(1) “Nonadversarial approach” means that the district attorney general and the defense attorney work together for the benefit of the mental health treatment program participants and the mental health treatment court program;

(2) “Severe and persistent mental illness” means a diagnosis of one (1) or more qualifying mental illnesses or disorders, which shall be determined by the department of mental health and substance abuse services;(3) “Sexual offender” means any person who has been convicted of or charged with a sexual offense or violent sexual offense as those terms are defined in § 40-39-202; and(4) “Violent offender” means a person who has been convicted of or charged with an offense, during the course of which there occurred the death of or serious bodily injury to any person.
