58-67-201. Board.
(1) |
There is created the Physicians Licensing Board consisting of nine physicians and surgeons and two members of the general public. |
Terms Used In Utah Code 58-67-201
- Adjudicative proceeding: means :Utah Code 68-3-12.5
- Board: means the Physicians Licensing Board created in Section 58-67-201. See Utah Code 58-67-102
- Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
- Presiding officer: A majority-party Senator who presides over the Senate and is charged with maintaining order and decorum, recognizing Members to speak, and interpreting the Senate's rules, practices and precedents.
- Unprofessional conduct: means the same as that term is defined in Sections 58-1-501 and 58-67-502, and as may be further defined by division rule. See Utah Code 58-67-102

The board shall be appointed and serve in accordance with Section 58-1-201. |

(b) |
The board may also designate one of the board’s members on a permanent or rotating basis to:
(i) |
assist the division in reviewing complaints concerning the unlawful or unprofessional conduct of a licensee the board regulates; and |
(ii) |
advise the division in the division’s investigation of these complaints. |

(4) |
A board member who has, under Subsection (3), reviewed a complaint or advised in the complaint’s investigation may be disqualified from participating with the board when the board serves as a presiding officer in an adjudicative proceeding concerning that complaint. |
