Terms Used In Utah Code 72-2-111- Construction: means the construction, reconstruction, replacement, and improvement of the highways, including the acquisition of rights-of-way and material sites. See Utah Code 72-1-102
- Contract: A legal written agreement that becomes binding when signed.
- Department: means the Department of Transportation created in Section 72-1-201. See Utah Code 72-1-102
- Highway: means any public road, street, alley, lane, court, place, viaduct, tunnel, culvert, bridge, or structure laid out or erected for public use, or dedicated or abandoned to the public, or made public in an action for the partition of real property, including the entire area within the right-of-way. See Utah Code 72-1-102
- State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 68-3-12.5
- United States: includes each state, district, and territory of the United States of America. See Utah Code 68-3-12.5
| (a) |
The Legislature assents to all the provisions of Title 23, Highways, U.S.C., relating to federal aid for highway purposes, and all amendatory acts. |
| (b) |
The department may:
| (i) |
enter into a contract or agreement with the United States government relating to the survey, construction, and maintenance of highways under a federal act; |
| (ii) |
submit a scheme or program of construction and maintenance required by a federal agency; and |
| (iii) |
do any other thing necessary to fully carry out the cooperation contemplated and provided for by a federal act. |

| (c) |
The good faith of the state is pledged to make available sufficient funds to match the sums apportioned to the state by the United States government:
| (i) |
for the construction of federal-aid highways; and |
| (ii) |
to provide adequate maintenance for federal-aid highways. |
