Terms Used In Texas Alcoholic Beverage Code 103.06
- Alcoholic beverage: means alcohol, or any beverage containing more than one-half of one percent of alcohol by volume, which is capable of use for beverage purposes, either alone or when diluted. See Texas Alcoholic Beverage Code 1.04
- Commission: means the Texas Alcoholic Beverage Commission. See Texas Alcoholic Beverage Code 1.04
Any alcoholic beverage, its container, and its packaging which has been seized by a peace officer, as provided in § 103.03:
(1) may not be replevied; and
(2) shall be:
(A) destroyed or disposed of by a peace officer; or
(B) delivered to the commission for immediate public or private sale in the manner the commission considers best.
