(1) In accordance with Subsection (2) and except as provided in Subsection (3):
Terms Used In Utah Code 53-2d-803
- AED: means an automated or automatic computerized medical device that:(4)(a) has received pre-market notification approval from the United States Food and Drug Administration, pursuant to Utah Code 53-2d-101
- Department: means the Department of Public Safety created in Section
53-1-103 . See Utah Code 53-1-102- Emergency medical dispatch center: means a public safety answering point, as defined in Section
63H-7a-103 , that is designated as an emergency medical dispatch center by the bureau. See Utah Code 53-2d-101- Person: means :
(24)(a) an individual;(24)(b) an association;(24)(c) an institution;(24)(d) a corporation;(24)(e) a company;(24)(f) a trust;(24)(g) a limited liability company;(24)(h) a partnership;(24)(i) a political subdivision;(24)(j) a government office, department, division, bureau, or other body of government; and(24)(k) any other organization or entity. See Utah Code 68-3-12.5- Vehicle: means every device in, upon, or by which any person or property is or may be transported or drawn upon a highway, excepting devices used exclusively upon stationary rails or tracks. See Utah Code 53-1-102
- Writing: includes :
(48)(a) printing;(48)(b) handwriting; and(48)(c) information stored in an electronic or other medium if the information is retrievable in a perceivable format. See Utah Code 68-3-12.5(1)(a) a person who owns or leases an AED shall report the person’s name, address, and telephone number, and the exact location of the AED, in writing or by a web-based AED registration form, if available, to the emergency medical dispatch center that provides emergency dispatch services for the location where the AED is installed, if the person:(1)(a)(i) installs the AED;(1)(a)(ii) causes the AED to be installed; or(1)(a)(iii) allows the AED to be installed; and(1)(b) a person who owns or leases an AED that is removed from a location where it is installed shall report the person’s name, address, and telephone number, and the exact location from which the AED is removed, in writing or by a web-based AED registration form, if available, to the emergency medical dispatch center that provides emergency dispatch services for the location from which the AED is removed, if the person:(1)(b)(i) removes the AED;(1)(b)(ii) causes the AED to be removed; or(1)(b)(iii) allows the AED to be removed.(2) A report required under Subsection (1) shall be made within 14 days after the day on which the AED is installed or removed.(3) Subsection (1) does not apply to an AED:(3)(a) at a private residence; or(3)(b) in a vehicle or other mobile or temporary location.(4) A person who owns or leases an AED that is installed in, or removed from, a private residence may voluntarily report the location of, or removal of, the AED to the emergency medical dispatch center that provides emergency dispatch services for the location where the private residence is located.(5) The department may not impose a penalty on a person for failing to comply with the requirements of this section. - Department: means the Department of Public Safety created in Section
