  • Accommodations: means the room or other space provided for sleeping, including furnishings and other accessories in the room but not including the provision of food, beverages, telephone services, television or movie services, or other similar services, in a facility that is not a hospital, nursing home, emergency shelter, community mental health or community substance abuse treatment facility, or campground. See Michigan Laws 207.751
  • Affidavit: A written statement of facts confirmed by the oath of the party making it, before a notary or officer having authority to administer oaths.
  • Amendment: A proposal to alter the text of a pending bill or other measure by striking out some of it, by inserting new language, or both. Before an amendment becomes part of the measure, thelegislature must agree to it.
  • Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
  • Apprentice electrician: means an individual other than an electrical contractor, master electrician, or electrical journeyman, who is engaged in learning about and assisting in the installation or alteration of electrical wiring and equipment under the direct personal supervision of an electrical journeyman or master electrician. See Michigan Laws 339.5701
  • Armed forces: means the United States Army, Air Force, Navy, Marine Corps, Space Force, or Coast Guard or other military force designated by Congress as a part of the Armed Forces of the United States, including the reserve components. See Michigan Laws 339.5103
  • Attachment: A procedure by which a person's property is seized to pay judgments levied by the court.
  • Board: means the electrical administrative board described in section 705. See Michigan Laws 339.5701
  • certificate: means a certificate issued pursuant to sections 4, 5, and 6. See Michigan Laws 207.772
  • Charitable organization: means a not-for-profit tax-exempt religious, educational, or humane organization. See Michigan Laws 339.5103
  • Chief executive officer: means for a county the county executive of a county or, if the county does not have an elected county executive, the chairperson of the county board of commissioners and for a city, the mayor. See Michigan Laws 207.751
  • Citation: means that term as described in section 537. See Michigan Laws 339.5103
  • Commission: means the state tax commission created by 1927 PA 360, MCL 209. See Michigan Laws 207.772
  • Condominium unit: means that portion of a structure intended for separate ownership, intended for residential use, and established under the condominium act, 1978 PA 59, MCL 559. See Michigan Laws 207.772
  • Contract: A legal written agreement that becomes binding when signed.
  • Convention facility: means a convention exhibition facility, including meeting rooms and necessary sites, related parking lots or structures, and appurtenant properties and facilities, if the facility itself contains not less than 50,000 square feet of exhibition space and if the eligible municipality is a county, the facility is located within the boundaries of the most populous city in the county. See Michigan Laws 207.751
  • Conviction: A judgement of guilt against a criminal defendant.
  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
  • Department: means the department of licensing and regulatory affairs. See Michigan Laws 339.5103
  • Developer: means a person who is the owner of a new facility at the time of construction or of a rehabilitated facility at the time of rehabilitation for which a neighborhood enterprise zone certificate is applied for or issued. See Michigan Laws 207.772
  • Director: means the director of the department of licensing and regulatory affairs or his or her authorized representative. See Michigan Laws 339.5103
  • Electric sign: means fixed, stationary, or portable self-contained, electrically illuminated equipment that has words or symbols designed to convey information or attract attention. See Michigan Laws 339.5701
  • Electrical contractor: means a person that is engaged in the business of erecting, installing, altering, repairing, servicing, or maintaining electrical wiring. See Michigan Laws 339.5701
  • Electrical journeyman: means an individual other than an electrical contractor who, as his or her principal occupation, is engaged in the practical installation or alteration of electrical wiring. See Michigan Laws 339.5701
  • Electrical wiring: means all wiring, generating equipment, fixtures, appliances, devices, and appurtenances in connection with the generation, distribution, and utilization of electrical energy, in or on a building, residence, structure, or properties, regardless of whether or not the electrical wiring is energized at the time of installation. See Michigan Laws 339.5701
  • Eligible county: means a county with a population of 1,500,000 or more persons that adopts or has adopted a charter under 1966 PA 293, MCL 45. See Michigan Laws 207.751
  • Eligible municipality: means any of the following:
  (i) An eligible county that intends to impose a tax under this act for purposes related to a stadium as defined under subdivision (i)(i). See Michigan Laws 207.751
  • Enforcing agency: means that term as defined in section 2a of the Stille-DeRossett-Hale single state construction code act, MCL 125. See Michigan Laws 339.5105
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • Ex officio: Literally, by virtue of one's office.
  • Facility: means a homestead facility, a new facility, or a rehabilitated facility. See Michigan Laws 207.772
  • Fire alarm contractor: means a person that is engaged in the business of erecting, installing, altering, repairing, servicing, or maintaining wiring, devices, appliances, or equipment of a fire alarm system. See Michigan Laws 339.5701
  • Fire alarm specialty apprentice technician: means an individual other than a fire alarm contractor or a fire alarm specialty technician who is engaged in learning about and assisting in the installation or alteration of fire alarm system wiring and equipment under the direct personal supervision of a fire alarm specialty technician. See Michigan Laws 339.5701
  • Fire alarm specialty licensure: means licensure as a fire alarm contractor or a fire alarm specialty or apprentice technician. See Michigan Laws 339.5701
  • Fire alarm specialty technician: means an individual other than a fire alarm contractor who, as his or her principal occupation, is engaged in the design and practical installation or alteration of fire alarm systems. See Michigan Laws 339.5701
  • Fire alarm system: means a system that is designed to detect and annunciate the presence of fire, or by-products of fire, installed in a building or structure. See Michigan Laws 339.5701
  • Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
  • General public: means each individual who resides in this state and is 18 years of age or older, other than an individual or the spouse of an individual who is licensed or registered in the occupation or who has a material financial interest in the occupation that is regulated by the specific article in which the term is used. See Michigan Laws 339.5105
  • Gross receipts: means that term as defined in former section 7 of 1975 PA 228, or section 111 of the Michigan business tax act, 2007 PA 36, MCL 208. See Michigan Laws 207.751
  • Homestead facility: means 1 of the following:
  •   (i) An existing structure, purchased by or transferred to an owner after December 31, 1996, that has as its primary purpose residential housing consisting of 1 or 2 units, 1 of which is occupied by an owner as his or her principal residence and that is located within a subdivision platted pursuant to state law before January 1, 1968 other than an existing structure for which a certificate will or has been issued after December 31, 2006 in a city with a population of 750,000 or more, is located within a subdivision platted pursuant to state law before January 1, 1968.   • Jobsite: means the immediate work area within the property lines of a single construction project, alteration project, or maintenance project where electrical construction or alteration of electrical wiring is in progress. See Michigan Laws 339.5703
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC
  • License: includes the whole or part of a governmental permit, certificate, approval, registration, charter, or similar form of permission required under a specific article of this act. See Michigan Laws 339.5105
  • Licensee: means a person that is issued a license under this act. See Michigan Laws 339.5105
  • Local governmental unit: means a city, village, or township. See Michigan Laws 207.772
  • Master electrician: means an individual who has the necessary qualifications, training, experience, and technical knowledge to supervise the installation of electrical wiring and equipment in accordance with the standard rules and regulations governing that work. See Michigan Laws 339.5703
  • Michigan electrical code: means part 8 of the state construction code, R 408. See Michigan Laws 339.5107
  • Michigan mechanical code: means part 9A of the state construction code, R 408. See Michigan Laws 339.5107
  • Michigan plumbing code: means part 7 of the state construction code, R 408. See Michigan Laws 339.5107
  • Minor repair work: means electrical wiring that has a value of $100. See Michigan Laws 339.5703
  • Motor vehicle: means a motor vehicle subject to registration and certificate of title under section 216 of the Michigan vehicle code, 1949 PA 300, MCL 257. See Michigan Laws 207.751
  • Municipality: means a city, village, or township. See Michigan Laws 339.5107
  • New facility: means 1 or both of the following:
  •   (i) A new structure or a portion of a new structure that has as its primary purpose residential housing consisting of 1 or 2 units, 1 of which is or will be occupied by an owner as his or her principal residence. See Michigan Laws 207.772
  • Occupation: means a field of endeavor regulated under this act. See Michigan Laws 339.5107
  • Outline lighting: means an arrangement of incandescent lamps or electric discharge tubing that is an integral part of an electrical sign that outlines certain features, such as the shape of a building or the decoration of a window. See Michigan Laws 339.5703
  • Owner: means the record title holder of, or the vendee of the original land contract pertaining to, a new facility, a homestead facility, or a rehabilitated facility for which a neighborhood enterprise zone certificate is applied for or issued. See Michigan Laws 207.772
  • Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
  • Person: means an individual, partnership, corporation, association, or other legal entity. See Michigan Laws 207.751
  • person: may extend and be applied to bodies politic and corporate, as well as to individuals. See Michigan Laws 8.3l
  • Person: means an individual, sole proprietorship, partnership, association, limited liability company, corporation, or common law trust or a combination of those legal entities. See Michigan Laws 339.5107
  • Qualified assessing authority: means 1 of the following:
  •   (i) For a facility other than a homestead facility, the commission. See Michigan Laws 207.772
  • Qualified downtown revitalization district: means an area located within 1 or more of the following:
  •   (i) The boundaries of a downtown district as defined in section 201 of the recodified tax increment financing act, 2018 PA 57, MCL 125. See Michigan Laws 207.772
  • Qualified historic building: means a property within a neighborhood enterprise zone that has been designated a historic resource as defined under section 266 of the income tax act of 1967, 1967 PA 281, MCL 206. See Michigan Laws 207.772
  • Rehabilitated facility: means , except as otherwise provided in section 2a, an existing structure or a portion of an existing structure with a current true cash value of $120,000. See Michigan Laws 207.772
  • Related wiring: means any of the following:
  •   (i) Except as otherwise provided in subparagraphs (i), (ii), (iii), and (iv), that portion of the electric sign wiring that originates at the load-side terminals of a disconnecting means located in the vicinity of the electric sign involved but does not include the installation of the disconnecting means, complete with line-side connections. See Michigan Laws 339.5703
  • Remainder: An interest in property that takes effect in the future at a specified time or after the occurrence of some event, such as the death of a life tenant.
  • Sign specialist: means an individual who, as his or her principal occupation, is engaged in the installation, alteration, or repair of electric signs. See Michigan Laws 339.5703
  • Sign specialty contractor: means a person that is engaged in the business of manufacturing, installing, maintaining, connecting, or repairing electric sign wiring or devices, including wiring that is directly related to electric signs and is electrically dedicated as a sign circuit. See Michigan Laws 339.5703
  • Sign specialty licensure: means licensure as a sign specialist or sign specialty contractor. See Michigan Laws 339.5703
  • Stadium: means a facility, including necessary sites, related parking lots or structures, and appurtenant properties and facilities, that is intended to provide space for any of the following:
  •   (i) A professional baseball franchise, if the facility itself contains not less than 25,000 seats and is located in the downtown area of the most populous city in the eligible county. See Michigan Laws 207.751
  • state: when applied to the different parts of the United States, shall be construed to extend to and include the District of Columbia and the several territories belonging to the United States; and the words "United States" shall be construed to include the district and territories. See Michigan Laws 8.3o
  • State construction code: means the rules promulgated by the state construction code commission under section 4 of the Stille-DeRossett-Hale single state construction code act, MCL 125. See Michigan Laws 339.5107
  • United States: shall be construed to include the district and territories. See Michigan Laws 8.3o
