child support with this state as provided in section 3115. See Ohio Code 3115.102

  • Foreign limited partnership: means a limited partnership formed under the laws of any state other than this state. See Ohio Code 1782.01
  • Foreign nation: means any nation other than the United States and includes any province, territory, or other political subdivision of that nation. See Ohio Code 2712.01
  • Foreign support order: means a support order of a foreign tribunal. See Ohio Code 3115.102
  • Foreign tribunal: includes a competent authority under the convention. See Ohio Code 3115.102
  • Forge: means to fabricate or create, in whole or in part and by any means, any spurious writing, or to make, execute, alter, complete, reproduce, or otherwise purport to authenticate any writing, when the writing in fact is not authenticated by that conduct. See Ohio Code 2913.01
  • Forgery: The fraudulent signing or alteration of another's name to an instrument such as a deed, mortgage, or check. The intent of the forgery is to deceive or defraud. Source: OCC
  • Fraternal organization: means any society, order, state headquarters, or association within this state, except a college or high school fraternity, that is not organized for profit, that is a branch, lodge, or chapter of a national or state organization, that exists exclusively for the common business or sodality of its members. See Ohio Code 2915.01
  • Fraud: Intentional deception resulting in injury to another.
  • Gain access: means to approach, instruct, communicate with, store data in, retrieve data from, or otherwise make use of any resources of a computer, computer system, or computer network, or any cable service or cable system both as defined in section 2913. See Ohio Code 2913.01
  • Gambling device: means any of the following:

    (1) A book, totalizer, or other equipment for recording bets;

    (2) A ticket, token, or other device representing a chance, share, or interest in a scheme of chance or evidencing a bet;

    (3) A deck of cards, dice, gaming table, roulette wheel, slot machine, or other apparatus designed for use in connection with a game of chance;

    (4) Any equipment, device, apparatus, or paraphernalia specially designed for gambling purposes;

    (5) Bingo supplies sold or otherwise provided, or used, in violation of this chapter. See Ohio Code 2915.01

  • Gambling offense: means any of the following:

    (1) A violation of this chapter;

    (2) A violation of an existing or former municipal ordinance or law of this or any other state or the United States substantially equivalent to any provision of this chapter or a violation of section 2915. See Ohio Code 2915.01

  • Game flare: means the board or placard, or electronic representation of a board or placard, that accompanies each deal of instant bingo or electronic instant bingo tickets and that includes the following information for the game:

    (1) The name of the game;

    (2) The manufacturer's name or distinctive logo;

    (3) The form number;

    (4) The ticket count;

    (5) The prize structure, including the number of winning tickets by denomination and the respective winning symbol or number combinations for the winning tickets;

    (6) The cost per play;

    (7) The serial number of the game. See Ohio Code 2915.01

  • Game of chance: means poker, craps, roulette, or other game in which a player gives anything of value in the hope of gain, the outcome of which is determined largely by chance, but does not include bingo. See Ohio Code 2915.01
  • Game of chance conducted for profit: means any game of chance designed to produce income for the person who conducts or operates the game of chance, but does not include bingo. See Ohio Code 2915.01
  • Garnishment: Generally, garnishment is a court proceeding in which a creditor asks a court to order a third party who owes money to the debtor or otherwise holds assets belonging to the debtor to turn over to the creditor any of the debtor
  • General partner: means a person who has been admitted to a limited partnership as a general partner in accordance with the partnership agreement and named in the certificate of limited partnership as a general partner. See Ohio Code 1782.01
  • Germane: On the subject of the pending bill or other business; a strict standard of relevance.
  • Gift: A voluntary transfer or conveyance of property without consideration, or for less than full and adequate consideration based on fair market value.
  • governmental function: includes , but is not limited to, the following:

    (a) The provision or nonprovision of police, fire, emergency medical, ambulance, and rescue services or protection;

    (b) The power to preserve the peace; to prevent and suppress riots, disturbances, and disorderly assemblages; to prevent, mitigate, and clean up releases of oil and hazardous and extremely hazardous substances as defined in section 3750. See Ohio Code 2744.01

  • Grace period: The number of days you'll have to pay your bill for purchases in full without triggering a finance charge. Source: Federal Reserve
  • Grand jury: agreement providing that a lender will delay exercising its rights (in the case of a mortgage,
  • Grantor: The person who establishes a trust and places property into it.
  • Gross estate: The total fair market value of all property and property interests, real and personal, tangible and intangible, of which a decedent had beneficial ownership at the time of death before subtractions for deductions, debts, administrative expenses, and casualty losses suffered during estate administration.
  • Gross income: includes income of members of any branch of the United States armed services or national guard, including, amounts representing base pay, basic allowance for quarters, basic allowance for subsistence, supplemental subsistence allowance, cost of living adjustment, specialty pay, variable housing allowance, and pay for training or other types of required drills; self-generated income; and potential cash flow from any source. See Ohio Code 3119.01
  • Gross profit: means gross receipts minus the amount actually expended for the payment of prize awards. See Ohio Code 2915.01
  • Gross receipts: means all money or assets, including admission fees, that a person receives from bingo without the deduction of any amounts for prizes paid out or for the expenses of conducting bingo. See Ohio Code 2915.01
  • Guarantor: A party who agrees to be responsible for the payment of another party's debts should that party default. Source: OCC
  • Guardian: means a person, association, or corporation that is granted authority by a probate court pursuant to Chapter 2111 of the Revised Code to exercise parental rights over a child to the extent provided in the court's order and subject to the residual parental rights of the child's parents. See Ohio Code 2151.011
  • Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
  • guardian: includes , but is not limited to, a limited guardian, an interim guardian, a standby guardian, and an emergency guardian appointed pursuant to division (B) of section 2111. See Ohio Code 2137.01
  • Guardian of the estate: means a person appointed by the court to administer the estate of a ward. See Ohio Code 2112.01
  • Guardian of the person: means a person appointed by the court to make decisions regarding the support, care, education, health, and welfare of a ward. See Ohio Code 2112.01
  • Guardianship order: means an order appointing a guardian. See Ohio Code 2112.01
  • Guardianship proceeding: means a judicial proceeding in which an order for the appointment of a guardian is sought or has been issued. See Ohio Code 2112.01
  • Habeas corpus: A writ that is usually used to bring a prisoner before the court to determine the legality of his imprisonment. It may also be used to bring a person in custody before the court to give testimony, or to be prosecuted.
  • Habitual truant: means any child of compulsory school age who is absent without legitimate excuse for absence from the public school the child is supposed to attend for thirty or more consecutive hours, forty-two or more hours in one school month, or seventy-two or more hours in a school year. See Ohio Code 2151.011
  • Halfway house: means a facility licensed by the division of parole and community services of the department of rehabilitation and correction pursuant to section 2967. See Ohio Code 2929.01
  • Hashish: means a resin or a preparation of a resin to which both of the following apply:

    (1) It is contained in or derived from any part of the plant of the genus cannabis, whether in solid form or in a liquid concentrate, liquid extract, or liquid distillate form. See Ohio Code 2925.01

  • hazardous waste generated by households: means solid waste originally generated by individual households that is listed specifically as hazardous waste in or exhibits one or more characteristics of hazardous waste as defined by rules adopted under section 3734. See Ohio Code 2744.01
  • head of the institution: means the resident head of the institution and the person immediately in charge of the institution, whether designated warden, superintendent, or any other name by which the head is known. See Ohio Code 2967.01
  • Hearsay: Statements by a witness who did not see or hear the incident in question but heard about it from someone else. Hearsay is usually not admissible as evidence in court.
  • Home state: means the state or foreign country in which a child lived with a parent or a person acting as parent for at least six consecutive months immediately preceding the time of filing of a petition or comparable pleading for support and, if a child is less than six months old, the state or foreign country in which the child lived from birth with any of them. See Ohio Code 3115.102
  • Home state: means the state in which the respondent was physically present, including any period of temporary absence, for at least six consecutive months immediately before the filing of an application for appointment of a guardian or the issuance of a protective order or, if none, the state in which the respondent was physically present, including any period of temporary absence, for at least six consecutive months ending within the six months prior to the filing of the application. See Ohio Code 2112.01
  • House arrest: means a period of confinement of an offender that is in the offender's home or in other premises specified by the sentencing court or by the parole board pursuant to section 2967. See Ohio Code 2929.01
  • Human trafficking: means a scheme or plan to which all of the following apply:

    (1) Its object is one or both of the following:

    (a) To subject a victim or victims to involuntary servitude, as defined in section 2905. See Ohio Code 2929.01

  • Impeachment: (1) The process of calling something into question, as in "impeaching the testimony of a witness." (2) The constitutional process whereby the House of Representatives may "impeach" (accuse of misconduct) high officers of the federal government for trial in the Senate.
  • imprisonment: means being imprisoned under a sentence imposed for an offense or serving a term of imprisonment, prison term, jail term, term of local incarceration, or other term under a sentence imposed for an offense in an institution under the control of the department of rehabilitation and correction, a county, multicounty, municipal, municipal-county, or multicounty-municipal jail or workhouse, a minimum security jail, a community-based correctional facility, or another facility described or referred to in section 2929. See Ohio Code 1.05
  • in writing: includes any representation of words, letters, symbols, or figures; this provision does not affect any law relating to signatures. See Ohio Code 1.59
  • Income: includes earnings or other periodic entitlements to money from any source and any other property subject to withholding for support under the law of this state. See Ohio Code 3115.102
  • Income: means either of the following:

    (a) For a parent who is employed to full capacity, the gross income of the parent;

    (b) For a parent who is unemployed or underemployed, the sum of the gross income of the parent and any potential income of the parent. See Ohio Code 3119.01

  • Income share: means the percentage derived from a comparison of each parent's annual income after allowable deductions and credits as indicated on the worksheet to the total annual income of both parents. See Ohio Code 3119.01
  • Income-withholding order: means an order or other legal process directed to an obligor's employer or other payor, in accordance with Chapter 3121 of the Revised Code, to withhold support from the income of the obligor. See Ohio Code 3115.102
  • Indemnification: In general, a collateral contract or assurance under which one person agrees to secure another person against either anticipated financial losses or potential adverse legal consequences. Source: FDIC
  • Indictment: The formal charge issued by a grand jury stating that there is enough evidence that the defendant committed the crime to justify having a trial; it is used primarily for felonies.
  • Information: means data, text, images, videos, sounds, codes, computer programs, software, databases, or the like. See Ohio Code 2137.01
  • Information service: means , subject to division (BB)(2) of this section, the offering of a capability for generating, acquiring, storing, transforming, processing, retrieving, utilizing, or making available information via telecommunications, including, but not limited to, electronic publishing. See Ohio Code 2913.01
  • Initiating tribunal: means the tribunal of a state or foreign country from which a petition or comparable pleading is forwarded or in which a petition or comparable pleading is filed for forwarding to another state or foreign country. See Ohio Code 3115.102
  • Injunction: An order of the court prohibiting (or compelling) the performance of a specific act to prevent irreparable damage or injury.
  • Innocent person: includes any bona fide purchaser of property that is subject to forfeiture, including any person who establishes a valid claim to or interest in the property in accordance with section 2981. See Ohio Code 2981.01
  • Instant bingo: means a form of bingo that shall use folded or banded tickets or paper cards with perforated break-open tabs, a face of which is covered or otherwise hidden from view to conceal a number, letter, or symbol, or set of numbers, letters, or symbols, some of which have been designated in advance as prize winners, and may also include games in which some winners are determined by the random selection of one or more bingo numbers by the use of a seal card or bingo blower. See Ohio Code 2915.01
  • Instant bingo ticket dispenser: means a mechanical device that dispenses an instant bingo ticket or card as the sole item of value dispensed and that has the following characteristics:

    (1) It is activated upon the insertion of United States currency. See Ohio Code 2915.01

  • Institution of higher education: means a state institution of higher education as defined in section 3345. See Ohio Code 2741.01
  • Instrumentality: means property otherwise lawful to possess that is used in or intended to be used in an offense. See Ohio Code 2981.01
  • Insurer: means any person authorized under Title XXXIX of the Revised Code to engage in the business of insurance in this state, any health insuring corporation, and any legal entity that is self-insured and provides benefits to its employees or members. See Ohio Code 3119.01
  • Intangible property: Property that has no intrinsic value, but is merely the evidence of value such as stock certificates, bonds, and promissory notes.
  • Intensive probation supervision: includes intensive parole supervision and intensive post-release control supervision. See Ohio Code 2929.01
  • Inter vivos: Transfer of property from one living person to another living person.
  • Interest rate: The amount paid by a borrower to a lender in exchange for the use of the lender's money for a certain period of time. Interest is paid on loans or on debt instruments, such as notes or bonds, either at regular intervals or as part of a lump sum payment when the issue matures. Source: OCC
  • Internal Revenue Code: means the "Internal Revenue Code of 1986" 100 Stat. See Ohio Code 2915.01
  • Internet: means the international computer network of both federal and nonfederal interoperable packet switched data networks, including the graphical subnetwork known as the world wide web. See Ohio Code 1.59
  • Interrogatories: Written questions asked by one party of an opposing party, who must answer them in writing under oath; a discovery device in a lawsuit.
  • Intestate: Dying without leaving a will.
  • Irrevocable trust: A trust arrangement that cannot be revoked, rescinded, or repealed by the grantor.
  • Issuing state: means the state in which a tribunal issues a support order or a judgment determining parentage of a child. See Ohio Code 3115.102
  • Issuing tribunal: means the tribunal of a state or foreign country that issues a support order or a judgment determining parentage of a child. See Ohio Code 3115.102
  • Jail: means a jail, workhouse, minimum security jail, or other residential facility used for the confinement of alleged or convicted offenders that is operated by a political subdivision or a combination of political subdivisions of this state. See Ohio Code 2929.01
  • Jail term: means the term in a jail that a sentencing court imposes or is authorized to impose pursuant to section 2929. See Ohio Code 2929.01
  • Joint meeting: An occasion, often ceremonial, when the House and Senate each adopt a unanimous consent agreement
  • Joint resolution: A legislative measure which requires the approval of both chambers.
  • Joint session: When both chambers of a legislature adopt a concurrent resolution to meet together.
  • Joint tenancy: A form of property ownership in which two or more parties hold an undivided interest in the same property that was conveyed under the same instrument at the same time. A joint tenant can sell his (her) interest but not dispose of it by will. Upon the death of a joint tenant, his (her) undivided interest is distributed among the surviving joint tenants.
  • Judgement: The official decision of a court finally determining the respective rights and claims of the parties to a suit.
  • Judgment creditor: means a person who has obtained a judgment in a civil action against another person. See Ohio Code 2716.01
  • Judgment debtor: means a person against whom a judgment has been obtained in a civil action. See Ohio Code 2716.01
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • Juror: A person who is on the jury.
  • Jury instructions: A judge's directions to the jury before it begins deliberations regarding the factual questions it must answer and the legal rules that it must apply. Source: U.S. Courts
  • Juvenile: means a person under eighteen years of age. See Ohio Code 2925.01
  • Juvenile court: means whichever of the following is applicable that has jurisdiction under this chapter and Chapter 2152 of the Revised Code:

    (a) The division of the court of common pleas specified in section 2101. See Ohio Code 2151.011

  • Juvenile court judge: includes a magistrate to whom the juvenile court judge confers duties pursuant to division (A)(15) of section 2151. See Ohio Code 2950.01
  • Juvenile judge: means a judge of a court having jurisdiction under this chapter. See Ohio Code 2151.011
  • Juvenile offender registrant: includes a person who prior to January 1, 2008, was a "juvenile offender registrant" under the definition of the term in existence prior to January 1, 2008, and a person who prior to July 31, 2003, was a "juvenile sex offender registrant" under the former definition of that former term. See Ohio Code 2950.01
  • Juvenile traffic offender: means any child who violates any traffic law, traffic ordinance, or traffic regulation of this state, the United States, or any political subdivision of this state, other than a resolution, ordinance, or regulation of a political subdivision of this state the violation of which is required to be handled by a parking violations bureau or a joint parking violations bureau pursuant to Chapter 4521 of the Revised Code. See Ohio Code 2152.02
  • Landlord: means the owner, lessor, or sublessor of premises, or the agent or person the landlord authorizes to manage premises or to receive rent from a tenant under a rental agreement, except, if required by the facts of the action to which the term is applied, "landlord" means a park operator. See Ohio Code 1923.01
  • Law: means any provision of the constitution, statutes, or rules of the United States or of this state; provisions of charters, ordinances, resolutions, and rules of political subdivisions; and written policies adopted by boards of education. See Ohio Code 2744.01
  • Law: includes decisional and statutory law and rules and regulations having the force of law. See Ohio Code 3115.102
  • Law enforcement agency: includes , but is not limited to, the state board of pharmacy, the enforcement division of the department of taxation, the Ohio casino control commission, and the office of the prosecutor. See Ohio Code 2981.01
  • Lawsuit: A legal action started by a plaintiff against a defendant based on a complaint that the defendant failed to perform a legal duty, resulting in harm to the plaintiff.
  • Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC
  • Legacy: A gift of property made by will.
  • Legal custody: means a legal status that vests in the custodian the right to have physical care and control of the child and to determine where and with whom the child shall live, and the right and duty to protect, train, and discipline the child and to provide the child with food, shelter, education, and medical care, all subject to any residual parental rights, privileges, and responsibilities. See Ohio Code 2151.011
  • Legal tender: coins, dollar bills, or other currency issued by a government as official money. Source: U.S. Mint
  • Legatee: A beneficiary of a decedent
  • Legislative authority: means the legislative authority of the municipal corporation in which a municipal court, other than a county-operated municipal court, is located, and means the respective board of county commissioners of the county in which a county-operated municipal court is located. See Ohio Code 1901.03
  • legitimate excuse for absence from the public school the child is supposed to attend: includes , but is not limited to, any of the following:

    (a) The fact that the child in question has enrolled in and is attending another public or nonpublic school in this or another state;

    (b) The fact that the child in question is excused from attendance at school for any of the reasons specified in section 3321. See Ohio Code 2151.011

  • Levying officer: means the sheriff, another authorized law enforcement officer, or a bailiff who is ordered by the court to take possession of property under an order of attachment. See Ohio Code 2715.011
  • Levying officer: means the sheriff, another authorized law enforcement officer, or a bailiff who is ordered by the court to take possession of property and deliver it to the movant. See Ohio Code 2737.01
  • Liabilities: The aggregate of all debts and other legal obligations of a particular person or legal entity.
  • License violation report: means a report that is made by a sentencing court, or by the parole board pursuant to section 2967. See Ohio Code 2929.01
  • Lien: A claim against real or personal property in satisfaction of a debt.
  • Limited partner: means a person who has been admitted to a limited partnership as a limited partner in accordance with the partnership agreement. See Ohio Code 1782.01
  • Lineal descendant: Direct descendant of the same ancestors.
  • Liquidating trustee: means a person, other than a general partner but including a limited partner, who is carrying out the winding up of a limited partnership. See Ohio Code 1782.01
  • Litigation: A case, controversy, or lawsuit. Participants (plaintiffs and defendants) in lawsuits are called litigants.
  • Major drug offender: means an offender who is convicted of or pleads guilty to the possession of, sale of, or offer to sell any drug, compound, mixture, preparation, or substance that consists of or contains at least one thousand grams of hashish; at least one hundred grams of cocaine; at least one thousand unit doses or one hundred grams of heroin; at least five thousand unit doses of L. See Ohio Code 2929.01
  • Mandatory jail term: means the term in a jail that a sentencing court is required to impose pursuant to division (G) of section 1547. See Ohio Code 2929.01
  • Mandatory prison term: means any of the following:

    (1) Subject to division (X)(2) of this section, the term in prison that must be imposed for the offenses or circumstances set forth in divisions (F)(1) to (8) or (F)(12) to (21) of section 2929. See Ohio Code 2929.01

  • Mandatory serious youthful offender: means a person who is eligible for a mandatory SYO and who is not transferred to adult court under a mandatory or discretionary transfer and also includes, for purposes of imposition of a mandatory serious youthful dispositional sentence under section 2152. See Ohio Code 2152.02
  • Mandatory SYO: means a case in which the juvenile court is required to impose a mandatory serious youthful offender disposition under section 2152. See Ohio Code 2152.02
  • Mandatory term of local incarceration: means the term of sixty or one hundred twenty days in a jail, a community-based correctional facility, a halfway house, or an alternative residential facility that a sentencing court may impose upon a person who is convicted of or pleads guilty to a fourth degree felony OVI offense pursuant to division (G)(1) of section 2929. See Ohio Code 2929.01
  • Mandatory transfer: means that a case is required to be transferred for criminal prosecution under division (A) of section 2152. See Ohio Code 2152.02
  • Manufacture: means to plant, cultivate, harvest, process, make, prepare, or otherwise engage in any part of the production of a drug, by propagation, extraction, chemical synthesis, or compounding, or any combination of the same, and includes packaging, repackaging, labeling, and other activities incident to production. See Ohio Code 2925.01
  • Manufacturer: means any person who assembles completed bingo supplies from raw materials, other items, or subparts or who modifies, converts, adds to, or removes parts from bingo supplies to further their promotion or sale. See Ohio Code 2915.01
  • Marital deduction: The deduction(s) that can be taken in the determination of gift and estate tax liabilities because of the existence of a marriage or marital relationship.
  • Maximum first degree felony mandatory prison term: means the maximum definite prison term prescribed in division (A)(1)(b) of section 2929. See Ohio Code 2925.01
  • Maximum second degree felony mandatory prison term: means the maximum definite prison term prescribed in division (A)(2)(b) of section 2929. See Ohio Code 2925.01
  • Mental injury: means any behavioral, cognitive, emotional, or mental disorder in a child caused by an act or omission that is described in section 2919. See Ohio Code 2151.011
  • Merchandise prize: means any item of value, but shall not include any of the following:

    (1) Cash, gift cards, or any equivalent thereof;

    (2) Plays on games of chance, state lottery tickets, or bingo;

    (3) Firearms, tobacco, or alcoholic beverages; or

    (4) A redeemable voucher that is redeemable for any of the items listed in division (VV)(1), (2), or (3) of this section. See Ohio Code 2915.01

  • Methamphetamine: means methamphetamine, any salt, isomer, or salt of an isomer of methamphetamine, or any compound, mixture, preparation, or substance containing methamphetamine or any salt, isomer, or salt of an isomer of methamphetamine. See Ohio Code 2925.01
  • Minor drug possession offense: means either of the following:

    (1) A violation of section 2925. See Ohio Code 2925.01

  • Minority leader: See Floor Leaders
  • Mistrial: An invalid trial, caused by fundamental error. When a mistrial is declared, the trial must start again from the selection of the jury.
  • Mobile instrumentality: includes , but is not limited to, any vehicle, any watercraft, and any aircraft. See Ohio Code 2981.01
  • Monitored time: means a period of time during which an offender continues to be under the control of the sentencing court or parole board, subject to no conditions other than leading a law-abiding life. See Ohio Code 2929.01
  • Mortgage: The written agreement pledging property to a creditor as collateral for a loan.
  • Mortgage loan: A loan made by a lender to a borrower for the financing of real property. Source: OCC
  • Mortgagee: The person to whom property is mortgaged and who has loaned the money.
  • Mortgagor: The person who pledges property to a creditor as collateral for a loan and who receives the money.
  • Movant: means a party to an action who has filed a motion for an order of possession of specific personal property pursuant to section 2737. See Ohio Code 2737.01
  • Multi-unit building: means a building in which is located more than twelve residential units that have entry doors that open directly into the unit from a hallway that is shared with one or more other units. See Ohio Code 2950.01
  • Multicounty department of probation: means a probation department established under section 2301. See Ohio Code 2951.01
  • municipal corporation in which a municipal court is located: includes each municipal corporation named in section 1901. See Ohio Code 1901.03
  • municipal court: includes the housing or environmental division of the municipal court, and "judge" includes the judge of the housing or environmental division of the municipal court, as created by section 1901. See Ohio Code 1901.031
  • Name: means the actual, assumed, or clearly identifiable name of or reference to a living or deceased individual that identifies the individual. See Ohio Code 2741.01
  • National Bank: A bank that is subject to the supervision of the Comptroller of the Currency. The Office of the Comptroller of the Currency is a bureau of the U.S. Treasury Department. A national bank can be recognized because it must have "national" or "national association" in its name. Source: OCC
  • National Credit Union Administration: The federal regulatory agency that charters and supervises federal credit unions. (NCUA also administers the National Credit Union Share Insurance Fund, which insures the deposits of federal credit unions.) Source: OCC
  • neglected child: includes any child:

    (1) Who is abandoned by the child's parents, guardian, or custodian;

    (2) Who lacks adequate parental care because of the faults or habits of the child's parents, guardian, or custodian;

    (3) Whose parents, guardian, or custodian neglects the child or refuses to provide proper or necessary subsistence, education, medical or surgical care or treatment, or other care necessary for the child's health, morals, or well being;

    (4) Whose parents, guardian, or custodian neglects the child or refuses to provide the special care made necessary by the child's mental condition;

    (5) Whose parents, legal guardian, or custodian have placed or attempted to place the child in violation of sections 5103. See Ohio Code 2151.03

  • Net profit: means gross profit minus expenses. See Ohio Code 2915.01
  • Net profit from the proceeds of the sale of instant bingo or electronic instant bingo: means gross profit minus the ordinary, necessary, and reasonable expense expended for the purchase of bingo supplies for the purpose of conducting instant bingo or electronic instant bingo, and, in the case of instant bingo or electronic instant bingo conducted by a veteran's, fraternal, or sporting organization, minus the payment by that organization of real property taxes and assessments levied on a premises on which instant bingo or electronic instant bingo is conducted. See Ohio Code 2915.01
  • Non-economic loss: means nonpecuniary harm suffered by a victim of an offense as a result of or related to the commission of the offense, including, but not limited to, pain and suffering; loss of society, consortium, companionship, care, assistance, attention, protection, advice, guidance, counsel, instruction, training, or education; mental anguish; and any other intangible loss. See Ohio Code 2929.01
  • Non-economic loss: means nonpecuniary harm suffered by a victim of a delinquent act or juvenile traffic offense as a result of or related to the delinquent act or juvenile traffic offense, including, but not limited to, pain and suffering; loss of society, consortium, companionship, care, assistance, attention, protection, advice, guidance, counsel, instruction, training, or education; mental anguish; and any other intangible loss. See Ohio Code 2152.02
  • Non-life felony indefinite prison term: means a prison term imposed under division (A)(1)(a) or (2)(a) of section 2929. See Ohio Code 2929.01
  • Oath: includes affirmation, and "swear" includes affirm. See Ohio Code 1.59
  • Oath: A promise to tell the truth.
  • Obligation: An order placed, contract awarded, service received, or similar transaction during a given period that will require payments during the same or a future period.
  • Obligee: means any of the following:

    (1) An individual to whom a duty of support is or is alleged to be owed or in whose favor a support order or a judgment determining parentage of a child has been issued;

    (2) A foreign country, state, or political subdivision of a state to which the rights under a duty of support or support order have been assigned or that has independent claims based on financial assistance provided to an individual obligee in place of child support;

    (3) An individual seeking a judgment determining parentage of the individual's child;

    (4) A person that is a creditor in a proceeding under sections 3115. See Ohio Code 3115.102

  • Obligee: means the person who is entitled to receive the support payments under a support order. See Ohio Code 3119.01
  • Obligor: means an individual, or the estate of a decedent, to whom or to which any of the following applies:

    (1) The individual or estate owes or is alleged to owe a duty of support. See Ohio Code 3115.102

  • Obligor: means the person who is required to pay support under a support order. See Ohio Code 3119.01
  • Occupied dwelling unit: means a structure that is used in whole or in part as a home, residence, or sleeping place by one person who maintains a household or by two or more persons who maintain a common household, and the facilities and appurtenances in it and in which any person is present or is likely to be present, except that such a structure is not an occupied dwelling unit at any time if, after reasonable efforts to personally contact any person who may be present in the structure at that time, the person who made the efforts reasonably believes that no person is present in the structure at that time. See Ohio Code 2715.011
  • Occupied dwelling unit: means a structure that is used in whole or in part as a home, residence, or sleeping place by one person who maintains a household or by two or more persons who maintain a common household, and the facilities or appurtenances in it and in which any person is present or is likely to be present, except that such a structure is not an occupied dwelling unit at any time if, after reasonable efforts to personally contact any person who may be present in the structure at that time, the person who made the efforts reasonably believes that no person is present in the structure at that time. See Ohio Code 2737.01
  • Of unsound mind: means that the person lacks the relevant mental capacity. See Ohio Code 1.02
  • Offender: means a person who, in this state, is convicted of or pleads guilty to a felony or a misdemeanor. See Ohio Code 2929.01
  • offense: includes the commission of a delinquent act. See Ohio Code 2981.01
  • Official identity document: means a birth record, marriage record, divorce decree, driver's license, state issued identification card, social security card with the social security number redacted, passport, or any other official government-issued document required or commonly used to verify a person's identity. See Ohio Code 2717.01
  • Online tool: means an electronic service provided by a custodian that allows the user, in an agreement distinct from the terms-of-service agreement between the custodian and user, to provide directions for disclosure or nondisclosure of digital assets to a third person. See Ohio Code 2137.01
  • Oral argument: An opportunity for lawyers to summarize their position before the court and also to answer the judges' questions.
  • Order of possession: means the order issued by a court under this chapter for delivery to the movant of possession of specific personal property pending final judgment in the action. See Ohio Code 2737.01
  • Ordinary medical expenses: includes copayments and deductibles, and uninsured medical-related costs for the children of the order. See Ohio Code 3119.01
  • Organization: means any institution, public, semipublic, or private, and any private association, society, or agency located or operating in the state, incorporated or unincorporated, having among its functions the furnishing of protective services or care for children, or the placement of children in certified foster homes or elsewhere. See Ohio Code 2151.011
  • Out-of-home care: means detention facilities, shelter facilities, certified children's crisis care facilities, certified foster homes, placement in a prospective adoptive home prior to the issuance of a final decree of adoption, organizations, certified organizations, child day-care centers, type A family day-care homes, type B family day-care homes, child care provided by in-home aides, group home providers, group homes, institutions, state institutions, residential facilities, residential care facilities, residential camps, day camps, private, nonprofit therapeutic wilderness camps, public schools, chartered nonpublic schools, educational service centers, hospitals, and medical clinics that are responsible for the care, physical custody, or control of children. See Ohio Code 2151.011
  • Out-of-state juvenile offender registrant: includes a person who prior to January 1, 2008, was an "out-of-state juvenile offender registrant" under the definition of the term in existence prior to January 1, 2008, and a person who prior to July 31, 2003, was an "out-of-state juvenile sex offender registrant" under the former definition of that former term. See Ohio Code 2950.01
  • Outside this state: means a location in another state or a country other than the United States, whether or not the country is a foreign country. See Ohio Code 3115.102
  • Oversight: Committee review of the activities of a Federal agency or program.
  • Owner: means , unless the context requires a different meaning, any person, other than the actor, who is the owner of, who has possession or control of, or who has any license or interest in property or services, even though the ownership, possession, control, license, or interest is unlawful. See Ohio Code 2913.01
  • Pardon: means the remission of penalty by the governor in accordance with the power vested in the governor by the constitution. See Ohio Code 2967.01
  • Parole: means , regarding a prisoner who is serving a prison term for aggravated murder or murder, who is serving a prison term of life imprisonment for rape or for felonious sexual penetration as it existed under section 2907. See Ohio Code 2967.01
  • Parolee: means any inmate who has been released from confinement on parole by order of the adult parole authority or conditionally pardoned, who is under supervision of the adult parole authority and has not been granted a final release, and who has not been declared in violation of the inmate's parole by the authority or is performing the prescribed conditions of a conditional pardon. See Ohio Code 2967.01
  • Participant: means any person who plays bingo. See Ohio Code 2915.01
  • Partner: means a limited or general partner. See Ohio Code 1782.01
  • Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
  • Partnership agreement: means any valid written or oral agreement of the partners as to the affairs of a limited partnership and the conduct of its business. See Ohio Code 1782.01
  • Partnership interest: means a partner's share of the profits and losses of a limited partnership and the right to receive distributions of partnership assets. See Ohio Code 1782.01
  • Party: means a party to an arbitration or conciliation agreement. See Ohio Code 2712.01
  • Party: means the respondent, applicant, guardian, or other person allowed by the court to participate in a guardianship or protective proceeding. See Ohio Code 2112.01
  • Peace officer: includes , except as provided in section 2935. See Ohio Code 2935.01
  • Per stirpes: The legal means by which the children of a decedent, upon the death of an ancestor at a level above that of the decedent, receive by right of representation the share of the ancestor
  • Permanent custody: means a legal status that vests in a public children services agency or a private child placing agency, all parental rights, duties, and obligations, including the right to consent to adoption, and divests the natural parents or adoptive parents of all parental rights, privileges, and obligations, including all residual rights and obligations. See Ohio Code 2151.011
  • Permanent disabling harm: means serious physical harm that results in permanent injury to the intellectual, physical, or sensory functions and that permanently and substantially impairs a person's ability to meet one or more of the ordinary demands of life, including the functions of caring for one's self, performing manual tasks, walking, seeing, hearing, speaking, breathing, learning, and working. See Ohio Code 2929.01
  • Person: means an individual, association, corporation, or partnership and the state or any of its political subdivisions, departments, or agencies. See Ohio Code 2151.011
  • person: means any person, partnership, joint-stock company, unincorporated association, society, municipal corporation, or other corporation. See Ohio Code 2721.01
  • Person: includes an individual, corporation, business trust, estate, trust, partnership, and association. See Ohio Code 1.59
  • Person: means an individual, corporation, business trust, estate, trust, partnership, limited liability company, association, joint venture, public corporation, government or governmental subdivision, agency, or instrumentality, or any other legal or commercial entity. See Ohio Code 3115.102
  • Person: means any natural person; partnership, limited partnership, trust, estate, association, limited liability company, or corporation; any custodian, nominee, trustee, executor, administrator, or other fiduciary; or any other individual or entity in its own or any representative capacity. See Ohio Code 1782.01
  • Person: means an individual, corporation, business trust, estate, trust, partnership, limited liability company, association, joint venture, government, governmental agency or instrumentality, public corporation, or any other legal or commercial entity. See Ohio Code 2137.01
  • Persona: means an individual's name, voice, signature, photograph, image, likeness, or distinctive appearance, if any of these aspects have commercial value. See Ohio Code 2741.01
  • Personal earnings: means money, or any other consideration or thing of value, that is paid or due to a person in exchange for work, labor, or personal services provided by the person to an employer. See Ohio Code 2716.01
  • Personal earnings: means compensation paid or payable for personal services, however denominated, and includes wages, salary, commissions, bonuses, draws against commissions, profit sharing, vacation pay, or any other compensation. See Ohio Code 3119.01
  • Personal property: All property that is not real property.
  • Personal property: means tangible personal property other than a manufactured home, mobile home, or recreational vehicle that is the subject of an action under this chapter. See Ohio Code 1923.01
  • Personal representative: means an executor, administrator, special administrator, or other person acting under the authority of the probate court to perform substantially the same function under the law of this state. See Ohio Code 2137.01
  • Petit jury: A group of citizens who hear the evidence presented by both sides at trial and determine the facts in dispute. Federal criminal juries consist of 12 persons. Federal civil juries consist of six persons.
  • Physical impairment: means having one or more of the following conditions that substantially limit one or more of an individual's major life activities, including self-care, receptive and expressive language, learning, mobility, and self-direction:

    (a) A substantial impairment of vision, speech, or hearing;

    (b) A congenital orthopedic impairment;

    (c) An orthopedic impairment caused by disease, rheumatic fever or any other similar chronic or acute health problem, or amputation or another similar cause. See Ohio Code 2151.011

  • Physician assistant: means an individual who is licensed under Chapter 4730 of the Revised Code to provide services as a physician assistant to patients under the supervision, control, and direction of one or more physicians. See Ohio Code 1.64
  • Placement for adoption: means the arrangement by a public children services agency or a private child placing agency with a person for the care and adoption by that person of a child of whom the agency has permanent custody. See Ohio Code 2151.011
  • Placement in foster care: means the arrangement by a public children services agency or a private child placing agency for the out-of-home care of a child of whom the agency has temporary custody or permanent custody. See Ohio Code 2151.011
  • Plaintiff: The person who files the complaint in a civil lawsuit.
  • Planned permanent living arrangement: means an order of a juvenile court pursuant to which both of the following apply:

    (a) The court gives legal custody of a child to a public children services agency or a private child placing agency without the termination of parental rights. See Ohio Code 2151.011

  • Plea: In a criminal case, the defendant's statement pleading "guilty" or "not guilty" in answer to the charges, a declaration made in open court.
  • Plea agreement: An arrangement between the prosecutor, the defense attorney, and the defendant in which the defendant agrees to plead guilty in exchange for special considerations. Source:
  • Pleadings: Written statements of the parties in a civil case of their positions. In the federal courts, the principal pleadings are the complaint and the answer.
  • Political subdivision: includes , but is not limited to, a county hospital commission appointed under section 339. See Ohio Code 2744.01
  • Political subdivisions: means municipal corporations, townships, counties, school districts, and all other bodies corporate and politic responsible for governmental activities only in geographic areas smaller than that of the state to which the sovereign immunity of the state attaches. See Ohio Code 2743.01
  • Pool not conducted for profit: means a scheme in which a participant gives a valuable consideration for a chance to win a prize and the total amount of consideration wagered is distributed to a participant or participants. See Ohio Code 2915.01
  • Population: means that shown by the most recent regular federal census. See Ohio Code 1.59
  • possession: means having control over a thing or substance, but may not be inferred solely from mere access to the thing or substance through ownership or occupation of the premises upon which the thing or substance is found. See Ohio Code 2925.01
  • Post-release control: means a period of supervision by the adult parole authority after a prisoner's release from imprisonment, other than under a term of life imprisonment, that includes one or more post-release control sanctions imposed under section 2967. See Ohio Code 2967.01
  • Post-release control sanction: means a sanction that is authorized under sections 2929. See Ohio Code 2967.01
  • Potential income: means both of the following for a parent who the court pursuant to a court support order, or a child support enforcement agency pursuant to an administrative child support order, determines is voluntarily unemployed or voluntarily underemployed:

    (a) Imputed income that the court or agency determines the parent would have earned if fully employed as determined from the following criteria:

    (i) The parent's prior employment experience;

    (ii) The parent's education;

    (iii) The parent's physical and mental disabilities, if any;

    (iv) The availability of employment in the geographic area in which the parent resides;

    (v) The prevailing wage and salary levels in the geographic area in which the parent resides;

    (vi) The parent's special skills and training;

    (vii) Whether there is evidence that the parent has the ability to earn the imputed income;

    (viii) The age and special needs of the child for whom child support is being calculated under this section;

    (ix) The parent's increased earning capacity because of experience;

    (x) The parent's decreased earning capacity because of a felony conviction;

    (xi) Any other relevant factor. See Ohio Code 3119.01

  • Power of attorney: A written instrument which authorizes one person to act as another's agent or attorney. The power of attorney may be for a definite, specific act, or it may be general in nature. The terms of the written power of attorney may specify when it will expire. If not, the power of attorney usually expires when the person granting it dies. Source: OCC
  • Power of attorney: means a writing or other record that grants authority to an agent to act in the place of the principal. See Ohio Code 2137.01
  • Precedent: A court decision in an earlier case with facts and law similar to a dispute currently before a court. Precedent will ordinarily govern the decision of a later similar case, unless a party can show that it was wrongly decided or that it differed in some significant way.
  • Preliminary hearing: A hearing where the judge decides whether there is enough evidence to make the defendant have a trial.
  • Presiding officer: A majority-party Senator who presides over the Senate and is charged with maintaining order and decorum, recognizing Members to speak, and interpreting the Senate's rules, practices and precedents.
  • presumption that a prison term shall be imposed: means a presumption, as described in division (D) of section 2929. See Ohio Code 2925.01
  • Principal: means an individual who grants authority to an agent in a power of attorney. See Ohio Code 2137.01
  • Prison: means a residential facility used for the confinement of convicted felony offenders that is under the control of the department of rehabilitation and correction and includes a violation sanction center operated under authority of section 2967. See Ohio Code 2929.01
  • Prison term: includes either of the following sanctions for an offender:

    (a) A stated prison term;

    (b) A term in a prison shortened by, or with the approval of, the sentencing court pursuant to section 2929. See Ohio Code 2929.01

  • Prisoner: means a person who is in actual confinement in a state correctional institution. See Ohio Code 2967.01
  • Private child placing agency: means any association, as defined in section 5103. See Ohio Code 2151.011
  • Private noncustodial agency: means any person, organization, association, or society certified by the department of job and family services that does not accept temporary or permanent legal custody of children, that is privately operated in this state, and that does one or more of the following:

    (a) Receives and cares for children for two or more consecutive weeks;

    (b) Participates in the placement of children in certified foster homes;

    (c) Provides adoption services in conjunction with a public children services agency or private child placing agency. See Ohio Code 2151.011

  • Prize: means any gift, award, gratuity, good, service, credit, reward, or any other thing of value that may be transferred to a person, whether possession of the prize is actually transferred, or placed on an account or other record as evidence of the intent to transfer the prize. See Ohio Code 2915.01
  • Pro se: A Latin term meaning "on one's own behalf"; in courts, it refers to persons who present their own cases without lawyers.
  • Probable cause: A reasonable ground for belief that the offender violated a specific law.
  • Probable cause to support the motion: means that it is likely that a plaintiff who files a motion for attachment pursuant to section 2715. See Ohio Code 2715.011
  • Probable cause to support the motion: means that it is likely that the movant will obtain judgment against the respondent that entitles the movant to permanent possession of the specific personal property that is the subject of a motion filed pursuant to section 2737. See Ohio Code 2737.01
  • Probate: Proving a will
  • Probation: A sentencing alternative to imprisonment in which the court releases convicted defendants under supervision as long as certain conditions are observed.
  • Probation agency: means a county department of probation, a multicounty department of probation, a municipal court department of probation established under section 1901. See Ohio Code 2951.01
  • Probation officers: Screen applicants for pretrial release and monitor convicted offenders released under court supervision.
  • Proceeds: means both of the following:

    (a) In cases involving unlawful goods, services, or activities, "proceeds" means any property derived directly or indirectly from an offense. See Ohio Code 2981.01

  • Professional association: means an association organized under this chapter for the sole purpose of rendering one of the professional services authorized under Chapter 4701. See Ohio Code 1785.01
  • Professional license: means any license, permit, certificate, registration, qualification, admission, temporary license, temporary permit, temporary certificate, or temporary registration that is described in divisions (W)(1) to (37) of this section and that qualifies a person as a professionally licensed person. See Ohio Code 2925.01
  • Professional service: means any type of professional service that may be performed only pursuant to a license, certificate, or other legal authorization issued pursuant to Chapter 4701. See Ohio Code 1785.01
  • Professionally licensed person: means any of the following:

    (1) A person who has received a certificate or temporary certificate as a certified public accountant or who has registered as a public accountant under Chapter 4701 of the Revised Code and who holds an Ohio permit issued under that chapter;

    (2) A person who holds a certificate of qualification to practice architecture issued or renewed and registered under Chapter 4703 of the Revised Code;

    (3) A person who is registered as a landscape architect under Chapter 4703 of the Revised Code or who holds a permit as a landscape architect issued under that chapter;

    (4) A person licensed under Chapter 4707 of the Revised Code;

    (5) A person who has been issued a certificate of registration as a registered barber under Chapter 4709 of the Revised Code;

    (6) A person licensed and regulated to engage in the business of a debt pooling company by a legislative authority, under authority of Chapter 4710 of the Revised Code;

    (7) A person who has been issued a cosmetologist's license, hair designer's license, manicurist's license, esthetician's license, natural hair stylist's license, advanced cosmetologist's license, advanced hair designer's license, advanced manicurist's license, advanced esthetician's license, advanced natural hair stylist's license, cosmetology instructor's license, hair design instructor's license, manicurist instructor's license, esthetics instructor's license, natural hair style instructor's license, independent contractor's license, or tanning facility permit under Chapter 4713 of the Revised Code;

    (8) A person who has been issued a license to practice dentistry, a general anesthesia permit, a conscious sedation permit, a limited resident's license, a limited teaching license, a dental hygienist's license, or a dental hygienist's teacher's certificate under Chapter 4715 of the Revised Code;

    (9) A person who has been issued an embalmer's license, a funeral director's license, a funeral home license, or a crematory license, or who has been registered for an embalmer's or funeral director's apprenticeship under Chapter 4717 of the Revised Code;

    (10) A person who has been licensed as a registered nurse or practical nurse, or who has been issued a certificate for the practice of nurse-midwifery under Chapter 4723 of the Revised Code;

    (11) A person who has been licensed to practice optometry or to engage in optical dispensing under Chapter 4725 of the Revised Code;

    (12) A person licensed to act as a pawnbroker under Chapter 4727 of the Revised Code;

    (13) A person licensed to act as a precious metals dealer under Chapter 4728 of the Revised Code;

    (14) A person licensed under Chapter 4729 of the Revised Code as a pharmacist or pharmacy intern or registered under that chapter as a registered pharmacy technician, certified pharmacy technician, or pharmacy technician trainee;

    (15) A person licensed under Chapter 4729 of the Revised Code as a manufacturer of dangerous drugs, outsourcing facility, third-party logistics provider, repackager of dangerous drugs, wholesale distributor of dangerous drugs, or terminal distributor of dangerous drugs;

    (16) A person who is authorized to practice as a physician assistant under Chapter 4730 of the Revised Code;

    (17) A person who has been issued a license to practice medicine and surgery, osteopathic medicine and surgery, or podiatric medicine and surgery under Chapter 4731 of the Revised Code or has been issued a certificate to practice a limited branch of medicine under that chapter;

    (18) A person licensed as a psychologist, independent school psychologist, or school psychologist under Chapter 4732 of the Revised Code;

    (19) A person registered to practice the profession of engineering or surveying under Chapter 4733 of the Revised Code;

    (20) A person who has been issued a license to practice chiropractic under Chapter 4734 of the Revised Code;

    (21) A person licensed to act as a real estate broker or real estate salesperson under Chapter 4735 of the Revised Code;

    (22) A person registered as a registered environmental health specialist under Chapter 4736 of the Revised Code;

    (23) A person licensed to operate or maintain a junkyard under Chapter 4737 of the Revised Code;

    (24) A person who has been issued a motor vehicle salvage dealer's license under Chapter 4738 of the Revised Code;

    (25) A person who has been licensed to act as a steam engineer under Chapter 4739 of the Revised Code;

    (26) A person who has been issued a license or temporary permit to practice veterinary medicine or any of its branches, or who is registered as a graduate animal technician under Chapter 4741 of the Revised Code;

    (27) A person who has been issued a hearing aid dealer's or fitter's license or trainee permit under Chapter 4747 of the Revised Code;

    (28) A person who has been issued a class A, class B, or class C license or who has been registered as an investigator or security guard employee under Chapter 4749 of the Revised Code;

    (29) A person licensed to practice as a nursing home administrator under Chapter 4751 of the Revised Code;

    (30) A person licensed to practice as a speech-language pathologist or audiologist under Chapter 4753 of the Revised Code;

    (31) A person issued a license as an occupational therapist or physical therapist under Chapter 4755 of the Revised Code;

    (32) A person who is licensed as a licensed professional clinical counselor, licensed professional counselor, social worker, independent social worker, independent marriage and family therapist, or marriage and family therapist, or registered as a social work assistant under Chapter 4757 of the Revised Code;

    (33) A person issued a license to practice dietetics under Chapter 4759 of the Revised Code;

    (34) A person who has been issued a license or limited permit to practice respiratory therapy under Chapter 4761 of the Revised Code;

    (35) A person who has been issued a real estate appraiser certificate under Chapter 4763 of the Revised Code;

    (36) A person who has been issued a home inspector license under Chapter 4764 of the Revised Code;

    (37) A person who has been admitted to the bar by order of the supreme court in compliance with its prescribed and published rules. See Ohio Code 2925.01

  • Property: means real and personal property. See Ohio Code 1.59
  • Property: means "property" as defined in section 2901. See Ohio Code 2981.01
  • Property subject to forfeiture: includes contraband and proceeds and may include instrumentalities as provided in this chapter. See Ohio Code 2981.01
  • proprietary function: includes , but is not limited to, the following:

    (a) The operation of a hospital by one or more political subdivisions;

    (b) The design, construction, reconstruction, renovation, repair, maintenance, and operation of a public cemetery other than a township cemetery;

    (c) The establishment, maintenance, and operation of a utility, including, but not limited to, a light, gas, power, or heat plant, a railroad, a busline or other transit company, an airport, and a municipal corporation water supply system;

    (d) The maintenance, destruction, operation, and upkeep of a sewer system;

    (e) The operation and control of a public stadium, auditorium, civic or social center, exhibition hall, arts and crafts center, band or orchestra, or off-street parking facility. See Ohio Code 2744.01

  • Prosecute: To charge someone with a crime. A prosecutor tries a criminal case on behalf of the government.
  • Prosecuting attorney: means the prosecuting attorney who prosecuted the case of the offender in question or the successor in office to that prosecuting attorney. See Ohio Code 2971.01
  • prosecution: means the prosecution of criminal charges in a criminal prosecution or the prosecution of a delinquent child complaint in a delinquency proceeding. See Ohio Code 2930.01
  • Prosecutor: means one of the following:

    (1) With respect to a criminal case, it has the same meaning as in section 2935. See Ohio Code 2930.01

  • Prosecutor: includes the county prosecuting attorney and any assistant prosecutor designated to assist the county prosecuting attorney, and, in the case of courts inferior to courts of common pleas, includes the village solicitor, city director of law, or similar chief legal officer of a municipal corporation, any such officer's assistants, or any attorney designated by the prosecuting attorney of the county to appear for the prosecution of a given case. See Ohio Code 2935.01
  • Protected person: means an adult for whom a protective order has been issued. See Ohio Code 2112.01
  • Protective order: means an order appointing a guardian or other order under division (B)(3) of section 2111. See Ohio Code 2112.01
  • Protective proceeding: means a judicial proceeding in which a protective order is sought or has been issued. See Ohio Code 2112.01
  • Protective supervision: means an order of disposition pursuant to which the court permits an abused, neglected, dependent, or unruly child to remain in the custody of the child's parents, guardian, or custodian and stay in the child's home, subject to any conditions and limitations upon the child, the child's parents, guardian, or custodian, or any other person that the court prescribes, including supervision as directed by the court for the protection of the child. See Ohio Code 2151.011
  • Public agency: means an office, agency, department, bureau, or other governmental entity of the state or of a political subdivision of the state. See Ohio Code 2930.01
  • Public defender: Represent defendants who can't afford an attorney in criminal matters.
  • Public duty: includes , but is not limited to, any statutory, regulatory, or assumed duty concerning any action or omission of the state involving any of the following:

    (a) Permitting, certifying, licensing, inspecting, investigating, supervising, regulating, auditing, monitoring, law enforcement, emergency response activity, or compromising claims;

    (b) Supervising, rehabilitating, or liquidating corporations or other business entities. See Ohio Code 2743.01

  • Public law: A public bill or joint resolution that has passed both chambers and been enacted into law. Public laws have general applicability nationwide.
  • Public premises: means any hotel, restaurant, tavern, store, arena, hall, or other place of public accommodation, business, amusement, or resort. See Ohio Code 2925.01
  • Public registry-qualified juvenile offender registrant: means a person who is adjudicated a delinquent child and on whom a juvenile court has imposed a serious youthful offender dispositional sentence under section 2152. See Ohio Code 2950.01
  • Public roads: means public roads, highways, streets, avenues, alleys, and bridges within a political subdivision. See Ohio Code 2744.01
  • Punch board: means a form of instant bingo that uses a board containing a number of holes or receptacles of uniform size in which are placed, mechanically and randomly, serially numbered slips of paper that may be punched or drawn from the hole or receptacle. See Ohio Code 2915.01
  • Quorum: The number of legislators that must be present to do business.
  • Raffle: means a form of bingo in which the one or more prizes are won by one or more persons who have purchased a raffle ticket. See Ohio Code 2915.01
  • Ranking minority member: The highest ranking (and usually longest serving) minority member of a committee or subcommittee.
  • Real property: Land, and all immovable fixtures erected on, growing on, or affixed to the land.
  • Record: means information that is inscribed on a tangible medium or that is stored in an electronic or other medium and is retrievable in perceivable form. See Ohio Code 3115.102
  • Record: means information that is inscribed on a tangible medium or that is stored in an electronic or other medium and is retrievable in perceivable form. See Ohio Code 2112.01
  • Record: means information that is inscribed on a tangible medium or that is stored in an electronic or other medium and is retrievable in perceivable form. See Ohio Code 2137.01
  • Recourse: An arrangement in which a bank retains, in form or in substance, any credit risk directly or indirectly associated with an asset it has sold (in accordance with generally accepted accounting principles) that exceeds a pro rata share of the bank's claim on the asset. If a bank has no claim on an asset it has sold, then the retention of any credit risk is recourse. Source: FDIC
  • Redeemable voucher: means any ticket, token, coupon, receipt, or other noncash representation of value. See Ohio Code 2915.01
  • Register: means to file in a tribunal of this state a support order or judgment determining parentage of a child issued in another state or a foreign country. See Ohio Code 3115.102
  • Registered mail: includes certified mail and "certified mail" includes registered mail. See Ohio Code 1.02
  • Registering tribunal: means a tribunal in which a support order or judgment determining parentage of a child is registered. See Ohio Code 3115.102
  • release violator: means any parolee or releasee who has been declared to be in violation of the condition of parole or post-release control specified in division (A) or (B) of section 2967. See Ohio Code 2967.01
  • Releasee: means an inmate who has been released from confinement pursuant to section 2967. See Ohio Code 2967.01
  • Religious organization: means any church, body of communicants, or group that is not organized or operated for profit and that gathers in common membership for regular worship and religious observances. See Ohio Code 2915.01
  • Remainder: An interest in property that takes effect in the future at a specified time or after the occurrence of some event, such as the death of a life tenant.
  • Remand: When an appellate court sends a case back to a lower court for further proceedings.
  • Remote-computing service: means a custodian that provides to a user computer-processing services or the storage of digital assets by means of an electronic communications system, as defined in 18 U. See Ohio Code 2137.01
  • Rental agreement: means any agreement or lease, written or oral, that establishes or modifies the terms, conditions, rules, or other provisions concerning the use or occupancy of premises by one of the parties to the agreement or lease, except that "rental agreement" as used in division (A)(13) of section 1923. See Ohio Code 1923.01
  • Rented property: means personal property in which the right of possession and use of the property is for a short and possibly indeterminate term in return for consideration; the rentee generally controls the duration of possession of the property, within any applicable minimum or maximum term; and the amount of consideration generally is determined by the duration of possession of the property. See Ohio Code 2913.01
  • Repeat violent offender: means a person about whom both of the following apply:

    (1) The person is being sentenced for committing or for complicity in committing any of the following:

    (a) Aggravated murder, murder, any felony of the first or second degree that is an offense of violence, or an attempt to commit any of these offenses if the attempt is a felony of the first or second degree;

    (b) An offense under an existing or former law of this state, another state, or the United States that is or was substantially equivalent to an offense described in division (CC)(1)(a) of this section. See Ohio Code 2929.01

  • Reporter: Makes a record of court proceedings and prepares a transcript, and also publishes the court's opinions or decisions (in the courts of appeals).
  • Reprieve: means the temporary suspension by the governor of the execution of a sentence or prison term. See Ohio Code 2967.01
  • Rescission: The cancellation of budget authority previously provided by Congress. The Impoundment Control Act of 1974 specifies that the President may propose to Congress that funds be rescinded. If both Houses have not approved a rescission proposal (by passing legislation) within 45 days of continuous session, any funds being withheld must be made available for obligation.
  • Residential camp: means a program in which the care, physical custody, or control of children is accepted overnight for recreational or recreational and educational purposes. See Ohio Code 2151.011
  • Residential care facility: means an institution, residence, or facility that is licensed by the department of mental health and addiction services under section 5119. See Ohio Code 2151.011
  • Residential condominium unit: means a "residential unit" as defined in section 5311. See Ohio Code 2308.01
  • Residential facility: means a home or facility that is licensed by the department of developmental disabilities under section 5123. See Ohio Code 2151.011
  • Residential mortgage loan: means a loan or agreement to extend credit, including the renewal, refinancing, or modification of such a loan or agreement, that is made to a person and that is primarily secured by a mortgage, deed of trust, or other lien upon any interest in residential property or any certification of stock or other evidence of ownership in, and a proprietary lease from, a corporation or partnership formed for the purpose of cooperative ownership of residential property. See Ohio Code 2308.01
  • Residential premises: includes any type of structure in which a residential unit is located, including, but not limited to, multi-unit buildings and mobile and manufactured homes. See Ohio Code 2950.01
  • Residential property: includes a residential condominium unit, notwithstanding the number of units in the structure, but includes a manufactured or mobile home only if it is taxed as real property. See Ohio Code 2308.01
  • Residential unit: means a dwelling unit for residential use and occupancy, and includes the structure or part of a structure that is used as a home, residence, or sleeping place by one person who maintains a household or two or more persons who maintain a common household. See Ohio Code 2950.01
  • Respondent: means the party against whom a motion for an order of possession of specific personal property pursuant to section 2737. See Ohio Code 2737.01
  • Respondent: means an adult for whom a protective order or the appointment of a guardian is sought. See Ohio Code 2112.01
  • Responding state: means a state in which a petition or comparable pleading for support or to determine parentage of a child is filed or to which a petition or comparable pleading is forwarded for filing from another state or a foreign country. See Ohio Code 3115.102
  • Responding tribunal: means the authorized tribunal in a responding state or foreign country. See Ohio Code 3115.102
  • Restitution: The court-ordered payment of money by the defendant to the victim for damages caused by the criminal action.
  • Revocable trust: A trust agreement that can be canceled, rescinded, revoked, or repealed by the grantor (person who establishes the trust).
  • Revoke: means to void permanently all rights and privileges of the holder of a license issued under section 2915. See Ohio Code 2915.01
  • Right of publicity: means the property right in an individual's persona to use the individual's persona for a commercial purpose. See Ohio Code 2741.01
  • Right of survivorship: The ownership rights that result in the acquisition of title to property by reason of having survived other co-owners.
  • Rule: includes regulation. See Ohio Code 1.59
  • Sample drug: means a drug or pharmaceutical preparation that would be hazardous to health or safety if used without the supervision of a licensed health professional authorized to prescribe drugs, or a drug of abuse, and that, at one time, had been placed in a container plainly marked as a sample by a manufacturer. See Ohio Code 2925.01
  • Sanction: includes any sanction imposed pursuant to any provision of sections 2929. See Ohio Code 2929.01
  • Schedule: means the basic child support schedule created pursuant to section 3119. See Ohio Code 3119.01
  • Scheme of chance: includes the use of an electronic device to reveal the results of a game entry if valuable consideration is paid, directly or indirectly, for a chance to win a prize. See Ohio Code 2915.01
  • School: means any school operated by a board of education, any community school established under Chapter 3314 of the Revised Code, or any nonpublic school for which the state board of education prescribes minimum standards under section 3301. See Ohio Code 2925.01
  • School building: means any building in which any of the instruction, extracurricular activities, or training provided by a school is conducted, whether or not any instruction, extracurricular activities, or training provided by the school is being conducted in the school building at the time a criminal offense is committed. See Ohio Code 2925.01
  • School day: means the school day established by the board of education of the applicable school district pursuant to section 3313. See Ohio Code 2151.011
  • School premises: means either of the following:

    (1) The parcel of real property on which any school is situated, whether or not any instruction, extracurricular activities, or training provided by the school is being conducted on the premises at the time a criminal offense is committed;

    (2) Any other parcel of real property that is owned or leased by a board of education of a school, the governing authority of a community school established under Chapter 3314 of the Revised Code, or the governing body of a nonpublic school for which the state board of education prescribes minimum standards under section 3301. See Ohio Code 2925.01

  • Seal card: means a form of instant bingo that uses instant bingo tickets in conjunction with a board or placard that contains one or more seals that, when removed or opened, reveal predesignated winning numbers, letters, or symbols. See Ohio Code 2915.01
  • Second degree felony mandatory prison term: means one of the definite prison terms prescribed in division (A)(2)(b) of section 2929. See Ohio Code 2925.01
  • Secure correctional facility: means a facility under the direction of the department of youth services that is designed to physically restrict the movement and activities of children and used for the placement of children after adjudication and disposition. See Ohio Code 2151.011
  • Secure facility: means any facility that is designed and operated to ensure that all of its entrances and exits are locked and under the exclusive control of its staff and to ensure that, because of that exclusive control, no person who is institutionalized or confined in the facility may leave the facility without permission or supervision. See Ohio Code 2950.01
  • Security personnel: includes any person who either is a sheriff, deputy sheriff, marshal, deputy marshal, township constable, or member of an organized police department of a municipal corporation or has successfully completed a peace officer's training course pursuant to sections 109. See Ohio Code 2915.01
  • Self-generated income: includes expense reimbursements or in-kind payments received by a parent from self-employment, the operation of a business, or rents, including company cars, free housing, reimbursed meals, and other benefits, if the reimbursements are significant and reduce personal living expenses. See Ohio Code 3119.01
  • Self-sufficiency reserve: means the minimal amount necessary for an obligor to adequately subsist upon, as determined under section 3119. See Ohio Code 3119.01
  • Sentence: means the sanction or combination of sanctions imposed by the sentencing court on an offender who is convicted of or pleads guilty to an offense. See Ohio Code 2929.01
  • Serious youthful offender: means a person who is eligible for a mandatory SYO or discretionary SYO but who is not transferred to adult court under a mandatory or discretionary transfer and also includes, for purposes of imposition of a mandatory serious youthful dispositional sentence under section 2152. See Ohio Code 2152.02
  • service: means a corporation organized under Chapter 1702 of the Revised Code for the purpose of counseling consumers with respect to their financial obligations and assisting them in dealing with their creditors. See Ohio Code 2716.03
  • Service of process: The service of writs or summonses to the appropriate party.
  • Services: include labor, personal services, professional services, rental services, public utility services including wireless service as defined in division (F)(1) of section 128. See Ohio Code 2913.01
  • Settlement: Parties to a lawsuit resolve their difference without having a trial. Settlements often involve the payment of compensation by one party in satisfaction of the other party's claims.
  • Sex offender: means , subject to division (B)(2) of this section, a person who is convicted of, pleads guilty to, has been convicted of, has pleaded guilty to, is adjudicated a delinquent child for committing, or has been adjudicated a delinquent child for committing any sexually oriented offense. See Ohio Code 2950.01
  • Sexual motivation: means a purpose to gratify the sexual needs or desires of the offender. See Ohio Code 2971.01
  • Sexual motivation specification: means a specification, as described in section 2941. See Ohio Code 2971.01
  • Sexually oriented offense: means any of the following violations or offenses committed by a person, regardless of the person's age:

    (1) A violation of section 2907. See Ohio Code 2950.01

  • Sexually violent offense: means any of the following:

    (1) A violent sex offense;

    (2) A designated homicide, assault, or kidnapping offense that the offender commits with a sexual motivation. See Ohio Code 2971.01

  • Sexually violent predator: means a person who, on or after January 1, 1997, commits a sexually violent offense and is likely to engage in the future in one or more sexually violent offenses. See Ohio Code 2971.01
  • Sexually violent predator specification: means a specification, as described in section 2941. See Ohio Code 2971.01
  • Shelter: means the temporary care of children in physically unrestricted facilities pending court adjudication or disposition. See Ohio Code 2151.011
  • Significant-connection state: means a state, other than the home state, with which a respondent has a significant connection other than mere physical presence and in which substantial evidence concerning the respondent is available. See Ohio Code 2112.01
  • Skill-based amusement machine: means a mechanical, video, digital, or electronic device that rewards the player or players, if at all, only with merchandise prizes or with redeemable vouchers redeemable only for merchandise prizes, provided that with respect to rewards for playing the game all of the following apply:

    (a) The wholesale value of a merchandise prize awarded as a result of the single play of a machine does not exceed ten dollars;

    (b) Redeemable vouchers awarded for any single play of a machine are not redeemable for a merchandise prize with a wholesale value of more than ten dollars;

    (c) Redeemable vouchers are not redeemable for a merchandise prize that has a wholesale value of more than ten dollars times the fewest number of single plays necessary to accrue the redeemable vouchers required to obtain that prize; and

    (d) Any redeemable vouchers or merchandise prizes are distributed at the site of the skill-based amusement machine at the time of play. See Ohio Code 2915.01

  • Slot machine: means either of the following:

    (a) Any mechanical, electronic, video, or digital device that is capable of accepting anything of value, directly or indirectly, from or on behalf of a player who gives the thing of value in the hope of gain;

    (b) Any mechanical, electronic, video, or digital device that is capable of accepting anything of value, directly or indirectly, from or on behalf of a player to conduct bingo or a scheme or game of chance. See Ohio Code 2915.01

  • Slug: means an object that, by virtue of its size, shape, composition, or other quality, is capable of being inserted or deposited in a coin machine as an improper substitute for a genuine coin, bill, or token made for that purpose. See Ohio Code 2913.01
  • Sole ownership: The type of property ownership in which one individual holds legal title to the property and has full control of it.
  • Split parental rights and responsibilities: means a situation in which there is more than one child who is the subject of an allocation of parental rights and responsibilities and each parent is the residential parent and legal custodian of at least one of those children. See Ohio Code 3119.01
  • Sporting organization: means a hunting, fishing, or trapping organization, other than a college or high school fraternity or sorority, that is not organized for profit, that is affiliated with a state or national sporting organization, including but not limited to, the league of Ohio sportsmen, and that has been in continuous existence in this state for a period of three years. See Ohio Code 2915.01
  • Spousal-support order: means a support order for a spouse or former spouse of the obligor. See Ohio Code 3115.102
  • Standard pharmaceutical reference manual: means the current edition, with cumulative changes if any, of references that are approved by the state board of pharmacy. See Ohio Code 2925.01
  • state: means the United States and any foreign nation. See Ohio Code 2712.01
  • State: means the state of Ohio, including, but not limited to, the general assembly, the supreme court, the offices of all elected state officers, and all departments, boards, offices, commissions, agencies, institutions, and other instrumentalities of the state. See Ohio Code 2743.01
  • state: means the state of Ohio. See Ohio Code 1.59
  • State: means the state of Ohio, including, but not limited to, the general assembly, the supreme court, the offices of all elected state officers, and all departments, boards, offices, commissions, agencies, colleges and universities, institutions, and other instrumentalities of the state of Ohio. See Ohio Code 2744.01
  • State: means a state of the United States, the District of Columbia, Puerto Rico, the United States Virgin Islands, or any territory or insular possession under the jurisdiction of the United States. See Ohio Code 3115.102
  • State: includes an Indian tribe or band that is recognized by federal law or formally acknowledged by a state. See Ohio Code 2112.01
  • state agency: except as otherwise provided in the title, means every organized body, office, or agency established by the laws of the state for the exercise of any function of state government. See Ohio Code 1.60
  • State correctional institution: includes any institution or facility that is operated by the department of rehabilitation and correction and that is used for the custody, care, or treatment of criminal, delinquent, or psychologically or psychiatrically disturbed offenders. See Ohio Code 2967.01
  • Stated prison term: includes any credit received by the offender for time spent in jail awaiting trial, sentencing, or transfer to prison for the offense and any time spent under house arrest or house arrest with electronic monitoring imposed after earning credits pursuant to section 2967. See Ohio Code 2929.01
  • Statute: A law passed by a legislature.
  • Statute of limitations: A law that sets the time within which parties must take action to enforce their rights.
  • subdivision: means a municipal corporation, township, county, school district, or other body corporate and politic responsible for governmental activities in a geographic area smaller than that of the state. See Ohio Code 2744.01
  • Subpoena: A command to a witness to appear and give testimony.
  • Subpoena duces tecum: A command to a witness to produce documents.
  • Substance addiction services provider: means an agency, association, corporation or other legal entity, individual, or program that provides one or more of the following at a facility:

    (1) Either alcohol addiction services, or drug addiction services, or both such services that are certified by the director of mental health and addiction services under section 5119. See Ohio Code 2925.01

  • Summons: Another word for subpoena used by the criminal justice system.
  • Supervised release: means a release of an offender from a prison term, a term of imprisonment, or another type of confinement that satisfies either of the following conditions:

    (1) The release is on parole, a conditional pardon, under a community control sanction, under transitional control, or under a post-release control sanction, and it requires the person to report to or be supervised by a parole officer, probation officer, field officer, or another type of supervising officer. See Ohio Code 2950.01

  • Support enforcement agency: means a public official, governmental entity, or private agency authorized to do any of the following:

    (1) Seek enforcement of support orders or laws relating to the duty of support;

    (2) Seek establishment or modification of child support;

    (3) Request determination of parentage of a child;

    (4) Attempt to locate obligors or their assets; or

    (5) Request determination of the controlling child-support order. See Ohio Code 3115.102

  • Support order: means a judgment, decree, order, decision, or directive, whether temporary, final, or subject to modification, issued in a state or foreign country for the benefit of a child, a spouse, or a former spouse, which provides for monetary support, health care, arrearages, retroactive support, or reimbursement for financial assistance provided to an individual obligee in place of child support. See Ohio Code 3115.102
  • Support order: means either an administrative child support order or a court support order. See Ohio Code 3119.01
  • Supreme court: means the supreme court of this state. See Ohio Code 2712.01
  • Suspect: means a person who is alleged to be the perpetrator of a criminal offense. See Ohio Code 2930.01
  • Suspend: means to interrupt temporarily all rights and privileges of the holder of a license issued under section 2915. See Ohio Code 2915.01
  • Sweepstakes: means any game, contest, advertising scheme or plan, or other promotion where consideration is not required for a person to enter to win or become eligible to receive any prize, the determination of which is based upon chance. See Ohio Code 2915.01
  • Sweepstakes terminal device: means a mechanical, video, digital, or electronic machine or device that is owned, leased, or otherwise possessed by any person conducting a sweepstakes, or by that person's partners, affiliates, subsidiaries, or contractors, that is intended to be used by a sweepstakes participant, and that is capable of displaying information on a screen or other mechanism. See Ohio Code 2915.01
  • Sweepstakes terminal device facility: means any location in this state where a sweepstakes terminal device is provided to a sweepstakes participant, except as provided in division (G) of section 2915. See Ohio Code 2915.01
  • Telecommunication: means the origination, emission, dissemination, transmission, or reception of data, images, signals, sounds, or other intelligence or equivalence of intelligence of any nature over any communications system by any method, including, but not limited to, a fiber optic, electronic, magnetic, optical, digital, or analog method. See Ohio Code 2913.01
  • Telecommunications device: means any instrument, equipment, machine, or other device that facilitates telecommunication, including, but not limited to, a computer, computer network, computer chip, computer circuit, scanner, telephone, cellular telephone, pager, personal communications device, transponder, receiver, radio, modem, or device that enables the use of a modem. See Ohio Code 2913.01
  • Telecommunications service: means the providing, allowing, facilitating, or generating of any form of telecommunication through the use of a telecommunications device over a telecommunications system. See Ohio Code 2913.01
  • Temporary custody: means legal custody of a child who is removed from the child's home, which custody may be terminated at any time at the discretion of the court or, if the legal custody is granted in an agreement for temporary custody, by the person who executed the agreement. See Ohio Code 2151.011
  • Temporary restraining order: Prohibits a person from an action that is likely to cause irreparable harm. This differs from an injunction in that it may be granted immediately, without notice to the opposing party, and without a hearing. It is intended to last only until a hearing can be held.
  • tenant: includes a manufactured home park resident. See Ohio Code 1923.01
  • Terms-of-service agreement: means an agreement that controls the relationship between a user and a custodian. See Ohio Code 2137.01
  • Territory: means the geographical areas within which municipal courts have jurisdiction as provided in sections 1901. See Ohio Code 1901.03
  • Testate: To die leaving a will.
  • Testator: A male person who leaves a will at death.
  • Testify: Answer questions in court.
  • Testimony: Evidence presented orally by witnesses during trials or before grand juries.
  • Theft offense: means any of the following:

    (1) A violation of section 2911. See Ohio Code 2913.01

  • Tier one offense: means a violation of section 2903. See Ohio Code 2935.01
  • Tort: A civil wrong or breach of a duty to another person, as outlined by law. A very common tort is negligent operation of a motor vehicle that results in property damage and personal injury in an automobile accident.
  • Traditional juvenile: means a case that is not transferred to adult court under a mandatory or discretionary transfer, that is eligible for a disposition under sections 2152. See Ohio Code 2152.02
  • Traditional response: means a public children services agency's response to a report of child abuse or neglect that encourages engagement of the family in a comprehensive evaluation of the child's current and future safety needs and a fact-finding process to determine whether child abuse or neglect occurred and the circumstances surrounding the alleged harm or risk of harm. See Ohio Code 2151.011
  • Transcript: A written, word-for-word record of what was said, either in a proceeding such as a trial or during some other conversation, as in a transcript of a hearing or oral deposition.
  • Transfer: means , except with respect to a transfer from a criminal court to a juvenile court under section 2152. See Ohio Code 2152.02
  • Transitional control: means control of a prisoner under the transitional control program established by the department of rehabilitation and correction under section 2967. See Ohio Code 2967.01
  • Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence.
  • Trial jury: A group of citizens who hear the evidence presented by both sides at trial and determine the facts in dispute. Federal criminal juries consist of 12 persons. Federal civil juries consist of six persons.
  • Tribunal: means a court, administrative agency, or quasi-judicial entity authorized to establish, enforce, or modify support orders or to determine parentage of a child. See Ohio Code 3115.102
  • Trier of fact: means the jury or, in a nonjury action, the court. See Ohio Code 2741.01
  • True bill: Another word for indictment.
  • Trust account: A general term that covers all types of accounts in a trust department, such as estates, guardianships, and agencies. Source: OCC
  • Trustee: A person or institution holding and administering property in trust.
  • Trustee: includes an original, additional, and successor trustee and a cotrustee. See Ohio Code 2137.01
  • Undertaking: includes a bond. See Ohio Code 1.02
  • Unit dose: means an amount or unit of a compound, mixture, or preparation containing a controlled substance that is separately identifiable and in a form that indicates that it is the amount or unit by which the controlled substance is separately administered to or taken by an individual. See Ohio Code 2925.01
  • United States: includes any state, district, commonwealth, territory, or insular possession of the United States and any area subject to the legislative authority of the United States. See Ohio Code 2712.01
  • United States: includes all the states. See Ohio Code 1.59
  • unruly child: includes any of the following:

    (A) Any child who does not submit to the reasonable control of the child's parents, teachers, guardian, or custodian, by reason of being wayward or habitually disobedient;

    (B) Any child who is an habitual truant from school;

    (C) Any child who behaves in a manner as to injure or endanger the child's own health or morals or the health or morals of others;

    (D) Any child who violates a law, other than division (C) of section 2907. See Ohio Code 2151.022

  • User: means a person that has an account with a custodian. See Ohio Code 2137.01
  • Usury: Charging an illegally high interest rate on a loan. Source: OCC
  • Utter: means to issue, publish, transfer, use, put or send into circulation, deliver, or display. See Ohio Code 2913.01
  • Venue: The geographical location in which a case is tried.
  • Verdict: The decision of a petit jury or a judge.
  • Veto: The procedure established under the Constitution by which the President/Governor refuses to approve a bill or joint resolution and thus prevents its enactment into law. A regular veto occurs when the President/Governor returns the legislation to the house in which it originated. The President/Governor usually returns a vetoed bill with a message indicating his reasons for rejecting the measure. In Congress, the veto can be overridden only by a two-thirds vote in both the Senate and the House.
  • Victim advocate: means a person employed or authorized by a public or private entity who provides support and assistance for a victim of a criminal offense or delinquent act in relation to criminal, civil, administrative, and delinquency cases or proceedings and recovery efforts related to the criminal offense or delinquent act. See Ohio Code 2930.01
  • Victim advocate: work with prosecutors and assist the victims of a crime.
  • Victim Impact Statement: A written or spoken statement by the victim or his or her representative about the physical, emotional, and financial impact of a crime on the victim. The statement is given to the court before sentencing.
  • Victim-offender mediation: means a reconciliation or mediation program that involves an offender and the victim of the offense committed by the offender and that includes a meeting in which the offender and the victim may discuss the offense, discuss restitution, and consider other sanctions for the offense. See Ohio Code 2929.01
  • Violent sex offense: means any of the following:

    (1) A violation of section 2907. See Ohio Code 2971.01

  • Voir dire: The process by which judges and lawyers select a petit jury from among those eligible to serve, by questioning them to determine knowledge of the facts of the case and a willingness to decide the case only on the evidence presented in court. "Voir dire" is a phrase meaning "to speak the truth."
  • Volunteer rescue service organization: means any organization of volunteers organized to function as an emergency medical service organization, as defined in section 4765. See Ohio Code 2915.01
  • Ward: means any adult who has been adjudicated incompetent and for whom a guardian is acting or for whom the probate court is acting pursuant to section 2111. See Ohio Code 2112.01
  • Ward: includes a person for whom a conservator has been appointed by the probate court in an order of conservatorship issued pursuant to section 2111. See Ohio Code 2137.01
  • Whoever: includes all persons, natural and artificial; partners; principals, agents, and employees; and all officials, public or private. See Ohio Code 1.02
  • Will: includes codicils to wills admitted to probate, lost, spoliated, or destroyed wills, and instruments admitted to probate under Chapter 5817 of the Revised Code. See Ohio Code 2137.01
  • Worksheet: means the applicable worksheet created in rules adopted under section 3119. See Ohio Code 3119.01
  • Writ: A formal written command, issued from the court, requiring the performance of a specific act.
  • Writing: means any computer software, document, letter, memorandum, note, paper, plate, data, film, or other thing having in or upon it any written, typewritten, or printed matter, and any token, stamp, seal, credit card, badge, trademark, label, or other symbol of value, right, privilege, license, or identification. See Ohio Code 2913.01
  • Written consent: includes written, electronic, digital, or any other verifiable means of authorization. See Ohio Code 2741.01
  • Youth athletic park organization: means any organization, not organized for profit, that satisfies both of the following:

    (1) It owns, operates, and maintains playing fields that satisfy both of the following:

    (a) The playing fields are used for athletic activities by one or more organizations, not organized for profit, each of which is organized and operated exclusively to provide financial support to, or to operate, athletic activities for persons who are eighteen years of age or younger by means of sponsoring, organizing, operating, or contributing to the support of an athletic team, club, league, or association. See Ohio Code 2915.01
