Terms Used In CFR > Title 10 > Chapter II

  • Access: means the physical ability of property owners and their successors in interest to have ingress to and egress from State or private inholdings, valid mining claims, or other valid occupancies. See 43 CFR 6301.5
  • Access: means availability of a record to a subject individual. See 45 CFR 5b.1
  • Access: The review or copying of a record or its parts contained in a system of records by a requester. See 32 CFR 326.3
  • Access: Allowing individuals to review or receive copies of their records. See 32 CFR 329.3
  • Accessions training: Training that a Service member receives upon initial entry into Military Service through basic military training. See 32 CFR 105.3
  • Account: means an account on the books of a Federal Reserve Bank. See 30 CFR 1229.103
  • Account processing: includes charging, crediting, and settling of member or eligible institution accounts, excluding individual customer accounts. See 30 CFR 550.227
  • Accreditation: means a determination by a recognized accreditation body (or, in the case of direct accreditation, by FDA) that a third-party certification body meets the applicable requirements of this subpart. See 43 CFR 9180.1
  • Accreditation body: means an authority that performs accreditation of third-party certification bodies. See 43 CFR 9180.1
  • Accredited investor: means the same as in Commission Rule 501(a) (17 CFR 230. See 32 CFR 552.66
  • Accredited third-party certification body: means a third-party certification body that a recognized accreditation body (or, in the case of direct accreditation, FDA) has determined meets the applicable requirements of this subpart and is accredited to conduct food safety audits and to issue food or facility certifications to eligible entities. See 43 CFR 9180.1
  • Accuracy: Within sufficient tolerance for error to assure the quality of the record in terms of its use in making a determination. See 32 CFR 329.3
  • ACFM: means actual cubic feet per minute. See 46 CFR 197.204
  • Act: means the Energy Research and Development Administration Appropriation Authorization of 1977, Pub. See 41 CFR 101-26.803-4
  • Act: The Plant Variety Protection Act (7 U. See 7 CFR 97.2

  • Active duty for training: A category of active duty used to provide structured individual and/or unit training, including on-the-job training, or educational courses to Reserve component members. See 32 CFR 553.1
  • Active use: means that portion of the grazing preference that is:

    (1) Available for livestock grazing use under a permit or lease based on livestock carrying capacity and resource conditions in an allotment. See 43 CFR 4100.0-5

  • Activity plan: means a plan for managing a resource use or value to achieve specific objectives. See 43 CFR 4100.0-5
  • Actual cost: means the sum of all amounts for a project paid by an obligor (or related person), as well as all amounts that the Program determines the obligor will become obligated to pay, as such amounts are calculated by §253. See 50 CFR 253.10
  • Actual use: means where, how many, what kind or class of livestock, and how long livestock graze on an allotment, or on a portion or pasture of an allotment. See 43 CFR 4100.0-5
  • Actually and finally collected funds: means cash or any other form of payment that is, or has become, final and irrevocable. See 30 CFR 1229.103
  • Additional requirements: The requirements of this subpart shall be applicable to mortgages on individual dwelling units in a condominium, except as modified by this section. See 24 CFR 206.131
  • Adequate: means that which is needed to accomplish the intended purpose in keeping with good public health practice. See 43 CFR 8365.1-1
  • Adjudication: means a formal proceeding employing procedures identical or similar to those required by the Administrative Procedure Act, as codified in 5 U. See 29 CFR 4211.1
  • Administrative Cost of Issuing a Loan Guarantee: means the total of all administrative expenses that DOE incurs during:

    (1) The evaluation of an Application for a loan guarantee. See 41 CFR 101-28.203

  • Administrative expenses: (1) Include general office and operating expenses such as telephone and photocopy charges, printing, legal, and professional fees, postage, courier services, and office supplies. See 30 CFR 550.251
  • Administrative Instructions: as used in this subpart means the Administrative Instructions referred to in Rule 34. See 37 CFR 1.1001
  • Administrative law judge: means an administrative law judge appointed pursuant to the provisions of 5 U. See 49 CFR 1515.3
  • Administrative law judge: as used in this part means an administrative law judge appointed pursuant to 5 U. See 43 CFR 3486.4
  • Administrative offset: An action whereby money payable by the United States Government to, or held by the Government for, a recipient is withheld to satisfy a delinquent debt the recipient owes the Government. See 32 CFR 22.105
  • Administrative offset: means withholding funds payable by the United States (including funds payable by the United States on behalf of a State government) to, or held by the United States for, a person to satisfy a claim. See 45 CFR 31.2
  • Administrative wage garnishment: means the process by which a Federal agency orders a non-Federal employer to withhold amounts from a debtor's wages to satisfy a debt, as authorized by 31 U. See 29 CFR 4903.1
  • Administrator: The Administrator of the Agricultural Marketing Service, or any officer or employee of the Service, to whom authority has heretofore been delegated, or to whom authority may hereafter be delegated, to act in his stead. See 7 CFR 61.2
  • Administrator: means the Administrator, Food and Nutrition Service, U. See 24 CFR 200.20
  • Administrator: means the Administrator of the Economic Regulatory Administration. See 29 CFR 4211.1
  • Administrator: means the Federal Energy Administrator of his delegate. See 29 CFR 4211.32

  • Advanced research: Advanced technology development that creates new technology or demonstrates the viability of applying existing technology to new products and processes in a general way. See 32 CFR 22.105
  • Aeronautical knowledge: A student pilot must demonstrate satisfactory aeronautical knowledge on a knowledge test that meets the requirements of this paragraph:

    (1) The test must address the student pilot's knowledge of--

    (i) Applicable sections of parts 61 and 91 of this chapter. See 33 CFR 165.902

  • Affiliate: means an entity or person that controls, is controlled by, or is under common control with, an applicant, permittee or lessee. See 43 CFR 4100.0-5
  • Affiliate: means any company that controls, is controlled by, or is under common control with another company. See 42 CFR 476.110
  • Affiliate: means a company that controls, is controlled by, or is under common control with another company. See 30 CFR 1227.501
  • Agency: means each of the executive agencies and military departments (as defined in 5 U. See 31 CFR 215.2

  • Agricultural Marketing Service: means the Agricultural Marketing Service, United States Department of Agriculture. See 7 CFR 201.2
  • Agricultural product: means an agriculturally-produced product stored or handled for the purposes of interstate or foreign commerce, including a processed product of such agricultural product, as determined by DACO. See 24 CFR 232.897
  • Air carrier: means a citizen of the United States who undertakes directly to engage in or provide air transportation. See 49 CFR 1510.3
  • Air carrier: The name and code of the air carrier reporting the data. See 43 CFR 3430.2
  • Air transportation: means continental interstate air transportation, continental intrastate air transportation, foreign air transportation, non-continental interstate air transportation, or non-continental intrastate air transportation. See 49 CFR 1510.3
  • Air transportation: means foreign air transportation or interstate air transportation as defined in 49 U. See 43 CFR 3471.3-1
  • Air transportation: has the meaning ascribed to it in 49 U. See 43 CFR 3472.1-3

  • Allotment: means an area of land designated and managed for grazing of livestock. See 43 CFR 4100.0-5
  • Allotment: EPA's calculation of the funds that may be available to an eligible recipient for an environmental program grant. See 40 CFR 35.102
  • Amendment: means any data and information that you submit regarding a filed GRAS notice before we respond to your notice by letter in accordance with §570. See 47 CFR 1.749
  • Amendment: means a change you make to an EP, DPP, or DOCD that is pending before BOEM for a decision (see §§550. See 30 CFR 550.200
  • Amendment: The process of adding, deleting, or changing information in a System of Records (SOR) to make the data accurate, relevant, timely, and/or complete. See 32 CFR 329.3
  • Annual energy audit: means a procedure including, but not limited to, verification of the achievement of energy cost savings and energy unit savings guaranteed resulting from implementation of energy conservation measures and determination of whether an adjustment to the energy baseline is justified by conditions beyond the contractor's control. See 30 CFR 56.19120
  • Annual rangelands: means those designated areas in which livestock forage production is primarily attributable to annual plants and varies greatly from year to year. See 43 CFR 4100.0-5
  • Annuitant: means a person receiving or who is entitled and has made application to receive retirement or survivor benefits under subchapter II, IV, or V of chapter 84 of title 5, United States Code. See 14 CFR 302.722
  • Annuity: means the gross monthly annuity rate payable before any authorized deductions (such as those for health benefits and life insurance premiums). See 14 CFR 302.722
  • Answering machine: means either a device or a voicemail system that allows a telephone caller to leave a recorded message to report an unsafe condition at a highway-rail or pathway grade crossing, as described in §234. See 49 CFR 234.301
  • Anthelmintic: An agent that is destructive to worms. See 46 CFR 197.322
  • Antitrust laws: means the antitrust laws, as the term is defined in the first section of the Clayton Act (15 U. See 41 CFR 101-28.306-3
  • Appeal: means the appeal to the ALJ. See 24 CFR 200.20
  • Appellate authority: The individual with authority to deny requests for access or amendment of records under 5 U. See 32 CFR 329.3
  • Applicant: The person who applied for a certificate of plant variety protection. See 7 CFR 97.2
  • Applicant: means a Person, including a prospective Borrower or Project Sponsor, that submits an Application to DOE. See 41 CFR 101-28.203
  • Applicant: means a person or entity that submits a siting application and the agents, employees, and contractors of such person or entity. See 47 CFR 1.6002
  • Applicant: means the person or persons who submit an application for a certificate. See 41 CFR 101-28.306-3
  • Applicant: means an individual who has applied for one of the security threat assessments identified in 49 CFR 1515. See 49 CFR 1515.3
  • Applicant: means the individual or entity applying for a loan (the prospective obligor). See 50 CFR 253.10

  • Assets: includes furniture and equipment, leasehold improvements, and capitalized start-up costs. See 30 CFR 550.227
  • Assets under custody: means assets held as a custodian on behalf of customers, as reported by the bank holding company on the FR Y-15. See 31 CFR 210.10
  • Assignee: A person to whom an owner assigns his/her rights in whole or in part. See 7 CFR 97.2
  • Assignment of the mortgage: If the mortgagee assigns the mortgage on the individual dwelling unit to the Commissioner, the mortgagee shall certify:

    (1) To any changes in the plan of apartment ownership including the administration of the property. See 24 CFR 206.131

  • Assistant Secretary: means the Assistant Secretary for Conservation and Renewable Energy or official to whom the Assistant Secretary's functions may be redelegated by the Secretary. See 41 CFR 101-26.507-4
  • Associate Administrator for Safety: means the Associate Administrator for Safety of the Federal Railroad Administration or that person's delegate as designated in writing. See 49 CFR 218.93
  • Associate Administrator for Safety: means the Associate Administrator for Safety, FRA, or that person's delegate as designated in writing. See 49 CFR 236.903
  • ATA: means a measure of pressure expressed in terms of atmosphere absolute (includes barometric pressure). See 46 CFR 197.204
  • Attorney General: means the Attorney General of the United States. See 41 CFR 101-28.203
  • Attorney General: means the Attorney General of the United States or his designee. See 41 CFR 101-28.306-3
  • Audit: means the systematic, independent, and documented examination (through observation, investigation, discussions with employees of the audited entity, records review, and, as appropriate, sampling and laboratory analysis) to assess an audited entity's food safety processes and procedures. See 43 CFR 8365.1-1
  • Audit: means the systematic and functionally independent examination of an eligible entity under this subpart by an accredited third-party certification body or by FDA. See 43 CFR 9180.1
  • Audit agent: means an individual who is an employee or other agent of an accredited third-party certification body who, although not individually accredited, is qualified to conduct food safety audits on behalf of an accredited third-party certification body. See 43 CFR 9180.1
  • Authorization: means any approval that a siting authority must issue under applicable law prior to the deployment of personal wireless service facilities, including, but not limited to, zoning approval and building permit. See 47 CFR 1.6002
  • Authorized FDA representative: means an FDA District Director in whose district the article of food involved is located or an FDA official senior to such director. See 21 CFR 1.377
  • Authorized officer: means any person authorized by the Secretary to administer regulations in this part. See 43 CFR 4100.0-5
  • Authorized officer: means any employee of the Bureau of Land Management to whom has been delegated the authority to perform the duties described herein. See 43 CFR 4700.0-5
  • Authorized officer: means any employee of the Bureau of Land Management who has been delegated the authority to perform the duties described in this part. See 43 CFR 8360.0-5
  • Authorized officer: means any employee of the Bureau of Land Management designated to perform the duties described in this subpart:

    (b) Fossil means the remains or trace(s) of an organism or assemblage of organisms which have been preserved by natural processes in the earth's crust. See 43 CFR 8224.0-5

  • Authorized officer: means any employee of the Bureau of Land Management to whom has been delegated the authority to perform the duties described in this subpart. See 43 CFR 9212.0-5
  • Automated answering system: means a type of answering system that directs a telephone caller to a single menu of options, where the caller has the choice to select one of the available options to report an unsafe condition at a highway-rail or pathway grade crossing, as described in §234. See 49 CFR 234.301
  • Average risk-weighted assets: means the four-quarter average of the measure of total risk-weighted assets associated with the lower of the bank holding company's common equity tier 1 risk-based capital ratios, as reported on the bank holding company's FR Y-9C for each quarter of the previous calendar year. See 31 CFR 210.10
  • Award: A grant or a cooperative agreement other than a technology investment agreement (TIA). See 32 CFR 34.2
  • Award: means any grant, cooperative agreement or loan made with Recovery Act funds. See 30 CFR 57.14209
  • Backtesting: means the comparison of a Board-regulated institution's internal estimates with actual outcomes during a sample period not used in model development. See 31 CFR 205.28
  • Bank: means a state member bank. See 30 CFR 1227.501
  • Bank: means any person engaged in the business of banking. See 30 CFR 1229.103
  • Banking day: means the part of a day on which a bank is open to the public for carrying on substantially all of its banking functions. See 30 CFR 1229.103
  • Base Allocation: means the fixed amount of funds for each State as set forth in §440. See 41 CFR 101-26.507-4
  • Base temperature: means the temperature used to compute heating and cooling degree days. See 41 CFR 101-26.507-4
  • Base Year: means the fiscal year in which a life cycle cost analysis is conducted. See 30 CFR 56.19094
  • Basic employee death benefit: means the basic employee death benefit as defined in §843. See 14 CFR 302.714
  • Basis grade contract: Contract of sale of cotton for future delivery mentioned in the Act, made at, on, or in any exchange in compliance with subsection 15b(f) of the Act. See 7 CFR 27.2
  • Bell: means a compartment either at ambient pressure (open bell) or pressurized (closed bell) that allows the diver to be transported to and from the underwater work site, allows the diver access to the surrounding environment, and is capable of being used as a refuge during diving operations. See 46 CFR 197.204
  • Biomass: means biologically generated energy sources such as heat derived from combustion of plant matter, or from combustion of gases or liquids derived from plant matter, animal wastes, or sewage, or from combustion of gases derived from landfills, or hydrogen derived from these same sources. See 41 CFR 101-26.607
  • Bleeders: Small orifices on a retort through which steam, other gasses, and condensate are emitted from the retort throughout the entire thermal process. See 37 CFR 2.37
  • Blind sector traffic: means revenue traffic, carried by a foreign air carrier on a flight operating in air transportation, which is enplaned at one foreign point and deplaned at another foreign point, where at least one of such points is not named as a terminal or intermediate point in the carrier's applicable foreign air carrier permit. See 43 CFR 3427.2
  • BLM: means the Bureau of Land Management. See 43 CFR 3170.3
  • Board: The Plant Variety Protection Board appointed by the Secretary. See 7 CFR 97.2
  • Board decisional employee: means a Board Member, law judge or other employee who is, or who may reasonably be expected to be, involved in the decisional process of the proceeding. See 49 CFR 821.60
  • BOEM: means Bureau of Ocean Energy Management. See 30 CFR 550.200
  • Bona fide tenant: means a tenant of the property who is not a mortgagor, borrower, a spouse or child of a mortgagor or borrower, or any other member of a mortgagor's or borrower's family. See 24 CFR 206.3
  • Borrower: means any Person that enters into a Loan Guarantee Agreement with DOE and issues Guaranteed Obligations. See 41 CFR 101-28.203
  • Bottom time: means the total elapsed time measured in minutes from the time the diver leaves the surface in descent to the time to the next whole minute that the diver begins ascent. See 46 CFR 197.204
  • Breach: A loss of control, compromise, unauthorized disclosure, unauthorized acquisition, unauthorized access, or any similar term referring to situations where a person other than authorized users (with an official need to know), and for an other than authorized purpose has access or potential access to personally identifiable information, whether physical or electronic. See 32 CFR 329.3
  • BSEE: means Bureau of Safety and Environmental Enforcement. See 30 CFR 550.200
  • Btu: means British thermal unit. See 30 CFR 57.3202
  • Building: means any closed structure primarily intended for human occupancy in which energy is consumed, produced, or distributed. See 30 CFR 56.19120
  • Building energy system: means an energy conservation measure or any portion of the structure of a building or any mechanical, electrical, or other functional system supporting the building, the nature or selection of which for a new building influences significantly the cost of energy consumed. See 30 CFR 56.19094
  • Building water system: means a water conservation measure or any portion of the structure of a building or any mechanical, electrical, or other functional system supporting the building, the nature or selection of which for a new building influences significantly the cost of water consumed. See 30 CFR 56.19094
  • Bulk-power system: means the same as the definition of such term in paragraph (1) of section 215(a) of the Federal Power Act. See 10 CFR 205.380
  • Burden: means the total time, effort, or financial resources expended by persons to generate, maintain, retain, or disclose or provide information to or for a Federal agency, including:

    (i) Reviewing instructions. See 30 CFR 550.136

  • Bureau: means the Bureau of Land Management. See 43 CFR 8340.0-5
  • Bursting pressure: means the pressure at which a pressure containment device would fail structurally. See 46 CFR 197.204
  • CAA: means a Community Action Agency. See 41 CFR 101-26.507-4
  • Calendar day: means every day shown on the calendar. See 21 CFR 1.377
  • Campfire: means a controlled fire occurring out of doors used for cooking, branding, personal warmth, lighting, ceremonial or esthetic purposes. See 43 CFR 9212.0-5
  • Canned product: A meat or poultry food product with a water activity above 0. See 37 CFR 2.37
  • Captain: means a vessel operator or a vessel master. See 50 CFR 253.10
  • Capture: means the physical containment of natural gas for transportation to market or productive use of natural gas, and includes injection and royalty-free on-site uses pursuant to subpart 3178 of this part. See 43 CFR 3179.3
  • Cargo Preference Act: means the Cargo Preference Act of 1954, 46 U. See 41 CFR 101-28.203
  • Carrier: means any air carrier or foreign air carrier as defined in 49 U. See 43 CFR 3471.3-1
  • Carrier: means any air carrier or foreign air carrier as defined in 49 U. See 43 CFR 3472.1-3
  • Case file: means a BOEM document file containing information and the record of evidence related to the alleged violation. See 30 CFR 550.1402
  • Cash contributions: means the recipient's cash outlay, including the outlay of money contributed to the recipient by third parties. See 10 CFR 600.302
  • Cellulosic biofuel: means any liquid fuel produced from cellulosic feedstocks. See 41 CFR 101-26.801
  • centralized offset: refer to the process by which the Treasury Department's Financial Management Service offsets Federal payments through the Treasury Offset Program. See 29 CFR 4903.1
  • Certificate: A document issued or authorized to be issued under this subpart by an inspector to allow the interstate movement of regulated articles to any destination. See 24 CFR 203.22
  • Certificate: means a USWA document that bears specific assurances under the Act or warrants a person to operate or perform in a certain manner and sets forth specific responsibilities, rights, and privileges granted to the person under the Act. See 24 CFR 232.897
  • Certificate: A certificate of plant variety protection issued under the Act by the Office. See 7 CFR 97.2
  • Certificate: A document which is issued for a regulated article by an inspector or by a person operating under a compliance agreement, and which represents that the article is eligible for interstate movement in accordance with §301. See 24 CFR 203.35
  • Certificate: means a certificate of review issued pursuant to the Act. See 41 CFR 101-28.306-3

  • Certification: means a written debt claim, as prescribed by §179. See 10 CFR 431.20
  • Certification: Refers to the process by which the Department credentials SARCs and SAPR VAs, assesses the effectiveness of sexual assault advocacy capabilities using a competencies framework, and evaluates and performs oversight over SARC and SAPR VA training. See 32 CFR 105.3
  • Change-of-gauge service: means a service that requires a change of aircraft en route but has only a single flight number. See 43 CFR 3472.1-3
  • Check: means a check or an electronic check, as those terms are defined in §229. See 30 CFR 1229.103
  • Chief Counsel: means the NHTSA Chief Counsel, or his or her designee. See 49 CFR 599.500
  • Children: means dependents not exceeding 19 years or a lesser age set forth in the State plan. See 41 CFR 101-26.507-4
  • Cholecystokinetic drug product: A drug product that causes contraction of the gallbladder and is used during the course of diagnostic gallbladder studies (cholecystography). See 46 CFR 197.334
  • CID: means Conservation Information Document. See 30 CFR 550.200
  • Citizen: means a "citizen of the United States" as described in 46 U. See 50 CFR 253.10
  • City: means any unit of general local government. See 31 CFR 215.2
  • Civil penalty: means a fine. See 30 CFR 550.1402
  • Claim: A written demand or written assertion by one of the parties to a grant or cooperative agreement seeking as a matter of right, the payment of money in a sum certain, the adjustment or interpretation of award terms, or other relief arising under or relating to a grant or cooperative agreement. See 32 CFR 22.105
  • claim: means an amount of money, funds, or other property determined by an appropriate official to be owed to the United States from any individual, entity, organization, association, partnership, corporation, or State or local government or subdivision, except another Federal agency. See 45 CFR 31.2
  • Class I: has the meaning assigned by regulations of the Surface Transportation Board (49 CFR part 1201. See 49 CFR 234.401
  • Class of livestock: means ages and/or sex groups of a kind of livestock. See 43 CFR 4100.0-5
  • Classification: The classification of any cotton shall be determined by the quality of a sample in accordance with the Universal Cotton Standards (the official cotton standards of the United States) for cotton property measurements of American Upland cotton. See 7 CFR 27.2
  • Classing Office: A facility of the Cotton Division established under the act at any point. See 7 CFR 28.2
  • Clear and conspicuous: means that a notice is reasonably understandable and designed to call attention to the nature and significance of the information in the notice. See 42 CFR 476.110
  • Clearance point: means the location near a turnout beyond which it is unsafe for passage on an adjacent track(s). See 49 CFR 218.93
  • Clock half-hour: means a time that is on the half-hour, such as 1:30, 2:30, etc. See 30 CFR 1229.103
  • Clock hour: means a time that is on the hour, such as 1:00, 2:00, etc. See 30 CFR 1229.103
  • Close relative: The spouse, parents, adult brothers and sisters, adult natural children, adult stepchildren, and adult adopted children of a decedent. See 32 CFR 553.1
  • Closed area: means public lands closed to entry by a Bureau of Land Management fire prevention order. See 43 CFR 9212.0-5
  • Closed-loop biomass: means any organic material from a plant which is planted exclusively for purposes of being used at a qualified renewable energy facility to generate electricity. See 41 CFR 101-26.607
  • Closeout: The process by which the grants officer administering an award made by a DoD Component determines that all applicable administrative actions and all required work of the award have been completed by the recipient and DoD Component. See 32 CFR 32.2
  • Closeout: The process by which the grants officer administering an award made by a DoD Component determines that all applicable administrative actions and all required work of the award have been completed by the recipient and DoD Component. See 32 CFR 34.2

  • Code lot: All production of a particular product in a specific size container marked with a specific container code. See 37 CFR 2.37
  • Code-sharing arrangement: means an arrangement whereby a carrier's designator code is used to identify a flight operated by another carrier. See 43 CFR 3471.3-1
  • COLA: means a cost-of-living adjustment. See 14 CFR 302.714
  • Collateral misconduct: Victim misconduct that might be in time, place, or circumstance associated with the victim's sexual assault incident. See 32 CFR 105.3
  • Collection of information: includes any requirement or request for persons to obtain, maintain, retain, report, or publicly disclose information. See 30 CFR 550.136
  • Collodion-like vehicle: A solution containing pyroxylin (nitrocellulose) in an appropriate nonaqueous solvent that leaves a transparent cohesive film when applied to the skin in a thin layer. See 46 CFR 197.404

  • Commemorative monuments: Monuments or other structures or landscape features that serve to honor events in history, units of the Armed Forces, individuals, or groups of individuals that served in the Armed Forces, and that do not contain human remains or mark the location of remains in close proximity. See 32 CFR 553.1
  • Commercial diving operation: means all activities in support of a commercial diver. See 46 CFR 197.204
  • Commercial fishery failure: means a serious disruption of a fishery resource affecting present or future productivity due to natural or undetermined causes. See 50 CFR 253.50
  • Commercial prerinse spray valve: means a handheld device that has a release-to-close valve and is suitable for removing food residue from food service items before cleaning them in commercial dishwashing or ware washing equipment. See 30 CFR 56.9330
  • Commission: means the Securities and Exchange Commission. See 32 CFR 552.66
  • Commissioner: The Examiner in Chief of the Office. See 7 CFR 97.2
  • Commissioner: means the Federal Housing Commissioner. See 24 CFR 200.3
  • Commissioner: means the Federal Housing Commissioner. See 24 CFR 207.251
  • Communitized area: means the area committed to a BLM approved communitization agreement. See 43 CFR 3170.3
  • Company: means any corporation, limited liability company, business trust, general or limited partnership, association, or similar organization. See 42 CFR 476.110

  • Component: means an electronic element, device, or appliance (including hardware or software) that is part of a system or subsystem. See 49 CFR 229.305

  • Condition: means the relative degree of soundness of a product which may affect its merchantability and includes those factors which are subject to change and may result from, but not necessarily limited to, age, improper handling, storage or lack of refrigeration. See 7 CFR 51.2
  • Conditional Commitment: means a Term Sheet offered by DOE and accepted by the offeree of the Term Sheet, all in accordance with §609. See 41 CFR 101-28.203
  • Conduct or Sponsor: A Federal agency is considered to "conduct or sponsor" a collection of information if the agency collects the information, causes another agency to collect the information, contracts or enters into a cooperative agreement with a person to collect the information, or requires a person to provide information to another person, or in similar ways causes another agency, contractor, partner in a cooperative agreement, or person to obtain, solicit, or require the disclosure to third parties or the public of information by or for an agency. See 30 CFR 550.136
  • Confidential communications: Defined in 32 CFR part 103. See 32 CFR 105.3
  • Confidential regulatory information: means any record, data, or report, including but not limited to examination reports, or any part thereof, that is non-public, privileged or otherwise not intended for public disclosure which is in the possession or control of a financial regulatory agency and which contains information regarding members of a Bank or financial institutions with which a Bank has had or contemplates having transactions under the Bank Act. See 30 CFR 550.243
  • Configuration management control plan: means a plan designed to ensure that the proper and intended product configuration, including the electronic hardware components and software version, is documented and maintained through the life-cycle of the products in use. See 49 CFR 229.305

  • Consolidated grant: A single grant made to a recipient consolidating funds from more than one environmental grant program. See 40 CFR 35.102
  • Consolidated subsidiary: has the meaning set forth in 12 CFR 249. See 31 CFR 210.10
  • Consultative audit: means an audit of an eligible entity:

    (i) To determine whether such entity is in compliance with the applicable food safety requirements of the FD&C Act, FDA regulations, and industry standards and practices. See 43 CFR 9180.1

  • Consumer: means an individual who obtains or has obtained a financial product or service from you that is to be used primarily for personal, family, or household purposes, or that individual's legal representative. See 42 CFR 476.110
  • Consumer: means an individual who purchases, applies to purchase, or is solicited to purchase from you insurance products or annuities primarily for personal, family, or household purposes. See 30 CFR 1227.501
  • contract of insurance: means the agreement evidenced by such endorsement and includes the terms, conditions and provisions of this part and of the National Housing Act. See 24 CFR 207.251
  • Contracting Officer: means the Secretary of Energy or a DOE official authorized by the Secretary to enter into, administer or terminate DOE Loan Guarantee Agreements and related contracts on behalf of DOE. See 41 CFR 101-28.203
  • Contractor: means any individual, corporation, association, partnership, consortium or joint venture who has contracted to carry out activities under this part. See 43 CFR 3190.0-5
  • contributions: refers to contributions actually provided by the contributor from such individual's property, or the use thereof, or by the use of such individual's own credit. See 20 CFR 725.233
  • control: means having any relationship which gives an entity or person authority directly or indirectly to determine the manner in which an applicant, permittee or lessee conducts grazing operations. See 43 CFR 4100.0-5
  • Control: means either (1) holding 50 percent or more of the outstanding voting securities of an issuer. See 41 CFR 101-28.306-3
  • Control: Ownership or authority of the NRO pursuant to federal statute or privilege to regulate official or public access to records. See 32 CFR 326.3
  • Control of the facility: means ultimate responsibility for the operation and integrity of a facility by ownership, lease, or operating agreement. See 24 CFR 232.897
  • Controlling entity: means an entity which directly or indirectly controls a member or applicant, and is not controlled by any other entity. See 41 CFR 101-28.306-3
  • Cooling Degree Days: means a population-weighted annual average of the climatological cooling degree days for each weather station within a State, as determined by DOE. See 41 CFR 101-26.507-4
  • Corn and callus remover drug product: A topical agent used for the removal of corns and calluses. See 46 CFR 197.452
  • Corporate debt position: means a debt position that is an exposure to a company that is not a sovereign entity, the Bank for International Settlements, the European Central Bank, the European Commission, the International Monetary Fund, a multilateral development bank, a depository institution, a foreign bank, a credit union, a public sector entity, a GSE, or a securitization. See 31 CFR 205.28
  • Cost sharing or matching: means that portion of project or program costs not borne by the Federal Government. See 10 CFR 600.302
  • cotton: means cotton of any variety produced within the continental United States. See 7 CFR 28.2
  • Cotton Division: The Cotton Division of the Service. See 7 CFR 27.2
  • cottonseed: as used in this part means the seed, after having been put through the usual and customary process known as cotton ginning, of any cotton produced within the continental United States. See 7 CFR 61.2
  • Country from which the article is shipped: means the country in which the article of food is loaded onto the conveyance that brings it to the United States or, in the case of food sent by international mail, the country from which the article is mailed. See 21 CFR 1.276
  • County: means any unit of local general Government which is classified as a county by the Bureau of the Census and within the political boundaries of which 500 or more persons are regularly employed by all agencies of the Federal Government. See 31 CFR 215.2
  • County income or employment taxes: means any form of tax for which, under a county ordinance:

    (1) Collection is provided by imposing on employers generally the duty of withholding sums from the pay of employees and making returns of the sums to a designated county officer, department, or instrumentality. See 31 CFR 215.2

  • court: as used in this part will be construed to include court-martial, court of inquiry, military commission, or retiring board. See 32 CFR 534.1
  • Covered asset exchange: means a transaction in which a bank holding company has provided assets of a given liquidity category to a counterparty in exchange for assets of a higher liquidity category, and the bank holding company and the counterparty agreed to return such assets to each other at a future date. See 31 CFR 210.10
  • Covered carrier: means a certificated carrier, a commuter carrier, an air taxi, or a U. See 43 CFR 3453.2
  • Covered program: means a program under Titles XX through XXIII of the Act. See 30 CFR 57.12042
  • Credible report: Either a written or verbal report made in support of an expedited transfer that is determined to have credible information. See 32 CFR 105.3
  • creditor agency: includes OPM, unless otherwise noted. See 10 CFR 431.20
  • Creditor agency: means any Federal agency that is owed a debt. See 29 CFR 4903.1
  • Crisis intervention: Defined in 32 CFR part 103. See 32 CFR 105.3
  • Critical electric infrastructure: means the same as the definition of such term in paragraph (2) of section 215A(a) of the Federal Power Act. See 10 CFR 205.380
  • Critical factor: Any characteristic, condition or aspect of a product, container, or procedure that affects the adequacy of the process schedule. See 37 CFR 2.37
  • Cross-jurisdictional claims: means foreign claims on an ultimate risk basis, as reported by the bank holding company on the FR Y-15. See 31 CFR 210.10
  • Cross-jurisdictional liabilities: means total cross-jurisdictional liabilities, as reported by the bank holding company on the FR Y-15. See 31 CFR 210.10
  • Crossing Inventory: means the U. See 49 CFR 234.401
  • CSRS: means the Civil Service Retirement System as described in subchapter III of chapter 83 of title 5, United States Code. See 14 CFR 302.714
  • CSRS component: means the portion of a combined CSRS/FERS annuity that is computed under CSRS rules. See 14 CFR 302.714
  • Custodian: Person who has possession or control of cotton or of samples, as agent, controller, broker, or factor, as the case may be. See 7 CFR 28.2
  • Customer: means a consumer who has a customer relationship with you. See 42 CFR 476.110
  • Customer relationship: means a continuing relationship between a consumer and you under which you provide one or more financial products or services to the consumer that are to be used primarily for personal, family, or household purposes. See 42 CFR 476.110
  • Cylinder: means a pressure vessel for the storage of gases under pressure. See 46 CFR 197.204
  • CZMA: means Coastal Zone Management Act. See 30 CFR 550.200
  • Dandruff: A condition involving an increased rate of shedding of dead epidermal cells of the scalp. See 46 CFR 197.484
  • Data communication: means transmitting and receiving of data to or from Banks, Federal Reserve offices, clearinghouse associations, depository institutions or their service bureaus, and other direct sending entities. See 30 CFR 550.227
  • Data processing: includes capture, storage, and assembling of, and computation of, data from payment instruments received from Federal Reserve offices, Banks, clearinghouse associations, depository institutions, and other direct lending entities. See 30 CFR 550.227
  • Date of completion: The date on which all work under an award is completed or the date on the award document, or any supplement or amendment thereto, on which Federal sponsorship ends. See 32 CFR 32.2
  • Davis-Bacon Act: means the statute referenced in section 1702(k) of the Act. See 41 CFR 101-28.203
  • Days: means consecutive calendar days, unless otherwise indicated. See 43 CFR 3170.3
  • dealer: means any person who cleans, processes, sells, offers for sale, transports, or delivers for transportation seeds in interstate commerce. See 7 CFR 201.2
  • Debt: Any amount of money or any property owed to a Federal Agency by any person, organization, or entity except another United States Federal Agency. See 32 CFR 22.105
  • Debt: means money owed by an employee of the Federal Government to an agency of the Federal Government, from sources which include loans insured or guaranteed by the United States and all other amounts due the Government from fees, leases, rents, royalties, services, sales of real or personal property, overpayments, penalties, damages, interests, fines and forfeitures (except those arising under the Uniform Code of Military Justice) and all other similar sources. See 10 CFR 431.20
  • Debt: means any amount of money, funds or property that has been determined by an appropriate official of the Federal Government to be owed to the United States government, including government-owned corporations, by a person. See 29 CFR 4903.1
  • Debt position: means a covered position that is not a securitization position or a correlation trading position and that has a value that reacts primarily to changes in interest rates or credit spreads. See 31 CFR 205.28
  • Debtor: means an individual, organization, association, partnership, corporation, or State or local government or subdivision indebted to the Government, or the person or entity with legal responsibility for assuming the debtor's obligation. See 45 CFR 31.2
  • Debtor: means a person who owes a debt to the United States. See 29 CFR 4903.1
  • Deceased beneficiary: In the event that a person, who is otherwise qualified to receive payments as the result of a deficit caused by an underpayment under the provisions of paragraph (c) of this section, dies before receiving payment or before negotiating the check or checks representing such payment, his or her share of the underpayment shall be divided among the remaining living person(s) in the same order or priority. See 20 CFR 725.545
  • Deciding Official: means the Manager of the Golden Field Office of the Department of Energy (or any DOE official to whom the authority of the Manager of the Golden Field Office may be redelegated by the Secretary of Energy). See 41 CFR 101-26.607
  • Decompression chamber: means a pressure vessel for human occupancy such as a surface decompression chamber, closed bell, or deep diving system especially equipped to recompress, decompress, and treat divers. See 46 CFR 197.204
  • Decompression sickness: means a condition caused by the formation of gas or gas bubbles in the blood or body tissue as a result of pressure reduction. See 46 CFR 197.204
  • Decompression table: means a profile or set of profiles of ascent rates and breathing mixtures designed to reduce the pressure on a diver safely to atmospheric pressure after the diver has been exposed to a specific depth and bottom time. See 46 CFR 197.204
  • Defect: Any nonconformance of a container from specified requirements. See 7 CFR 70.36
  • Defective: A container which has one or more defects. See 7 CFR 70.36
  • Defense critical electric infrastructure: means the same as the definition of such term in paragraph (4) of section 215A(a) of the Federal Power Act. See 10 CFR 205.380
  • Defined: (1) The term "member of the same household" as used in section 402(a)(2) of the Act (with respect to a spouse). See 20 CFR 725.232
  • Definitions: (1) The terms used in this subpart shall have the same meaning as set forth in 12 CFR 152. See 32 CFR 536.147
  • Delinquent: means the failure to pay an obligation or debt by the date specified in the initial notification or applicable contractual agreement, unless other payment arrangements have been agreed to by OPM and the debtor by that date, or if, at any time thereafter, the debtor fails to satisfy the obligations under a payment agreement with the creditor agency. See 10 CFR 431.20
  • Delinquent debt: A debt:

    (1) That the debtor fails to pay by the date specified in the initial written notice from the agency owed the debt, normally within 30 calendar days, unless the debtor makes satisfactory payment arrangements with the agency by that date. See 32 CFR 22.105

  • Delinquent debt: means a debt that has not been paid by the date specified in the agency's initial written demand for payment or applicable agreement or instrument (including a post-delinquency payment agreement) unless other satisfactory payment arrangements have been made. See 29 CFR 4903.1
  • Demand: means a noteholder's request that a debtor or guarantor pay a note's full principal and interest balance. See 50 CFR 253.10

  • Determination: Any decision affecting an individual which, in whole or in part, is based on information contained in the record and which is made by any person or agency. See 32 CFR 329.3
  • Developed recreation sites and areas: means sites and areas that contain structures or capital improvements primarily used by the public for recreation purposes. See 43 CFR 8360.0-5
  • Development: The systematic use of scientific and technical knowledge in the design, development, testing, or evaluation of potential new products, processes, or services to meet specific performance requirements or objectives. See 32 CFR 22.105
  • Development: means efforts to create or advance new technology or demonstrate the viability of applying existing technology to new products and processes. See 10 CFR 600.302
  • Dietary supplement: has the meaning given in section 201(ff) of the Federal Food, Drug, and Cosmetic Act. See 43 CFR 8365.1-1
  • Dietary supplement component: means any substance intended for use in the manufacture of a dietary supplement, including those that may not appear in the finished batch of the dietary supplement. See 43 CFR 8365.1-1
  • Direct accreditation: means accreditation of a third-party certification body by FDA. See 43 CFR 9180.1
  • Direct air carrier and foreign air carrier: means a selling carrier. See 49 CFR 1510.3
  • Direct sale: means a sale to a selected purchaser to the exclusion of all others without resorting to advertising for bids. See 24 CFR 291.5
  • Director: The Director of the Cotton Division, or any officer or employee of the Division to whom authority has heretofore been delegated, or to whom authority may hereafter be delegated, to act in his stead. See 7 CFR 61.2
  • Director: means the Director of OPM or his or her designee. See 10 CFR 431.20

  • dispatches trains: means dispatches or otherwise provides the authority for the movement of the train or trains through a highway-rail or pathway grade crossing. See 49 CFR 234.301
  • Dispatching railroad: means a railroad that dispatches or otherwise provides the authority for the movement of one or more trains through a highway-rail or pathway grade crossing. See 49 CFR 234.301
  • Disposable pay: means that part of current basic pay, special pay, incentive pay, retired pay, retainer pay, or, in the case of an employee not entitled to basic pay, other authorized pay remaining after the deduction of any amount required by law to be withheld. See 10 CFR 431.20
  • disposal agency: as used in this part refers to GSA. See 41 CFR 102-75.5
  • Dispute: A disagreement as to the true grade of a sample of cottonseed analyzed and graded by a licensed chemist. See 7 CFR 61.2
  • District: means the specific area of public lands administered by a District Manager or a Field Manager. See 43 CFR 4100.0-5
  • District of Columbia income tax: means the income tax imposed under 47 District of Columbia Code, chapter 15, subchapter II. See 31 CFR 215.2
  • Dive location: means that portion of a vessel or facility from which a diving operation is conducted. See 46 CFR 197.204
  • Dive team: means the divers and diver support personnel involved in a diving operation, including the diving supervisor. See 46 CFR 197.204
  • Diver: means a person working beneath the surface, exposed to hyperbaric conditions, and using underwater breathing apparatus. See 46 CFR 197.204
  • Diver-carried reserve breathing gas: means a supply of air or mixed-gas, as appropriate, carried by the diver in addition to the primary or secondary breathing gas supplied to the diver. See 46 CFR 197.204
  • Dividend or interest reinvestment plan: means a plan which is offered solely to existing security holders of the State savings association which allows such persons to reinvest dividends or interest paid to them on securities issued by the State savings association, and which also may allow additional cash amounts to be contributed by the participants in the plan, provided that the securities to be issued are newly issued, or are purchased for the account of plan participants, at prices not in excess of current market prices at the time of purchase, or at prices not in excess of an amount determined in accordance with a pricing formula specified in the plan and based upon average or current market prices at the time of purchase.   • Diving installation: means all of the equipment used in support of a commercial diving operation. See 46 CFR 197.204
  • Diving mode: means a type of diving requiring SCUBA, surface-supplied air, or surface-supplied mixed-gas equipment, with related procedures and techniques. See 46 CFR 197.204
  • Diving stage: means a suspended platform constructed to carry one or more divers and used for putting divers into the water and bringing them to the surface when in-water decompression or a heavy-weight diving outfit is used. See 46 CFR 197.204
  • Diving supervisor: means the person having complete responsibility for the safety of a commercial diving operation including the responsibility for the safety and health of all diving personnel in accordance with this subpart. See 46 CFR 197.204

  • Domestic violence: means the occurrence of one or more of the following acts by a current or former family member, household member, intimate partner, or caretaker:

    (1) Attempting to cause or causing or threatening another person physical harm, severe emotional distress, psychological trauma, rape, or sexual assault. See 30 CFR 1227.501

  • DOT Decisionmaker: as used in this part is the official authorized to issue final decisions of the Department as set forth in §302. See 43 CFR 3486.4
  • Double sampling: A sampling scheme which involves use of two independently drawn but related samples, a first sample and a second sample which is added to the first to form a total sample size. See 7 CFR 70.36
  • DPP: means Development and Production Plan. See 30 CFR 550.200
  • Dwelling Unit: means a house, including a stationary mobile home, an apartment, a group of rooms, or a single room occupied as separate living quarters. See 41 CFR 101-26.507-4
  • DWOP: means Deepwater Operations Plan. See 30 CFR 550.200
  • Effective date: means the date annuities increased by a COLA begin to accrue at the higher rate. See 14 CFR 302.714

  • Electronic funds transfer: A system that provides the authority to debit or credit accounts in financial institutions by electronic means rather than source documents (e. See 32 CFR 22.105
  • Electronic media: includes any means for transmitting messages electronically between you and a consumer in a format that allows visual text to be displayed on equipment, for example, a personal computer monitor. See 30 CFR 1227.501
  • Eligible cellulosic biofuels production facility: means a facility--

    (1) Located in the United States (including U. See 41 CFR 101-26.801

  • Eligible entity: means a foreign entity in the import supply chain of food for consumption in the United States that chooses to be subject to a food safety audit under this subpart conducted by an accredited third-party certification body. See 43 CFR 9180.1
  • Eligible Lender: means either:

    (1) Any Person formed for the purpose of, or engaged in the business of, lending money that, as determined by DOE in each case, is:

    (i) Not debarred or suspended from participation in a Federal government contract or participation in a non-procurement activity (under a set of uniform regulations implemented for numerous agencies, such as DOE, at 2 CFR part 180). See 41 CFR 101-28.203

  • Eligible place: means a place in the United States that--

    (1) Was an eligible point under section 419 of the Federal Aviation Act of 1958 as in effect before October 1, 1988. See 43 CFR 3507.20

  • Eligible place: means a place in the United States that--

    (1) Was an eligible point under section 419 of the Federal Aviation Act of 1958 as in effect before October 1, 1988. See 43 CFR 3473.3-1

  • Eligible Project: means a project that:

    (1) Is located in the United States at one location, except that the project may be located at two or more locations in the United States if the project is comprised of installations or facilities employing a single New or Significantly Improved Technology that is deployed pursuant to an integrated and comprehensive business plan. See 41 CFR 101-28.203

  • Eligible properties: means HUD-acquired properties designated by HUD for property disposition or other housing programs. See 24 CFR 291.5
  • Emergency: Defined in 32 CFR part 103. See 32 CFR 105.3
  • Emergency care: Defined in 32 CFR part 103. See 32 CFR 105.3
  • Emergency conservation plan: means a set of instructions designed to specify actions to be taken in response to a serious interruption of energy supply. See 30 CFR 57.3202
  • Emergency measures: means measures necessary in the judgment of the Secretary to protect or restore the reliability of critical electric infrastructure or of defense critical electric infrastructure during a grid security emergency as defined in section 215A(a) of the Federal Power Act. See 10 CFR 205.380
  • Emergency order: means an order for emergency measures under section 215A(b) of the Federal Power Act. See 10 CFR 205.380
  • Employee: means a current employee of OPM or other agency, including a current member of the Armed Forces or Reserve of the Armed Forces of the United States. See 10 CFR 431.20
  • Employee: means an individual who is engaged or compensated by a railroad or by a contractor to a railroad to perform any of the duties defined in this subpart. See 49 CFR 218.93
  • Employee: includes a person who had applied for retirement under FERS but had not been separated from the service prior to his or her death even if the person's retirement would have been retroactively effective upon separation. See 14 CFR 302.24
  • Employee: means an officer or employee of the executive branch of the United States. See 20 CFR 10.508
  • Employee benefit plan: means any purchase, savings, option, rights, bonus, ownership, appreciation, profit sharing, thrift, incentive, pension or similar plan solely for officers, directors or employees. See 32 CFR 552.66
  • Employer: means a railroad, or contractor to a railroad, that directly engages or compensates individuals to perform the duties specified in §236. See 49 CFR 236.903
  • Energy baseline: means the amount of energy that would be consumed annually without implementation of energy conservation measures based on historical metered data, engineering calculations, submetering of buildings or energy consuming systems, building load simulation models, statistical regression analysis, or some combination of these methods. See 30 CFR 56.19120
  • Energy conservation measures: means measures that are applied to an existing Federal building that improve energy efficiency and are life cycle cost effective and that involve energy conservation, cogeneration facilities, renewable energy sources, improvements in operation and maintenance efficiencies, or retrofit activities. See 30 CFR 56.19094
  • Energy conservation measures: means measures that are applied to an existing Federally owned building or facility that improves energy efficiency, are life-cycle cost-effective under subpart A of this part, and involve energy conservation, cogeneration facilities, renewable energy sources, improvements in operation and maintenance efficiencies, or retrofit activities. See 30 CFR 56.19120
  • Energy cost savings: means a reduction in the cost of energy and related operation and maintenance expenses, from a base cost established through a methodology set forth in an energy savings performance contract, utilized in an existing federally owned building or buildings or other federally owned facilities as a result of--

    (1) The lease or purchase of operating equipment, improvements, altered operation and maintenance, or technical services. See 30 CFR 56.19120

  • Energy efficiency: means the ratio of the useful output of services in air transportation to the energy consumption of such services. See 43 CFR 3507.11
  • Energy efficiency goal: means the ratio of production achieved to energy used. See 30 CFR 57.3202
  • Energy information: includes all information in whatever form on (1) fuel reserves, exploration, extraction, and energy resources (including petrochemical feedstocks) wherever located. See 29 CFR 4211.32
  • Energy savings performance contract: means a contract which provides for the performance of services for the design, acquisition, installation, testing, operation, and, where appropriate, maintenance and repair of an identified energy conservation measure or series of measures at one or more locations. See 30 CFR 56.19120
  • Energy statement: is a statement of the probable impact of a major regulatory action on energy efficiency and energy conservation, contained in a decision, opinion, order, or rule. See 43 CFR 3507.11
  • Energy unit savings: means the determination, in electrical or thermal units (e. See 30 CFR 56.19120
  • Energy use avoidance: means the amount of energy resources, e. See 30 CFR 57.3202
  • Enforcement agreement: means a written agreement, signed and dated, between a state agency and either the Secretary of the Interior or Secretary of Commerce, or both, to enforce Federal and state laws pertaining to the protection of interjurisdictional fishery resources. See 50 CFR 253.50
  • ENS: means Emergency Notification System as defined in this section. See 49 CFR 234.301
  • Entry: The point at which imported product offered for entry receives reinspection and is marked with the official mark of inspection in accordance with §557. See 37 CFR 2.171
  • Environmental program: A program for which EPA awards grants under the authorities listed in §35. See 40 CFR 35.102
  • EPAA: means the Emergency Petroleum Allocation Act of 1973 (Pub. See 29 CFR 4211.32
  • Ephemeral rangelands: means areas of the Hot Desert Biome (Region) that do not consistently produce enough forage to sustain a livestock operation, but from time to time produce sufficient forage to accommodate livestock grazing. See 43 CFR 4100.0-5
  • Equipment: means tangible, nonexpendable personal property charged directly to the award having a useful life of more than one year and an acquisition cost of $5,000 or more per unit. See 10 CFR 600.302

  • Facility certification: means an attestation, issued for purposes of section 801(q) or 806 of the FD&C Act by an accredited third-party certification body, after conducting a regulatory audit and any other activities necessary to establish whether a facility complies with the applicable food safety requirements of the FD&C Act and FDA regulations. See 43 CFR 9180.1
  • Facility Fee: means the fee, to be paid in the amount and in the manner provided in the Term Sheet, to cover the Administrative Cost of Issuing a Loan Guarantee for the period from the Borrower's acceptance of the Term Sheet through issuance of the Guarantee. See 41 CFR 101-28.203
  • Family Unit: means all persons living together in a dwelling unit. See 41 CFR 101-26.507-4
  • Farm: means farm as defined in §1. See 43 CFR 8365.1-1
  • farm: includes operations that, in addition to these activities:

    (i) Pack or hold raw agricultural commodities;

    (ii) Pack or hold processed food, provided that all processed food used in such activities is either consumed on that farm or another farm under the same management, or is processed food identified in paragraph (1)(iii)(B)(1) of this definition; and

    (iii) Manufacture/process food, provided that:

    (A) All food used in such activities is consumed on that farm or another farm under the same management; or

    (B) Any manufacturing/processing of food that is not consumed on that farm or another farm under the same management consists only of:

    (1) Drying/dehydrating raw agricultural commodities to create a distinct commodity (such as drying/dehydrating grapes to produce raisins), and packaging and labeling such commodities, without additional manufacturing/processing (an example of additional manufacturing/processing is slicing);

    (2) Treatment to manipulate the ripening of raw agricultural commodities (such as by treating produce with ethylene gas), and packaging and labeling treated raw agricultural commodities, without additional manufacturing/processing; and

    (3) Packaging and labeling raw agricultural commodities, when these activities do not involve additional manufacturing/processing (an example of additional manufacturing/processing is irradiation); or

    (2) Secondary activities farm. See 21 CFR 1.227

  • Farm grade crossing: means a type of highway-rail grade crossing where a private roadway used for the movement of farm motor vehicles, farm machinery, or livestock in connection with agricultural pursuits, forestry, or other land-productive purposes crosses one or more railroad tracks at grade. See 49 CFR 234.301
  • FCCS: means the Federal Claims Collection Standards jointly published by the Department of Justice and the General Accounting Office of 4 CFR 101. See 10 CFR 431.20
  • FCCS: means the Federal Claims Collection Standards, 31 CFR parts 900-904. See 29 CFR 4903.1
  • FDA: means the Food and Drug Administration. See 46 CFR 308.524
  • Federal agency: means "agency" as defined by 5 U. See 30 CFR 56.19094
  • Federal agency: has the meaning given such term in section 551(1) of Title 5, United States Code. See 30 CFR 56.19120
  • Federal agency: means any Executive agency under 5 U. See 30 CFR 57.3202
  • Federal building: means an energy or water conservation measure or any building, structure, or facility, or part thereof, including the associated energy and water consuming support systems, which is constructed, renovated, leased, or purchased in whole or in part for use by the Federal government. See 30 CFR 56.19094
  • Federal capital crime: An offense under Federal law for which a sentence of imprisonment for life or the death penalty may be imposed. See 32 CFR 553.1
  • Federal employee: means a current employee of PBGC or other Federal agency, including a current member of the uniformed services, including the Army, Navy, Air Force, Marine Corps, Coast Guard, Commissioned Corps of the National Oceanic and Atmospheric Administration, Commissioned Corps of the Public Health Service, the National Guard, and the reserve forces of the uniformed services. See 29 CFR 4903.1
  • Federal Financing Bank: means an instrumentality of the United States government created by the Federal Financing Bank Act of 1973, under the general supervision of the Secretary of the Treasury. See 41 CFR 101-28.203
  • Federal fishery management plan: means a plan developed and approved under the Magnuson Fishery Conservation and Management Act (16 U. See 50 CFR 253.50
  • Federal payment agency: means any Federal agency that transmits payment requests in the form of certified payment vouchers, or other similar forms, to a disbursing official for disbursement. See 29 CFR 4903.1
  • Federally inspected and passed: Inspected and passed under the Meat Inspection Act, as amended (21 U. See 37 CFR 1.1045
  • Federally owned property: means property in the possession of, or directly acquired by, the Government and subsequently made available to the recipient. See 10 CFR 600.302
  • Fedwire: means the funds-transfer system owned and operated by the Federal Reserve Banks that is used primarily for the transmission and settlement of payment orders governed by this subpart. See 30 CFR 1229.126
  • FERS: means the Federal Employees Retirement System as described in chapter 84 of title 5, United States Code. See 14 CFR 302.24
  • FERS: means the Federal Employees Retirement System as defined in chapter 84 of title 5, United States Code. See 14 CFR 302.714
  • FERS component: means the portion of a combined CSRS/FERS annuity computed under FERS rules. See 14 CFR 302.714
  • FHA: means the Federal Housing Administration. See 24 CFR 203.251
  • FHA: means the Federal Housing Administration. See 24 CFR 200.3
  • Filing: A pleading or other document allowed or required to be filed in accordance with this part shall be considered filed when postmarked, if mailed, or when received, if hand delivered. See 24 CFR 200.20
  • Final Agency Order: means an order issued by the TSA Final Decision Maker. See 49 CFR 1515.3
  • Final disposition: Actions taken to resolve the reported incident, document case outcome, and address the misconduct by the alleged perpetrator, as appropriate. See 32 CFR 105.3
  • Finance Office: means the DOE Office of the Chief Financial Officer (or any office to which that Office's authority may be redelegated by the Secretary of Energy). See 41 CFR 101-26.607
  • Financial assurance: means the surety or other financial obligation authorized by DACO that is a condition of receiving a license or authorization under the Act. See 24 CFR 232.897
  • financial holding company: as used in this subpart means the financial holding company and all of its subsidiaries, including a private equity fund or other fund controlled by the financial holding company. See 31 CFR 315.28
  • Financial institution: means any institution the business of which is engaging in activities that are financial in nature or incidental to such financial activities as described in section 4(k) of the Bank Holding Company Act of 1956 (12 U. See 42 CFR 476.110
  • Financial product or service: means any product or service that a financial holding company could offer by engaging in an activity that is financial in nature or incidental to such a financial activity under section 4(k) of the Bank Holding Company Act of 1956 (12 U. See 42 CFR 476.110
  • Financial regulatory agency: means any of the following:

    (1) The Department of the Treasury, including the Comptroller of the Currency. See 30 CFR 550.243

  • Financial sector entity: has the meaning set forth in 12 CFR 249. See 31 CFR 210.10
  • Financial service: includes your evaluation or brokerage of information that you collect in connection with a request or an application from a consumer for a financial product or service. See 42 CFR 476.110
  • Fire: means the burning of timber, trees, slash, brush, tundra, grass or other flammable material such as, but not limited to, petroleum products, trash, rubbish, lumber, paper, cloth or agricultural refuse occurring out of doors and includes campfire as defined in this section. See 43 CFR 9212.0-5
  • Fiscal year: means the Federal fiscal year beginning October 1 and ending on September 30 of the following calendar year. See 41 CFR 101-26.607
  • Fish: means finfish, mollusks, crustaceans and all other forms of aquatic animal and plant life, other than marine mammals and birds. See 50 CFR 253.10
  • Fisheries management: means all activities concerned with conservation, restoration, enhancement, or utilization of fisheries resources, including research, data collection and analysis, monitoring, assessment, information dissemination, regulation, and enforcement. See 50 CFR 253.50
  • Fishery facility: means land, land structures, water craft that do not engage in fishing, and equipment used for transporting, unloading, receiving, holding, processing, preserving, or distributing fish for commercial purposes (including any water craft used for charter fishing). See 50 CFR 253.10
  • Fishery resource: means finfish, mollusks, and crustaceans, and any form of marine or Great Lakes animal or plant life, including habitat, other than marine mammals and birds. See 50 CFR 253.50
  • Flyway Council: means the Atlantic, Mississippi, Central, or Pacific Flyway Council. See 50 CFR 20.152
  • FMS: means the Financial Management Service, a bureau within the Department of the Treasury. See 45 CFR 31.2
  • FNS: means the Food and Nutrition Service, USDA. See 24 CFR 200.20
  • FOIA: means the Freedom of Information Act, as amended (5 U. See 29 CFR 4901.2
  • Food: has the meaning given in section 201(f) of the Federal Food, Drug, and Cosmetic Act, except that food does not include pesticides (as defined in 7 U. See 43 CFR 8365.1-1
  • Food: has the meaning given in section 201(f) of the FD&C Act, except that food does not include pesticides (as defined in 7 U. See 43 CFR 9180.1
  • Food: has the meaning given in section 201(f) of the Federal Food, Drug, and Cosmetic Act:

    (1) Except for purposes of this subpart, it does not include:

    (i) Food contact substances as defined in section 409(h)(6) of the Federal Food, Drug, and Cosmetic Act. See 21 CFR 1.227

  • Food: has the meaning given in section 201(f) of the act, except as provided in paragraph (b)(5)(i) of this section. See 21 CFR 1.276

  • Food safety audit: means a regulatory audit or a consultative audit that is conducted to determine compliance with the applicable food safety requirements of the FD&C Act, FDA regulations, and for consultative audits, also includes conformance with industry standards and practices. See 43 CFR 9180.1
  • Foot-candle: means a one lumen of light density per square foot. See 49 CFR 228.307
  • Foreign air carrier: means any person other than a citizen of the United States who undertakes directly to engage in or provide air transportation. See 49 CFR 1510.3
  • Foreign Air Carrier: means a non-U. See 43 CFR 3430.0-7
  • Foreign air transportation: means the carriage by aircraft of persons for compensation or hire between a place in the United States and any place outside of the United States. See 49 CFR 1510.3
  • Foreign cooperative: means an autonomous association of persons, identified as members, who are united through a jointly owned enterprise to aggregate food from member growers or processors that is intended for export to the United States. See 43 CFR 9180.1
  • Foreign facility: means a facility other than a domestic facility that manufactures/processes, packs, or holds food for consumption in the United States. See 21 CFR 1.227
  • Former prisoner of war: A person who is eligible for or has been awarded the Prisoner of War Medal. See 32 CFR 553.1
  • Former spouse: See spouse. See 32 CFR 553.1
  • Formula Share: means the percentage of the total formula allocation provided to each State as calculated in §440. See 41 CFR 101-26.507-4
  • FRA: means the Federal Railroad Administration. See 49 CFR 218.93
  • FRA: means the Federal Railroad Administration. See 49 CFR 236.903
  • FRA Associate Administrator: means the FRA Associate Administrator for Railroad Safety/Chief Safety Officer. See 49 CFR 234.401
  • Frequent flyer award: means a zero-fare award of air transportation that a domestic air carrier or foreign air carrier provides to a passenger in exchange for accumulated travel mileage credits in a customer loyalty program, whether or not the term frequent flyer is used in the definition of that program. See 49 CFR 1510.3
  • Fsw: means feet of seawater (or equivalent static pressure head). See 46 CFR 197.204
  • Full address: means the facility's street name and number. See 21 CFR 1.276
  • Full automatic operation: means that mode of an automatic train control system capable of operating without external human influence, in which the locomotive engineer/operator may act as a passive system monitor, in addition to an active system controller. See 49 CFR 236.903
  • Full-time equivalent employee: means all individuals employed by the person claiming the exemption. See 21 CFR 1.328
  • Funding period: The period of time specified in the grant agreement during which the recipient may expend or obligate funds for the purposes set forth in the agreement. See 40 CFR 35.102
  • Funding period: means the period of time when Federal funding is available for obligation by the recipient. See 10 CFR 600.302
  • GAAP: means generally accepted accounting principles as used in the United States. See 31 CFR 210.10
  • Gas: means any fluid, either combustible or noncombustible, hydrocarbon or non-hydrocarbon, that has neither independent shape nor volume, but tends to expand indefinitely and exists in a gaseous state under metered temperature and pressure conditions. See 43 CFR 3170.3
  • Gas embolism: means a condition caused by expanding gases, which have been taken into and retained in the lungs while breathing under pressure, being forced into the bloodstream or other tissues during ascent or decompression. See 46 CFR 197.204
  • General: As used in this subpart, the term "overpayment" includes:

    (1) Payment where no amount is payable under this part. See 20 CFR 725.540

  • General: A student pilot may not operate an aircraft in solo flight unless that student has met the requirements of this section. See 33 CFR 165.902
  • General market risk: means the risk of loss that could result from broad market movements, such as changes in the general level of interest rates, credit spreads, equity prices, foreign exchange rates, or commodity prices. See 31 CFR 205.28
  • General operations: means world-wide Federal agency operations, other than building operations, and includes services. See 30 CFR 57.3202
  • General transportation: means the use of vehicles for over-the-road driving as opposed to vehicles designed for off-road conditions, and the use of aircraft and vessels. See 30 CFR 57.3202
  • Generally infested area: Any part of a regulated area not designated as a suppressive area in accordance with §301. See 24 CFR 203.22

  • Goal: means a specific statement of an intended energy conservation result which will occur within a prescribed time period. See 30 CFR 57.3202
  • Golden nematode: The nematode known as the golden nematode (Globodera rostochiensis), in any stage of development. See 24 CFR 203.22
  • Government: The U. See 32 CFR 553.1
  • Government employee: means any officer or employee, civilian or military, except such part-time employees or part-time consultants as may be excluded therefrom by a determination made in writing by the head of the employee's office or constituent organization, pursuant to an exemption approved by the Commissioner of Patents that to include him or them would be impracticable or inequitable, given the reasons therefor. See 45 CFR 7.0
  • Governor: means the chief executive officer of a State, including the Mayor of the District of Columbia. See 41 CFR 101-26.507-4
  • Grantee: means the State or other entity named in the Notification of Grant Award as the recipient. See 41 CFR 101-26.507-4
  • GRAS: means generally recognized as safe. See 47 CFR 1.749
  • GRAS notice: means a submission that informs us of your view that a substance is not subject to the premarket approval requirements of the Federal Food, Drug, and Cosmetic Act based on your conclusion that the substance is GRAS under the conditions of its intended use in accordance with §570. See 47 CFR 1.749
  • Grazing district: means the specific area within which the public lands are administered under section 3 of the Act. See 43 CFR 4100.0-5
  • Grazing lease: means a document that authorizes grazing use of the public lands under Section 15 of the Act. See 43 CFR 4100.0-5
  • Grazing permit: means a document that authorizes grazing use of the public lands under Section 3 of the Act. See 43 CFR 4100.0-5
  • Grid security emergency: means the same as the definition of such term in paragraph (7) of section 215A(a) of the Federal Power Act. See 10 CFR 205.380
  • Group burial: Interment in one gravesite of one or more service members on active duty killed in the same incident or location where:

    (1) The remains cannot be individually identified. See 32 CFR 553.1

  • Grower: means a person who engages in growing and harvesting or collecting crops (including botanicals), raising animals (including fish, which includes seafood), or both. See 21 CFR 1.276
  • Guarantee: means the undertaking of the United States of America, acting through the Secretary pursuant to Title XVII of the Energy Policy Act of 2005, to pay in accordance with the terms thereof, principal and interest of a Guaranteed Obligation. See 41 CFR 101-28.203
  • Guarantee: means a guarantor's contractual promise to repay indebtedness if an obligor fails to repay as agreed. See 50 CFR 253.10
  • Guarantee fee: means one percent of a guaranteed note's average annual unpaid principal balance. See 50 CFR 253.10
  • Guaranteed note: means a promissory note from an obligor to a noteholder, the repayment of which the United States guarantees. See 50 CFR 253.10
  • Guaranteed Obligation: means any loan or other debt obligation of the Borrower for an Eligible Project for which DOE guarantees all or any part of the payment of principal and interest under a Loan Guarantee Agreement entered into pursuant to the Act. See 41 CFR 101-28.203
  • Guidelines: means a set of instructions designed to prescribe, direct and regulate a course of action. See 30 CFR 57.3202
  • Gummosis disease: A dangerous plant disease of sugarcane which is caused by the highly infectious bacterium, Xanthomonas vasculorum (Cobb) Dowson, and which is not widely prevalent or distributed within and throughout the United States. See 24 CFR 203.35
  • Hand-operated switch: means any type of switch when operated by manual manipulation. See 49 CFR 218.93
  • Hazard: means any biological, chemical (including radiological), or physical agent that is reasonably likely to cause illness or injury. See 43 CFR 8365.1-1
  • Hazard: means an existing or potential condition that can result in an accident. See 49 CFR 236.903
  • Hazard requiring a control: means a known or reasonably foreseeable hazard for which a person knowledgeable about the safe manufacturing, processing, packing, or holding of food would, based on the outcome of a hazard analysis (which includes an assessment of the probability that the hazard will occur in the absence of controls or measures and the severity of the illness or injury if the hazard were to occur), establish one or more controls or measures to significantly minimize or prevent the hazard in a food and components to manage those controls or measures (such as monitoring, corrections or corrective actions, verification, and records) as appropriate to the food, the facility, and the nature of the control or measure and its role in the facility's food safety system. See 43 CFR 8365.1-1
  • Headspace: That portion of a container not occupied by the product. See 37 CFR 2.37
  • health care provider: is a ny:

    (1) Post-secondary educational institution offering health care instruction, including a teaching hospital or medical school;

    (2) Community health center or health center providing health care to migrants;

    (3) Local health department or agency;

    (4) Community mental health center;

    (5) Not-for-profit hospital;

    (6) Rural health clinic;

    (7) Skilled nursing facility; or

    (8) Consortium of health care providers consisting of one or more entities described in paragraphs (a)(1) through (7) of this section. See 47 CFR 54.600

  • Healthcare personnel: Persons assisting or otherwise supporting healthcare providers in providing healthcare services (e. See 32 CFR 105.3
  • Healthcare provider: Those individuals who are employed or assigned as healthcare professionals, or are credentialed to provide healthcare services at a medical treatment facility (MTF), or who provide such care at a deployed location or otherwise in an official capacity. See 32 CFR 105.3
  • Hearing: means that part of the appeal which involves the submission of evidence before the ALJ for the record in the appeal. See 24 CFR 200.20
  • Hearing Clerk: means the Hearing Clerk, USDA, Washington, DC 20250. See 24 CFR 200.20
  • Hearing Officer: means a NHTSA employee who has been delegated the authority to assess civil penalties. See 49 CFR 599.500
  • Hearing official: means an individual (including an administrative law judge) responsible for conducting any hearing with respect to the existence or amount of a debt claimed, and rendering a decision on the basis of such hearing. See 10 CFR 431.20
  • Heating Degree Days: means a population-weighted seasonal average of the climatological heating degree days for each weather station within a State, as determined by DOE. See 41 CFR 101-26.507-4
  • Heavy-weight diving outfit: means diver-worn surface-supplied deep-sea dress. See 46 CFR 197.204
  • Hedge: means a position or positions that offset all, or substantially all, of one or more material risk factors of another position. See 31 CFR 205.28
  • Highway-rail or pathway grade crossing: means either a highway-rail grade crossing or a pathway grade crossing. See 49 CFR 234.301
  • Holder: means a person that has possession in fact or by operation of law of a warehouse receipt, USWA electronic document, or any electronic document. See 24 CFR 232.897
  • Holder: means any Person that holds a promissory note made by the Borrower evidencing the Guaranteed Obligation (or his designee or agent). See 41 CFR 101-28.203
  • Holding: means storage of food and also includes activities performed incidental to storage of a food (e. See 43 CFR 8365.1-1

  • Humane treatment: means handling compatible with animal husbandry practices accepted in the veterinary community, without causing unnecessary stress or suffering to a wild horse or burro. See 43 CFR 4700.0-5
  • HVAC: means heating, ventilation, and air conditioning. See 49 CFR 228.307
  • Hyperbaric conditions: means pressure conditions in excess of surface atmospheric pressure. See 46 CFR 197.204
  • identical: means identical within the variation that can be expected to arise as a result of quantity production techniques. See 47 CFR 2.908
  • Idiosyncratic risk: means the risk of loss in the value of a position that arises from changes in risk factors unique to that position. See 31 CFR 205.28
  • IFQ: means Individual Fishing Quota, which is a Federal permit under a limited access system to harvest a quantity of fish, expressed by a unit or units representing a percentage of the total allowable catch of a fishery that may be received or held for exclusive use by a person. See 50 CFR 253.10
  • Ileostomy: An external operative opening from the ileum. See 46 CFR 197.344
  • Import: To bring within the territorial limits of the United States whether that arrival is accomplished by land, air, or water. See 37 CFR 2.171
  • Importer: means the U. See 43 CFR 8365.1-1
  • Incidental Repairs: means those repairs necessary for the effective performance or preservation of weatherization materials. See 41 CFR 101-26.507-4
  • Incontinence: An inability to retain urine or feces. See 46 CFR 197.344
  • Incremental risk: means the default risk and credit migration risk of a position. See 31 CFR 205.28
  • Incubation tests: Tests in which the thermally processed product is kept at a specific temperature for a specified period of time in order to determine if outgrowth of microorganisms occurs. See 37 CFR 2.37
  • Independent regulatory agency: means the Board of Governors of the Federal Reserve System, the Commodity Futures Trading Commission, the Consumer Product Safety Commission, the Federal Communications Commission, the Federal Deposit Insurance Corporation, the Federal Energy Regulatory Commission, the Federal Housing Finance Board, the Federal Maritime Commission, the Federal Trade Commission, the Interstate Commerce Commission, the Mine Enforcement Safety and Health Review Commission, the National Labor Relations Board, the Nuclear Regulatory Commission, the Occupational Safety and Health Review Commission, the Postal Rate Commission, the Securities and Exchange Commission, and any other similar agency designated by statute as a Federal independent regulatory agency or commission.   • Industry track: means a switching track, or series of tracks, serving the needs of a commercial industry other than a railroad. See 49 CFR 218.93
  • Infestation: The presence of witchweed or the existence of circumstances that make it reasonable to believe that witchweed is present. See 24 CFR 200.193
  • Infestation: The presence of the golden nematode or the existence of circumstances that make it reasonable to believe that the golden nematode is present. See 24 CFR 203.22

  • Information: means any statement or estimate of fact or opinion, regardless of form or format, whether in numerical, graphic, or narrative form, and whether oral or maintained on paper, electronic or other media. See 30 CFR 550.136
  • Ingrown toenail relief drug product: A drug product applied to an ingrown toenail that relieves pain or discomfort either by softening the nail or by hardening the nail bed. See 46 CFR 197.432

  • Land use plan: means a resource management plan, developed under the provisions of 43 CFR part 1600, or a management framework plan. See 43 CFR 4100.0-5
  • Landed: means the first point of offloading fishery resources. See 50 CFR 253.50
  • Lavatory: means a basin or similar vessel used primarily for washing of the hands, arms, face, and head. See 49 CFR 228.307

  • Leaf scald disease: A dangerous plant disease of sugarcane which is caused by the highly infectious bacterium, Xanthomonas albilineans (Ashby) Dowson, and which is not widely prevalent or distributed within and throughout the United States. See 24 CFR 203.35
  • Legally enforceable: means that there has been a final agency determination that the debt, in the amount stated, is due and there are no legal bars to collection action. See 45 CFR 31.2
  • License: means a license issued under the Act by DACO. See 24 CFR 232.897
  • Licensed cottonseed chemist: A person licensed under the act by the Secretary to make quantitative and qualitative chemical analyses of samples of cottonseed according to the methods prescribed by the Science Division Director of the Agricultural Marketing Service and to certificate the grade according to the official cottonseed standards of the United States. See 7 CFR 61.2
  • Licensing agreement: means the document and any amendment or addenda to such agreement executed by the warehouse operator and FSA specifying licensing terms and conditions specific to the warehouse operator and the agricultural product licensed to be stored. See 24 CFR 232.897
  • Life cycle cost: means the total cost of owning, operating and maintaining a building over its useful life (including its fuel and water, energy, labor, and replacement components), determined on the basis of a systematic evaluation and comparison of alternative building systems, except that in the case of leased buildings, the life cycle cost shall be calculated over the effective remaining term of the lease.   • living in the same household: as used in this subpart , means that a husband and wife were customarily living together as husband and wife in the same place. See 20 CFR 725.232
  • Loan Agreement: means a written agreement between a Borrower and an Eligible Lender containing the terms and conditions under which the Eligible Lender will make a loan or loans to the Borrower for an Eligible Project. See 41 CFR 101-28.203
  • Loan Guarantee Agreement: means a written agreement that, when entered into by DOE and a Borrower, and, if applicable, an Eligible Lender, establishes the obligation of DOE to guarantee the payment of all or a portion of the principal of, and interest on, specified Guaranteed Obligations, subject to the terms and conditions specified in the Loan Guarantee Agreement.   • Long-term wet lease: means a lease by which the lessor provides both an aircraft and crew dedicated to a particular route(s), and which either:

  • Lot: That parcel or quantity of cottonseed offered for sale or tendered for delivery or delivered on a sale or contract of sale, in freight cars, trucks, wagons, or otherwise in the quantities and within the time limits prescribed from time to time by the Director for the drawing and preparation of official samples by licensed cottonseed samplers.   • Official establishment: An establishment operated under Federal meat inspection pursuant to the Meat Inspection Act, as amended (21 U. See 37 CFR 1.1045
  • Official investigative process: Defined in 32 CFR part 103. See 32 CFR 105.3
  • Official sample: A specimen of cottonseed drawn and prepared by a licensed cottonseed sampler and certified by him as representative of a certain identified lot, in accordance with the regulations in this subpart. See 7 CFR 61.2
  • Offshore vehicle: means a vehicle that is capable of being driven on ice. See 30 CFR 550.200
  • Oil: means a mixture of hydrocarbons that exists in the liquid phase at the temperature and pressure at which it is measured. See 43 CFR 3170.3
  • Oil well: means a well for which the energy equivalent of the oil produced exceeds the energy equivalent of the gas produced, as determined at the time of well completion. See 43 CFR 3179.3
  • OMB: means the Office of Management and Budget in the Executive Office of the President. See 41 CFR 101-28.203
  • OMB: refers to the Office of Management and Budget. See 30 CFR 550.136
  • One-way trip: means continuous air transportation, during which a stopover does not occur. See 49 CFR 1510.3
  • ONRR: means the Office of Natural Resources Revenue, U. See 43 CFR 3170.3
  • Open window: means the period during each reverse auction, as specified in an associated solicitation, during which DOE accepts bids for production incentives under this part. See 41 CFR 101-26.801
  • Open with limited information: Entry in DSAID to be used in the following situations: Victim refused or declined services, victim opt-out of participating in investigative process, third-party reports, local jurisdiction refused to provide victim information, or civilian victim with military subject. See 32 CFR 105.3
  • Operating carrier: means the carrier that is operating the aircraft in a code-sharing arrangement or long-term wet lease. See 43 CFR 3471.3-1
  • Operating railroad: means any railroad or urban rapid transit operator that operates one or more trains through a highway-rail or pathway crossing on, or connected to, the general railroad system of transportation. See 49 CFR 234.401
  • Operational deposit: has the meaning set forth in 12 CFR 249. See 31 CFR 210.10
  • Operational training and readiness: means those activities which are necessary to establish or maintain an agency's capability to perform its primary mission. See 30 CFR 57.3202
  • Ordinance: means an ordinance, order, resolution, or similar instrument which is duly adopted and approved by a city or county in accordance with the constitution and statutes of the state in which it is located and which has the force of law within such city or county. See 31 CFR 215.2
  • Origination year: means the year in which an application for a loan is accepted for processing. See 50 CFR 253.10
  • Originator: The NRO employee or contractor who created the document at issue or his successor in office or any official who has been delegated release or declassification authority pursuant to law. See 32 CFR 326.3
  • Output: An environmental activity or effort and associated work products related to an environmental goal or objective that will be produced or provided over a period of time or by a specified date. See 40 CFR 35.102
  • overpayment: includes :

    (1) Payment where no amount is payable under this part;

    (2) Payment in excess of the amount payable under this part;

    (3) A payment under this part which has not been reduced by the amounts required by the Act (see §725. See 20 CFR 725.540

  • Owner: A breeder who developed or discovered and developed a variety for which plant variety protection may be applied for under the Act, or a person to whom the rights to such variety have been assigned or transferred. See 7 CFR 97.2
  • Owner: Person who through financial interest, owns, controls, or has the disposition either of cotton or of samples. See 7 CFR 28.2
  • Owner-occupant purchaser: means a purchaser who intends to use the property as his or her principal residence. See 24 CFR 291.5
  • Packing: means placing food into a container other than packaging the food and also includes re-packing and activities performed incidental to packing or re-packing a food (e. See 43 CFR 8365.1-1
  • Packing: means placing food into a container other than packaging the food and also includes re-packing and activities performed incidental to packing or re-packing a food (e. See 21 CFR 1.227
  • Parent: A natural parent, a stepparent, a parent by adoption, or a person who for a period of not less than one year stood in loco parentis, or was granted legal custody by a court decree or statutory provision. See 32 CFR 553.1
  • Parent company: means a company that:

    (1) Exercises ultimate ownership of the applicant company either directly, by ownership of a majority of that company's voting securities, or indirectly, by control over a majority of that company's voting securities through one or more intermediate subsidiary companies or otherwise, and

    (2) Is not itself subject to the ultimate ownership control of another company. See 30 CFR 57.12042

  • Participant: means any applicant or intervenor participating in the adjudication. See 29 CFR 4211.1
  • Participating area: means that part of the unit area that BLM deems to be productive from a horizon or deposit, and to which production would be allocated in the manner described in the unit agreement, assuming that all lands are committed to the unit agreement. See 43 CFR 3280.2
  • party: refers to any person who participates in a proceeding by the timely filing of a petition for rule making, comments on a notice of proposed rule making, a petition for reconsideration, or responsive pleadings in the manner prescribed by this subpart. See 47 CFR 1.400
  • Party: means the applicant or the agency attorney. See 49 CFR 1515.3
  • Party: means the person alleged to have committed a violation of the CARS Act, regulations thereunder, or other applicable law, and includes an individual, a public or private corporation, and a partnership or other association. See 49 CFR 599.500
  • Party: as used in this part includes the person initiating a proceeding, such as an applicant, complainant, or petitioner. See 43 CFR 3486.4
  • Pathogen: means a microorganism of public health significance. See 43 CFR 8365.1-1
  • Pathway crossing: means a pathway that:

    (1) Is explicitly authorized by a public authority or a railroad. See 49 CFR 234.401

  • Pathway grade crossing: means a pathway that crosses one or more railroad tracks at grade and that is--

    (1) Explicitly authorized by a public authority or a railroad. See 49 CFR 234.301

  • Paying agency: means the agency of the Federal Government which employs the individual who owes a debt to an agency of the Federal Government. See 10 CFR 431.20
  • Payments activity: means payments activity, as reported by the bank holding company on the FR Y-15. See 31 CFR 210.10
  • Payroll office: means the payroll office in the paying agency which is primarily responsible for the payroll records and the coordination of pay matters with the appropriate personnel office with respect to an employee. See 10 CFR 431.20
  • Pedestrian crossing: means a separate designated sidewalk or pathway where pedestrians, but not vehicles, cross railroad tracks. See 49 CFR 218.93
  • Pediculicide drug product: A drug product for the treatment of head, pubic (crab), and body lice. See 46 CFR 197.460
  • Percentage change: means the percent change in the price index as defined in section 8462(a)(2) of title 5, United States Code. See 14 CFR 302.714
  • Performance Partnership Agreement: A negotiated agreement signed by the EPA Regional Administrator and an appropriate official of a State agency and designated as a Performance Partnership Agreement. See 40 CFR 35.102
  • Performance Partnership Grant: A single grant combining funds from more than one environmental program. See 40 CFR 35.102
  • Perishable food: means food that is not heat-treated. See 21 CFR 1.377
  • Permanently dependent child: A child of the primarily eligible person who

    (i) Is unmarried. See 32 CFR 553.1

  • Permit: means authorization in writing by the authorized officer. See 43 CFR 9212.0-5
  • Person: Any individual, corporation, company, society, or association, or other organized group of any of the foregoing. See 24 CFR 200.193

See 41 CFR 101-26.507-4
  • Petition for approval: means a petition to FRA for approval to use a product on a railroad as described in its PSP. See 49 CFR 236.903
  • Pink bollworm: The live insect known as the pink bollworm of cotton (Pectinophora gossypiella Saund. See 24 CFR 200.80
  • Plan: means those actions which an agency envisions it must undertake to assure attainment of energy consumption and efficiency goals without an unacceptably adverse impact on primary missions. See 30 CFR 57.3202
  • Plan of development: means the document a unit operator submits to BLM defining how the unit operator will diligently pursue unit exploration and development to meet both initial and subsequent unit development and public interest obligations. See 43 CFR 3280.2
  • Planning target: The amount of funds that the Regional Administrator suggests a grant applicant consider in developing its application, including the work plan, for an environmental program. See 40 CFR 35.102
  • Plant Protection and Quarantine: The organizational unit within the Animal and Plant Health Inspection Service, U. See 24 CFR 203.35

  • practical utility: means that actual uses can be demonstrated. See 30 CFR 550.136
  • Predefined change: means any post-implementation modification to the use of a product that is provided for in the PSP (see §236. See 49 CFR 236.903
  • preference: means the total number of animal unit months on public lands apportioned and attached to base property owned or controlled by a permittee, lessee, or an applicant for a permit or lease. See 43 CFR 4100.0-5
  • Preliminary energy survey: means a procedure which may include, but is not limited to, an evaluation of energy cost savings and energy unit savings potential, building conditions, energy consuming equipment, and hours of use or occupancy, for the purpose of developing technical and price proposals prior to selection. See 30 CFR 56.19120
  • Pressure vessel: means a container capable of withstanding an internal maximum working pressure over 15 psig. See 46 CFR 197.204
  • Previous Condition: refers to the estimated risk inherent in the portion of the existing method of operation that is relevant to the change under analysis (including the elements of any existing signal or train control system relevant to the review of the product). See 49 CFR 236.903
  • Primarily eligible person: Any person who is entitled to interment or inurnment based on his or her service as specified in §553. See 32 CFR 553.1
  • Primary next of kin: (1) In the absence of a valid written document from the decedent identifying the primary next of kin, the order of precedence for designating a decedent's primary next of kin is as follows:

    (i) Spouse, even if a minor. See 32 CFR 553.1

  • Primary operating railroad: means the operating railroad that either owns or maintains the track through the highway-rail or pathway crossing, unless the crossing is located within a private company, port, or dock area. See 49 CFR 234.401
  • Principal: means the aggregate amount of all passenger security services fees due to be remitted to the Transportation Security Administration by an air carrier as required by this part. See 49 CFR 1510.3
  • Prior approval: means written or electronic approval by an authorized official evidencing prior consent. See 10 CFR 600.302
  • Privacy Act Coordinator: The NRO Information and Access Release Center Chief who serves as the NRO manager of the information review and release program instituted under the Privacy Act. See 32 CFR 326.3
  • Private entity: (1) This term means any entity other than a State, local government, Indian tribe, or foreign public entity. See 30 CFR 57.14206
  • Private maintenance: means the provision of proper care and humane treatment to excess wild horses and burros by qualified individuals under the terms and conditions specified in a Private Maintenance and Care Agreement. See 43 CFR 4700.0-5
  • Private nonprofit organization: means a secular or religious organization, no part of the net earnings of which may inure to the benefit of any member, founder, contributor, or individual. See 24 CFR 291.5
  • Process schedule: The thermal process and any specified critical factors for a given canned product required to achieve shelf stability. See 37 CFR 2.37
  • Process temperature: The minimum temperature(s) of the heating medium to be maintained as specified in the process schedule. See 37 CFR 2.37
  • Process time: The intended time(s) a container is to be exposed to the heating medium while the heating medium is at or above the process temperature(s). See 37 CFR 2.37
  • Processing authority: The person(s) or organization(s) having expert knowledge of thermal processing requirements for foods in hermetically sealed containers, having access to facilities for making such determinations, and designated by the establishment to perform certain functions as indicated in this part. See 37 CFR 2.37
  • Product: means any safety critical electronic locomotive control system, subsystem, or component, not including safety critical processor based signal and train control systems, whose functions are directly related to safe movement and stopping of the train as well as the associated man-machine interfaces irrespective of the location of the control system, subsystem, or component. See 49 CFR 229.305
  • product: as used in this part means "canned product. See 37 CFR 2.37
  • Product: means a processor-based signal or train control system, subsystem, or component. See 49 CFR 236.903
  • Production: means oil or gas removed from a well bore and any products derived therefrom. See 43 CFR 3170.3
  • Program: means the appropriate technology small grants program. See 41 CFR 101-26.803-4
  • Program: means the organized set of activities and allocation of resources directed toward a common purpose, objective, or goal undertaken or proposed by an agency in order to carry out the responsibilities assigned to it. See 30 CFR 57.3202
  • Program: means the Fisheries Finance Program, Financial Services Division, National Marine Fisheries Service, National Oceanic and Atmospheric Administration, U. See 50 CFR 253.10
  • Program Allocation: means the base allocation plus formula allocation for each State. See 41 CFR 101-26.507-4
  • Program employee: Any inspector or other individual employed by the Department or any cooperating agency who is authorized by the Secretary to do any work or perform any duty in connection with the Program. See 37 CFR 2.37
  • Program income: means gross income earned by the recipient that is directly generated by a supported activity or earned as a result of the award. See 10 CFR 600.302
  • Project: means an undertaking or a proposal for research in support of management of an interjurisdictional fishery resource or an interstate fishery management plan. See 50 CFR 253.50
  • Project: means a property consisting of site, improvements and, where permitted, equipment meeting the provisions of the applicable section of the Act, other applicable statutes and regulations, and terms, conditions and standards established by the Commissioner. See 24 CFR 200.3
  • Project costs: means all allowable costs, as set forth in the applicable Federal cost principles, incurred by a recipient and the value of the contributions made by third parties in accomplishing the objectives of the award during the project period. See 10 CFR 600.302
  • Project Sponsor: means any Person that assumes substantial responsibility for the development, financing, and structuring of an Eligible Project and, if not the Applicant, owns or controls, by itself and/or through individuals in common or affiliated business entities, a five percent or greater interest in the proposed Eligible Project, the Borrower or the Applicant. See 41 CFR 101-28.203
  • property: as used in this subpart shall be construed to include the individual dwelling unit and the undivided interest in the common areas and facilities as may be designated. See 24 CFR 206.131
  • Property: means real property and personal property (equipment, supplies, and intellectual property), unless otherwise stated. See 10 CFR 600.302

  • Provider agreement: means the document and any amendment or addenda to such agreement executed by the provider and FSA that sets forth the provider's responsibilities concerning the provider's operation or maintenance of a CFS. See 24 CFR 232.897
  • Psoriasis: A condition of the scalp or body characterized by irritation, itching, redness, and extreme excess shedding of dead epidermal cells. See 46 CFR 197.484
  • Public interest: means operations within a geothermal unit resulting in:

    (1) Diligent development. See 43 CFR 3280.2

  • Public lands: means any land and interest in land outside of Alaska owned by the United States and administered by the Secretary of the Interior through the Bureau of Land Management, except lands held for the benefit of Indians. See 43 CFR 4100.0-5
  • Public lands: means any lands or interests in lands administered by the Secretary of the Interior through the Bureau of Land Management. See 43 CFR 4700.0-5
  • Public lands: means any lands and interests in lands owned by the United States and administered by the Secretary of the Interior through BLM without regard to how the United States acquired ownership. See 43 CFR 6301.5
  • Public lands: means any lands the surface of which is administered by the Bureau of Land Management. See 43 CFR 8340.0-5
  • Public lands: means any lands and interests in lands owned by the United States and administered by the Secretary of the Interior through the Bureau of Land Management without regard to how the United States acquired ownership. See 43 CFR 8360.0-5
  • Public lands: means any lands and interest in lands owned by the United States within the several States and administered by the Secretary of the Interior through the Bureau of Land Management, without regard to how the United States acquired ownership, except:

  • public report of warning system malfunction at a highway-rail grade crossing: means a report that contains specific information regarding a warning system malfunction at a highway-rail grade crossing that is supplied to a railroad via the ENS by a member of the public who does not belong to one of the categories of individuals listed in the definition of Credible report of warning system malfunction or credible report of warning system malfunction at a highway-rail grade crossing in §234. See 49 CFR 234.301
  • PVHO: means pressure vessel for human occupancy but does not include pressure vessels for human occupancy that may be subjected to external pressures in excess of 15 psig but can only be subjected to maximum internal pressures of 15 psig or less (i. See 46 CFR 197.204
  • Qualified: means that a person has successfully completed all instruction, training, and examination programs required by the railroad and this subpart and that the person, therefore, has actual knowledge or may reasonably be expected to have knowledge of the subject on which the person is expected to be competent. See 49 CFR 218.93
  • Qualified auditor: means a person who is a qualified individual as defined in this section and has technical expertise obtained through education, training, or experience (or a combination thereof) necessary to perform the auditing function as required by §1. See 43 CFR 8365.1-1
  • Qualified blind trust: means a trust in which the interested party has a beneficial interest and which:

    (1) Is certified pursuant to §2634. See 20 CFR 10.508

  • Qualified diversified trust: means a trust in which the interested party has a beneficial interest and which:

    (1) Is certified pursuant to §2634. See 20 CFR 10.508

  • Qualified individual: means a person who has the education, training, or experience (or a combination thereof) necessary to perform an activity required under this subpart, and can read and understand the language of any records that the person must review in performing this activity. See 43 CFR 8365.1-1
  • Qualified trust: means a trust described in the Ethics in Government Act of 1978 and this part and certified by the Director under this subpart. See 20 CFR 10.508
  • Qualifying Attributes: means the requirements which must be met by a Non-Borrowing Spouse in order to be an Eligible Non-Borrowing Spouse. See 24 CFR 206.3
  • Qualifying conviction: Defined in 32 CFR part 103. See 32 CFR 105.3
  • Qualifying court order: means a court order acceptable for processing as defined in §838. See 14 CFR 302.722
  • Quality Assurance Division: The Quality Assurance Division at Memphis, Tennessee. See 7 CFR 27.2
  • RAM: means the Restricted Access Management division in the Alaska Regional Office of NMFS or the office that undertakes the duties of this division to issue or manage quota shares. See 50 CFR 253.10
  • Random sampling: A process of selecting a sample from a lot, or portion of production, whereby each unit in the lot of portion of production, has an equal chance of being chosen. See 7 CFR 70.36
  • Range improvement: means an authorized physical modification or treatment which is designed to improve production of forage. See 43 CFR 4100.0-5
  • Raw agricultural commodity: has the meaning given in section 201(r) of the Federal Food, Drug, and Cosmetic Act. See 43 CFR 8365.1-1
  • Re-victimization: A pattern wherein the victim of abuse or crime has a statistically higher tendency to be victimized again, either shortly thereafter or much later in adulthood in the case of abuse as a child. See 32 CFR 105.3
  • Real property: means land, including land improvements, structures and appurtenances thereto, but excludes movable machinery and equipment. See 10 CFR 600.302

  • Receiving facility: means a facility that is subject to subparts C and G of part 117 of this chapter, or subparts C and E of part 507 of this chapter, and that manufactures/processes a raw material or other ingredient that it receives from a supplier. See 43 CFR 8365.1-1
  • Recipient: A for-profit organization receiving an award directly from a DoD Component to carry out a project or program. See 32 CFR 34.2
  • Recipient: means any entity other than an individual that receives Recovery Act funds in the form of a grant, cooperative agreement or loan directly from the Federal Government. See 30 CFR 57.14209
  • Recognized accreditation body: means an accreditation body that FDA has determined meets the applicable requirements of this subpart and is authorized to accredit third-party certification bodies under this subpart. See 43 CFR 9180.1
  • Record: means any item, collection, or grouping of information about an individual that is maintained by the Department, including but not limited to the individual's education, financial transactions, medical history, and criminal or employment history and that contains his name, or an identifying number, symbol, or other identifying particular assigned to the individual, such as a finger or voice print or a photograph. See 45 CFR 5b.1
  • Record: Any item, collection, or grouping of information, whatever the storage media (e. See 32 CFR 320.2
  • Record: Any item, collection, or grouping of information about an individual that is maintained by the NRO, including, but not limited to, the individual's education, financial transactions, medical history, and criminal or employment history, and that contains the individual's name or identifying number (such as Social Security or employee number), symbol, or other identifying particular assigned to the individual, such as fingerprint, voice print, or photograph. See 32 CFR 326.3
  • Record: Any item, collection, or grouping of information about an individual that is maintained by an agency, including, but not limited to, the individual's education, financial transactions, medical history, and criminal or employment history and that contains his name, or the identifying number, symbol, or other identifying particular assigned to the individual, such as a finger or voice print or a photograph (As defined by 5 U. See 32 CFR 329.3
  • Recurring costs: means future costs that are incurred uniformly and annually over the study period. See 30 CFR 56.19094
  • Refinancing: means newer debt that either replaces older debt or reimburses applicants for previous expenditures. See 50 CFR 253.10
  • Refurbishing: means any reconstruction, reconditioning, or other improvement of existing vessels or facilities, but does not include routine repairs or activities characterized as maintenance. See 50 CFR 253.10
  • Regional entity: means an entity having enforcement authority under section 215(e)(4) of the Federal Power Act, 16 U. See 10 CFR 205.380
  • Regional supplemental guidance: Guidance to environmental program applicants prepared by the Regional Administrator, based on the national program guidance and specific regional and applicant circumstances, for use in preparing a grant application. See 40 CFR 35.102

  • Regular place of Federal employment: means the official duty station, or other place, where an employee actually and normally (i. See 31 CFR 215.2
  • Regulated airport: Any airport or portions of an airport in a quarantined State declared regulated in accordance with provisions in §301. See 24 CFR 200.70
  • Regulated area: Any quarantined State, or any portion thereof, designated as a regulated area in §301. See 24 CFR 200.193

  • Regulatory method: means the aggregate of all experimental procedures for measuring and confirming the presence of the marker residue of the sponsored compound in the target tissue of the target animal. See 46 CFR 308.524
  • Relevance: Limitation to only those elements of information that clearly bear of the determination(s) for which the records are intended. See 32 CFR 329.3
  • Remote control operator: means a locomotive engineer, as defined in §240. See 49 CFR 218.93
  • Remote control zone: means one or more tracks within defined limits designated in the timetable special instructions, or other railroad publication, within which remote control locomotives, under certain circumstances specified in this part, may be operated without an employee assigned to protect the pull-out end of the remote control movement, i.   • Renewable energy facility: means a single module or unit, or an aggregation of such units, that generates electric energy which is independently metered and which results from the utilization of a renewable energy source. See 41 CFR 101-26.607
  • Renewable energy source: means solar heat, solar light, wind, ocean, geothermal heat, and biomass, except for--

    (1) Heat from the burning of municipal solid waste. See 41 CFR 101-26.607

  • Renewable energy sources: means sunlight, wind, geothermal, biomass, solid wastes, or other such sources of energy. See 30 CFR 57.3202
  • Renewable energy system: means a system which when installed in connection with a dwelling--

    (1) Transmits or uses solar energy, energy derived from geothermal deposits, energy derived from biomass (or any other form of renewable energy which DOE subsequently specifies through an amendment of this part) for the purpose of heating or cooling such dwelling or providing hot water or electricity for use within such dwelling. See 41 CFR 101-26.507-4

  • Research: means work or investigative study, designed to acquire knowledge of fisheries resources and their habitat. See 50 CFR 253.50
  • Research: Basic, applied, and advanced research, as defined in this section. See 32 CFR 22.105
  • Research: Basic, applied, and advanced research activities. See 32 CFR 34.2
  • Reserve component: The Army Reserve, the Navy Reserve, the Marine Corps Reserve, the Air Force Reserve, the Coast Guard Reserve, the Army National Guard of the United States, and the Air National Guard of the United States. See 32 CFR 553.1
  • Residential Energy Expenditures: means the average annual cost of purchased residential energy, including the cost of renewable energy resources. See 41 CFR 101-26.507-4
  • Residue: means any compound present in edible tissues of the target animal which results from the use of the sponsored compound, including the sponsored compound, its metabolites, and any other substances formed in or on food because of the sponsored compound's use. See 46 CFR 308.524
  • Residue of carcinogenic concern: means all compounds in the total residue of a demonstrated carcinogen excluding any compounds judged by FDA not to present a carcinogenic risk. See 46 CFR 308.524
  • Responders: Includes first responders, who are generally composed of personnel in the following disciplines or positions: SARCs, SAPR VAs, healthcare personnel, law enforcement, and MCIOs. See 32 CFR 105.3
  • Response time: Within 20 business days of receiving your request, the FOIA Officer will tell you whether we have granted or denied it. See 32 CFR 552.100

  • return to work: as used in this subpart is not limited to returning to work at the employee's normal worksite or usual position, but may include returning to work at other locations and in other positions. See 20 CFR 10.505
  • Returned check: means a cash item returned by a paying bank, including an electronic returned check as defined in §229. See 30 CFR 1229.103
  • Reviewing Officer: means a BOEM employee assigned to review case files and assess civil penalties. See 30 CFR 550.1402
  • Revision control: means a chain of custody regimen designed to positively identify safety-critical components and spare equipment availability, including repair/replacement tracking. See 49 CFR 229.305
  • Revision control: means a chain of custody regimen designed to positively identify safety-critical components and spare equipment availability, including repair/replacement tracking in accordance with procedures outlined in the PSP. See 49 CFR 236.903
  • Risk: means the expected probability of occurrence for an individual accident event (probability) multiplied by the severity of the expected consequences associated with the accident (severity). See 49 CFR 236.903

  • Roadway maintenance activity: means any work limited to the duties prescribed for a roadway worker by definition in this section, including movement of on-track maintenance-of-way equipment other than locomotives. See 49 CFR 218.93
  • Roadway worker: means any employee of a railroad, or of a contractor to a railroad, whose duties include inspection, construction, maintenance or repair of railroad track, bridges, roadway, signal and communication systems, electric traction systems, roadway facilities or roadway maintenance machinery on or near track or with the potential of fouling a track, and flagmen and watchmen/lookouts as defined in §214.   • Safe Helpline: A crisis support service for members of the DoD community affected by sexual assault. See 32 CFR 105.3

  • Safety Analysis: refers to a formal set of documentation which describes in detail all of the safety aspects of the product, including but not limited to procedures for its development, installation, implementation, operation, maintenance, repair, inspection, testing, and modification, as well as analyses supporting its safety claims. See 49 CFR 229.305
  • Safety assessment: A set of guidelines and considerations post-sexual assault that the responsible personnel designated by the Installation Commander can follow to determine if a sexual assault survivor is likely to be in imminent danger of physical or psychological harm as a result of being victimized by or reporting sexual assault(s). See 32 CFR 105.3
  • Salary offset: means an administrative offset to collect a debt under 5 U. See 10 CFR 431.20
  • Salary offset: means a type of administrative offset to collect a debt under Section 5514 of Title 5 of the United States Code and 5 CFR part 550, subpart K by deduction(s) at one or more officially established pay intervals from the current pay account of an employee with or without his or her consent.   • SCUBA diving: means a diving mode in which the diver is supplied with a compressed breathing mixture from diver carried equipment. See 46 CFR 197.204
  • Seals: Those parts of a semirigid container and lid or of a flexible container that are fused together in order to hermetically close the container. See 37 CFR 2.37
  • Seborrheic dermatitis: A condition of the scalp or body characterized by irritation, itching, redness, and excess shedding of dead epidermal cells. See 46 CFR 197.484
  • Secondary victimization: The re-traumatization of the sexual assault, abuse, or rape victim. See 32 CFR 105.3
  • Secretary: The Secretary of Agriculture of the United States, or any officer or employee of the Department to whom authority has heretofore been delegated, or to whom authority may hereafter be delegated, to act in his stead. See 7 CFR 61.2
  • Secretary: means the Secretary of Commerce or his/her designee. See 50 CFR 253.50

  • Securitization position: means a covered position that is:

    (1) An on-balance sheet or off-balance sheet credit exposure (including credit-enhancing representations and warranties) that arises from a securitization (including a resecuritization). See 31 CFR 205.28

  • Security: means any non-withdrawable account, note, stock, treasury stock, bond, debenture, evidence of indebtedness, certificate of interest or participation in any profit-sharing agreement, collateral-trust certificate, preorganization or subscription, transferable share, investment contract, voting trust certificate or, in general, any interest or instrument commonly known as a security, or any certificate of interest or participation in, temporary or interim certificate for, receipt for, guarantee of, or warrant or right to subscribe to or purchase any of the foregoing, except that a security shall not include an account insured, in whole or in part, by the Federal Deposit Insurance Corporation. See 32 CFR 552.66
  • Security threat assessment: means the threat assessment for which the applicant has applied, as described in 49 CFR 1515. See 49 CFR 1515.3
  • Self-assessment: means an evaluation conducted by a recognized accreditation body or by an accredited third-party certification body of its competency and capacity under the applicable requirements of this subpart for the defined scope of recognition or accreditation. See 43 CFR 9180.1
  • sell: includes every contract to sell or otherwise dispose of a security or interest in a security for value. See 32 CFR 552.66
  • Sender: means any of the following entities that sends an item to a Reserve Bank for forward collection--

    (1) A depository institution, as defined in section 19(b) of the Federal Reserve Act (12 U. See 30 CFR 1229.103

  • Separated employee: means a former employee or Member who has been separated from the service but who has not met all the requirements for retirement under FERS or who has not filed an application for retirement under FERS. See 14 CFR 302.24
  • Service: The Food Safety and Inspection Service of the Department. See 37 CFR 1.1045
  • Service: The Agricultural Marketing Service of the U. See 7 CFR 28.2
  • Service area: means the area that can be properly grazed by livestock watering at a certain water. See 43 CFR 4100.0-5
  • Service license: means the document and any amendment to such document, issued under the Act by DACO to individuals certified competent by the licensed warehouse operator to perform inspection, sampling, grading classifying, or weighing services according to established standards and procedures, set forth in §735. See 24 CFR 232.897
  • Service member: Defined in 32 CFR part 103. See 32 CFR 105.3
  • Services: means intangible economic output, including, but not limited to--

    (1) business, repair, and amusement services,

    (2) management, legal, engineering, architectural, and other professional services, and

    (3) financial, insurance, transportation, informational and any other data-based services, and communication services. See 41 CFR 101-28.306-3

  • Services: means the provision of administrative assistance or something of benefit to the public. See 30 CFR 57.3202
  • Sexual assault: Intentional sexual contact characterized by the use of force, threats, intimidation, or abuse of authority or when the victim does not or cannot consent. See 32 CFR 105.3
  • Shelter: means a dwelling unit or units whose principal purpose is to house on a temporary basis individuals who may or may not be related to one another and who are not living in nursing homes, prisons, or similar institutional care facilities. See 41 CFR 101-26.507-4
  • Shipper: means the owner or exporter of the article of food who consigns and ships the article from a foreign country or the person who sends an article of food by international mail or express consignment operators or carriers or other private delivery service to the United States. See 21 CFR 1.276
  • Short position: means a transaction in which a bank holding company has borrowed or otherwise obtained a security from a counterparty and sold that security, and the bank holding company must return the security to the initial counterparty in the future. See 31 CFR 210.10
  • Siding: means an auxiliary track, adjacent and connected to a main track, used for meeting or passing trains. See 49 CFR 218.93
  • Signaled siding: means a siding within traffic control system (TCS) territory or within interlocking limits where a signal indication authorizes the siding's use. See 49 CFR 218.93
  • Single sampling: A sampling scheme where the decision to accept or reject an inspection lot with respect to a specified requirement is made after the inspection of a single sample. See 7 CFR 70.36
  • Siting authority: means a State government, local government, or instrumentality of a State government or local government, including any official or organizational unit thereof, whose authorization is necessary prior to the deployment of personal wireless service facilities. See 47 CFR 1.6002
  • Small business concern: means a small business as defined at section 2 of Pub. See 10 CFR 600.302
  • Smoking: means the use of a tobacco product, electronic cigarettes whether or not they are a tobacco product, or similar products that produce a smoke, mist, vapor, or aerosol, with the exception of products (other than electronic cigarettes) which meet the definition of a medical device in section 201(h) of the Federal Food, Drug and Cosmetic Act, such as nebulizers. See 43 CFR 3453.3-1
  • Soil: That part of the upper layer of earth in which plants can grow. See 24 CFR 200.193

  • Solicitation: means an announcement that DOE is accepting Applications that is widely disseminated to the public on the DOE Web site or otherwise, and which satisfies the requirements of §609. See 41 CFR 101-28.203
  • solo flight: as used in this subpart means that flight time during which a student pilot is the sole occupant of the aircraft or that flight time during which the student performs the duties of a pilot in command of a gas balloon or an airship requiring more than one pilot flight crewmember. See 33 CFR 165.902
  • Sovereign debt position: means a direct exposure to a sovereign entity. See 31 CFR 205.28
  • Specific risk: means the risk of loss on a position that could result from factors other than broad market movements and includes event risk, default risk, and idiosyncratic risk. See 31 CFR 205.28
  • Sponsor: means the person or organization proposing or holding an approval by FDA for the use of a sponsored compound. See 46 CFR 308.524
  • Sponsored compound: means any drug or food additive or color additive proposed for use, or used, in food-producing animals or in their feed. See 46 CFR 308.524
  • Spouse: A person who is legally married to another person. See 32 CFR 553.1
  • Spray force: means the amount of force exerted onto the spray disc, measured in ounce-force (ozf). See 30 CFR 56.9330
  • Standard Federal regions: means the 10 standard Federal regions established by Office of Management and Budget Circular A-105, entitled "Standard Federal Regions. See 41 CFR 101-26.803-4
  • Standby diver: means a diver at the dive location available to assist a diver in the water. See 46 CFR 197.204
  • State: includes any of the individual entities comprising the United States. See 43 CFR 3507.20
  • State: means each of the several states, the District of Columbia, the Commonwealth of Puerto Rico, American Samoa, the Virgin Islands, Guam, or the Commonwealth of the Northern Mariana Islands. See 50 CFR 253.50

  • State: Any State, territory, or district of the United States, including Puerto Rico. See 24 CFR 200.70
  • State: means the District of Columbia, Puerto Rico, and any of the States, Commonwealths, territories, and possessions of the United States. See 41 CFR 101-26.607
  • State agency: means any department, agency, commission, or official of a state authorized under the laws of the State to regulate commercial fisheries or enforce laws relating to commercial fisheries. See 50 CFR 253.50
  • State capital crime: Under State law, the willful, deliberate, or premeditated unlawful killing of another human being for which a sentence of imprisonment for life or the death penalty may be imposed. See 32 CFR 553.1
  • State Director: means the State Director, Bureau of Land Management, or his or her authorized representative. See 43 CFR 4100.0-5
  • State income tax: means any form of tax for which, under a State status:

    (1) Collection is provided, either by imposing on employers generally the duty of withholding sums from the compensation of employees and making returns of such sums to the State or by granting to employers generally the authority to withhold sums from the compensation of employees, if any employee voluntarily elects to have such sums withheld. See 31 CFR 215.2

  • State Plant Regulatory Official: The authorized official of a State who has responsibility for the operation of the State plant regulatory program. See 24 CFR 200.70
  • State savings association: includes any underwriter participating in the distribution of securities of a State savings association. See 32 CFR 552.66
  • Statement packaging: includes receiving statement information from members or eligible institutions or their service bureaus on respective customer cycle dates. See 30 CFR 550.227
  • Statute: means Subtitle VII of Title 49 of the United States Code (Transportation). See 43 CFR 3507.11
  • Statute: means Subtitle VII of Title 49 of the United States Code (Transportation). See 43 CFR 3507.20
  • Statute: when used in this chapter means Subtitle VII of Title 49 of the United States Code (Transportation). See 43 CFR 3486.4
  • Storage services: includes filing, storage, and truncation of items. See 30 CFR 550.227
  • Structure: means a pole, tower, base station, or other building, whether or not it has an existing antenna facility, that is used or to be used for the provision of personal wireless service (whether on its own or comingled with other types of services). See 47 CFR 1.6002
  • Study period: means the time period covered by a life cycle cost analysis. See 30 CFR 56.19094
  • Subaward: An award of financial assistance in the form of money, or property in lieu of money, made under a DoD grant or cooperative agreement by a recipient to an eligible subrecipient. See 32 CFR 22.105
  • Subaward: means financial assistance in the form of money, or property in lieu of money, provided under an award by a recipient to an eligible subrecipient or by a subrecipient to a lower tier subrecipient. See 10 CFR 600.302
  • Subaward: Financial assistance in the form of money, or property in lieu of money, provided under an award by a recipient to an eligible subrecipient or by a subrecipient to a lower tier subrecipient. See 32 CFR 34.2
  • Subgrantee: means an entity managing a weatherization project which receives a grant of funds awarded under this part from a grantee. See 41 CFR 101-26.507-4
  • Subject individual: means that individual to whom a record pertains. See 45 CFR 5b.1
  • Subpart A: Subpart A of this part describes the purpose and scope of the provisions in this part and defined terms used in this part. See 29 CFR 4219.1
  • Subpart C: Subpart C establishes the interest rate to be charged on overdue, defaulted and overpaid withdrawal liability under section 4219(c)(6) of ERISA, and authorizes multiemployer plans to adopt alternative rules concerning assessment of interest and related matters. See 29 CFR 4219.1
  • Subrecipient: means the legal entity to which a subaward is made and which is accountable to the recipient for the use of the funds or property provided. See 10 CFR 600.302
  • Subrecipient: The legal entity to which a subaward is made and which is accountable to the recipient for the use of the funds provided. See 32 CFR 34.2
  • Subsequently recovered remains: Additional remains belonging to the decedent that are recovered or identified after the decedent's interment or inurnment. See 32 CFR 553.1
  • Subsequently remarried spouse: A derivatively eligible spouse who was married to the primarily eligible person at the time of the primarily eligible person's death and who subsequently remarried another person. See 32 CFR 553.1
  • Substantial Evidence: means such relevant evidence as a reasonable person might accept as adequate to support a conclusion. See 49 CFR 1515.3
  • substantial financial and legal commitments: is a relative one, and the determination whether such commitments have been made, so as to qualify a person for an exchange under this subpart, will be made on a case-by-case basis. See 43 CFR 3436.0-5
  • Subsystem: means a defined portion of a system. See 49 CFR 229.305
  • Subsystem: means a defined portion of a system. See 49 CFR 236.903
  • Sugarcane disease: This means leaf scald disease with respect to activities in Hawaii, and means gummosis disease or leaf scald disease with respect to activities in Puerto Rico. See 24 CFR 203.35
  • Sunk costs: means costs incurred prior to the time at which the life cycle cost analysis occurs. See 30 CFR 56.19094
  • Supervisor of cottonseed inspection: An officer of the Division designated as such by the Director. See 7 CFR 61.2
  • Supplement: means any data and information that you submit regarding a filed GRAS notice after we respond to your notice by letter in accordance with §570. See 47 CFR 1.749
  • Supplemental feed: means a feed which supplements the forage available from the public lands and is provided to improve livestock nutrition or rangeland management. See 43 CFR 4100.0-5
  • Supplies: means tangible, expendable personal property that is charged directly to the award and that has a useful life of less than one year or an acquisition cost of less than $5,000 per unit. See 10 CFR 600.302
  • Support: means financial support or award under the program by grants, cooperative agreements or contracts. See 41 CFR 101-26.803-4
  • support: includes food, shelter, clothing, ordinary medical expenses, and other ordinary and customary items for the maintenance of the person supported. See 20 CFR 725.233
  • Support Office Director: means the Director of the DOE Field Support Office with the responsibility for grant administration or any official to whom that function may be redelegated by the Assistant Secretary. See 41 CFR 101-26.507-4
  • Suppressive area: That portion of a regulated area where eradication of infestation is undertaken as an objective, as designated under §301. See 24 CFR 203.22
  • Suppressive area: That part of a regulated area where eradication of infestation is undertaken as an objective, as designated by the Deputy Administrator under §301. See 24 CFR 200.80
  • Surface-supplied air diving: means a diving mode in which the diver is supplied from the dive location or bell with compressed breathing air including oxygen or oxygen enriched air if supplied for treatment. See 46 CFR 197.204
  • Survivor: means a person entitled to benefits under part 843 or 846 of this chapter based on the death of an employee, separated employee, retiree, or survivor. See 14 CFR 302.24
  • Survivor: means a person receiving a current spouse annuity or a former spouse annuity, or the beneficiary of an insurable interest annuity. See 14 CFR 302.714
  • Suspension: means the withholding from active use, through a decision issued by the authorized officer or by agreement, of part or all of the grazing preference specified in a grazing permit or lease. See 43 CFR 4100.0-5
  • Suspension: means an action by DOE that temporarily withdraws Federal sponsorship under an award, pending corrective action by the recipient or pending a decision to terminate the award by DOE. See 10 CFR 600.302
  • Switching or humping operations: includes the classification of placarded railroad cars according to commodity or destination, assembling of placarded cars for train movements, changing the position of placarded cars for purposes of loading, unloading, or weighing, and the placing of placarded cars for repair. See 49 CFR 228.101
  • Switchtender: means a qualified employee assigned to handle switches at a specific location. See 49 CFR 218.93
  • System: refers to any electronic locomotive control system and includes all subsystems and components thereof, as the context requires. See 49 CFR 229.305
  • System: refers to a signal or train control system and includes all subsystems and components thereof, as the context requires. See 49 CFR 236.903
  • System Manager: The official who is responsible for managing a SOR, including policies and procedures to operate and safeguard it. See 32 CFR 329.3
  • System managers: Officials who have overall responsibility for a Privacy Act system of records. See 32 CFR 326.3
  • System notice: The official public notice published in the 32 CFR 326.3
  • System of records: means any group of records under the control of the Department from which a record is retrieved by personal identifier such as the name of the individual, number, symbol or other unique retriever assigned to the individual. See 45 CFR 5b.1
  • System of records: A group of records under the control of NGA from which personal information is retrieved by the individual's name or by some identifying number, symbol, or other identifying particular assigned to the individual. See 32 CFR 320.2
  • System of records: A group of any records under the control of the NRO from which information is retrieved by the name of an individual or by some identifying number, symbol, or other identifying particular assigned to that individual. See 32 CFR 326.3
  • System Safety Precedence: means the order of precedence in which methods used to eliminate or control identified hazards within a system are implemented. See 49 CFR 236.903
  • Systemic indicator: includes the following indicators included on the FR Y-15:

    (1) Total exposures. See 31 CFR 210.10

  • Target tissue: means the edible tissue selected to monitor for residues in the target animals, including, where appropriate, milk or eggs. See 46 CFR 308.524
  • Tax refund offset: means withholding or reducing a tax refund payment by an amount necessary to satisfy a debt owed to the United States by the payee(s) of a tax refund payment. See 45 CFR 31.2
  • Tax refund offset: means the reduction by the IRS of a tax overpayment payable to a taxpayer by the amount of past-due, legally enforceable debt owed by that taxpayer to a Federal agency pursuant to Treasury regulations. See 29 CFR 4903.1
  • Tax refund payment: means any overpayment of Federal taxes to be refunded to the person making the overpayment after the IRS makes the appropriate credits as provided in 26 U. See 45 CFR 31.2
  • Taxpayer identifying number: means the identifying number described under section 6109 of the Internal Revenue Code of 1986 (26 U. See 45 CFR 31.2
  • Temporary crossing: means a highway-rail or pathway crossing created to serve a specific activity for a temporary time period not to exceed six months. See 49 CFR 234.401
  • Temporary nonuse: means that portion of active use that the authorized officer authorizes not to be used, in response to an application made by the permittee or lessee. See 43 CFR 4100.0-5
  • Term Sheet: means a written offer for the issuance of a loan guarantee, executed by the Secretary (or a DOE official authorized by the Secretary to execute such offer), delivered to the offeree, that sets forth the detailed terms and conditions under which DOE and the Applicant will execute a Loan Guarantee Agreement. See 41 CFR 101-28.203
  • Termination: means permanent withdrawal of the authority to obligate previously-awarded grant funds before that authority would otherwise expire. See 32 CFR 33.3
  • Termination: means the cancellation of an award, in whole or in part, under an agreement at any time prior to either:

    (1) The date on which all work under an award is completed. See 10 CFR 600.302

  • Test animals: means the species selected for use in the toxicity tests. See 46 CFR 308.524
  • Test facility: means a track that is not part of the general railroad system of transportation and is being used exclusively for the purpose of testing equipment and has all of its public grade crossings protected. See 49 CFR 229.305
  • Thermal process: The heat treatment necessary to achieve shelf stability as determined by the establishment's processing authority. See 37 CFR 2.37
  • Third party: means any person or entity except a director, officer, employee or agent of either:

    (1) A Bank in possession of any particular confidential regulatory information. See 30 CFR 550.243

  • Third party in-kind contributions: means the value of non-cash contributions provided by non-Federal third parties. See 10 CFR 600.302
  • Third-party telephone service: means a service that receives telephonic reports of unsafe conditions at highway-rail and pathway grade crossings on behalf of a railroad. See 49 CFR 234.301
  • Threshold assessment: means FDA's review of data and information about a sponsored compound to determine whether chronic bioassays in test animals are necessary to resolve questions concerning the carcinogenicity of the compound. See 46 CFR 308.524
  • Ticket agent: has the meaning ascribed to it in 49 U. See 43 CFR 3471.3-1
  • Ticket agent: has the meaning ascribed to it in 49 U. See 43 CFR 3472.1-3
  • Timekeeping device: means a device for measuring the time of a dive in minutes. See 46 CFR 197.204
  • Timeliness: Sufficiently current to ensure that any determination based on the record will be accurate and fair. See 32 CFR 329.3
  • Toilet: means a chemical toilet, a recirculating toilet, a combustion toilet, or a toilet that is flushed with water. See 49 CFR 228.307
  • Toilet room: means a room containing a toilet. See 49 CFR 228.307
  • TOTAL: is an acronym that stands for "Technology Open to Approved Lenders. See 24 CFR 203.251
  • Total exposures: means total exposures as reported by the bank holding company on the FR Y-15. See 31 CFR 210.10
  • Total Program Allocations: means the annual appropriation less funds reserved for training and technical assistance. See 41 CFR 101-26.507-4
  • Toxic material: means a material in concentration or amount of such toxicity as to constitute a recognized hazard that is causing or is likely to cause death or serious physical harm. See 49 CFR 228.307
  • Trading position: means a position that is held by the Board-regulated institution for the purpose of short-term resale or with the intent of benefiting from actual or expected short-term price movements, or to lock in arbitrage profits. See 31 CFR 205.28
  • Transportation of items: includes transporting items from Federal Reserve offices, other Banks' clearinghouse associations, depository institutions, and other direct sending entities to a Bank. See 30 CFR 550.227
  • Transporter: means a person who has possession, custody, or control of an article of food in the United States for the sole purpose of transporting the food, whether by road, rail, water, or air. See 21 CFR 1.328
  • Trauma informed care: An approach to engage people with histories of trauma that recognizes the presence of trauma symptoms and acknowledges the role that trauma has played in their lives. See 32 CFR 105.3
  • Treatment Manual: The provisions currently contained in the "Manual of Administratively Authorized Procedures to be Used Under the Witchweed Quarantine" and the "Fumigation Procedures Manual" and any amendments thereto. See 24 CFR 200.193
  • Tribal Organization: means the recognized governing body of any Indian tribe or any legally established organization of Native Americans which is controlled, sanctioned, or chartered by such governing body. See 41 CFR 101-26.507-4
  • Tribe: has the meaning provided for the term "Indian tribe" in section 102 of the Housing and Community Development Act of 1974 (42 U. See 24 CFR 291.5
  • TSA Final Decision Maker: means the Administrator, acting in the capacity of the decision maker on appeal, or any person to whom the Administrator has delegated the Administrator's decision-making authority. See 49 CFR 1515.3
  • Two-way market: means a market where there are independent bona fide offers to buy and sell so that a price reasonably related to the last sales price or current bona fide competitive bid and offer quotations can be determined within one day and settled at that price within a relatively short time frame conforming to trade custom. See 31 CFR 205.28
  • Umbilical: means the hose bundle between a dive location and a diver or bell, or between a diver and a bell, that supplies the diver or bell with a life-line, breathing gas, communications, power, and heat as appropriate to the diving mode or conditions. See 46 CFR 197.204
  • Under Secretary: means the Under Secretary of the Department of Energy. See 30 CFR 57.3202
  • underpayment: includes a payment in an amount less than the amount of the benefit due for such month, and nonpayment where some amount of such benefits is payable. See 20 CFR 725.545
  • Underwriter: means any person who has purchased from an issuer with a view to, or offers or sells for an issuer in connection with, the distribution of any security, or participates or has a participation in the direct or indirect underwriting of any such undertaking. See 32 CFR 552.66
  • Underwritten transactions in debt and equity markets: means total underwriting activity as reported by the bank holding company on the FR Y-15. See 31 CFR 210.10
  • Unit: means the land within a unit area as defined in 43 CFR 3180. See 43 CFR 3170.3
  • Unit agreement: means an agreement for the exploration, development, production, and utilization of separately owned interests in the geothermal resources made subject thereto as a single consolidated unit without regard to separate ownerships, which provides for the allocation of costs and benefits on a basis defined in the agreement or plan. See 43 CFR 3280.2
  • Unit area: means the area described in a unit agreement as constituting the land logically subject to development under such agreement. See 43 CFR 3280.2
  • Unit contraction provision: means a term of a unit agreement providing that the boundaries of the unit area will contract to the size of the participating area, by having those lands outside of the participating area removed. See 43 CFR 3280.2
  • Unit of General Purpose Local Government: means any city, county, town, parish, village, or other general purpose political subdivision of a State. See 41 CFR 101-26.507-4
  • Unit operator: means the person, association, partnership, corporation, or other business entity designated under a unit agreement to conduct operations on unitized land as specified in such agreement. See 43 CFR 3280.2
  • Unit PA: means the unit participating area, if one is in effect, the exploratory unit if there is no associated participating area, or an enhanced recovery unit. See 43 CFR 3170.3
  • Unit well: means a well that is:

    (1) Designed to produce or utilize geothermal resources in commercial quantities. See 43 CFR 3280.2

  • United States: includes the several States, the District of Columbia, and the several territories and possessions of the United States. See 43 CFR 3507.20
  • United States: means the several States, the District of Columbia, the Commonwealth of Puerto Rico, the Virgin Islands, Guam, American Samoa and any territory or possession of the United States of America. See 41 CFR 101-28.203
  • United States: means the fifty States of the United States, the District of Columbia, the Commonwealth of Puerto Rico, the Virgin Islands, American Samoa, Guam, the Commonwealth of the Northern Mariana Islands, and the Trust Territory of the Pacific Islands. See 41 CFR 101-28.306-3

  • Unrestricted reporting: Defined in 32 CFR part 103. See 32 CFR 105.3
  • Unsecured wholesale funding: has the meaning set forth in 12 CFR 249. See 31 CFR 210.10
  • unusual circumstances: means our need to:

    (1) Search for and get the requested records from field offices or other locations;

    (2) Search for, get, and review many records identified in a single request;

    (3) Consult with another Federal agency having a substantial interest in the request; or

    (4) Consult with two or more FCA offices having a substantial interest in the request. See 32 CFR 552.100

  • Upland Cotton: All cotton grown anywhere within the continental United States including the growths sometimes referred to as Upland, Gulf, and Texas cotton, but excluding American Pima growths. See 7 CFR 28.2
  • Useful life: means the period during which project property will, as determined by the Program, remain economically productive. See 50 CFR 253.10
  • User: The person or agency at whose request inspection is conducted. See 7 CFR 70.36
  • User: means a person that uses a provider's CFS. See 24 CFR 232.897
  • Utilization: means the portion of forage that has been consumed by livestock, wild horses and burros, wildlife and insects during a specified period. See 43 CFR 4100.0-5
  • Valid occupancy: means an occupancy under a current permit, lease, or other written authorization from BLM to occupy public lands. See 43 CFR 6301.5
  • Validation: means the process of determining whether a product's design requirements fulfill its intended design objectives during its development and life-cycle. See 49 CFR 236.903
  • Value: means the monetary worth of fishery resources used in developing the apportionment formula, which is equal to the price paid at the first point of landing. See 50 CFR 253.50
  • Variance: means the difference between actual consumption and goal. See 30 CFR 57.3202
  • Vehicle: means any motorized transportation conveyance designed and licensed for use on roadways, such as an automobile, bus, or truck, and any motorized conveyance originally equipped with safety belts. See 43 CFR 8360.0-5
  • Venting: The removal of air from a retort before the start of process timing. See 37 CFR 2.37
  • Verification: means the process of determining whether the results of a given phase of the development cycle fulfill the validated requirements established at the start of that phase. See 49 CFR 236.903
  • Vessel: means any waterborne craft including mobile offshore drilling units required to have a Certificate of Inspection issued by the Coast Guard or any waterborne craft connected with a deepwater port or within the deepwater port safety zone, or any waterborne craft engaged in activities related to the Outer Continental Shelf. See 46 CFR 197.204
  • Vessel: means any vessel documented under U. See 50 CFR 253.10
  • Veteran: A person who served in the U. See 32 CFR 553.1
  • Vetting official: means the USAID employee identified in the application or award as having responsibility for receiving vetting information, responding to questions about information to be included on the Partner Information Form, coordinating with the USAID Office of Security (SEC), and conveying the vetting determination to each applicant, potential subrecipients and contractors subject to vetting, and the agreement officer. See 30 CFR 57.19027
  • Victim: Defined in 32 CFR part 103. See 32 CFR 105.3
  • Violation: means failure to comply with the Outer Continental Shelf Lands Act (OCSLA) or any other applicable laws, with any regulations issued under the OCSLA, or with the terms or provisions of leases, licenses, permits, rights-of-way, or other approvals issued under the OCSLA. See 30 CFR 550.1402
  • Violation: means any non-conformance with the CARS Act or the regulations in this part except §599. See 49 CFR 599.500
  • Violator: means a person responsible for a violation. See 30 CFR 550.1402
  • Volume: means the weight of the fishery resource as landed, at the first point of landing. See 50 CFR 253.50
  • Volume tank: means a pressure vessel connected to the outlet of a compressor and used as an air reservoir. See 46 CFR 197.204
  • Waiver: means the cancellation, remission, forgiveness, or non-recovery of a debt allegedly owed by an employee to OPM or another agency as permitted or required by 5 U. See 10 CFR 431.20
  • Waiver: means an annuitant's written request to forfeit a specified amount of annuity as described in this subpart. See 14 CFR 302.722
  • Warehouse: means a structure or other authorized storage facility, as determined by DACO, in which any agricultural product may be stored or handled for the purpose of interstate or foreign commerce. See 24 CFR 232.897
  • Warehouse operator: means a person lawfully engaged in the business of storing or handling agricultural products. See 24 CFR 232.897
  • Warehousing activities and practices: means any legal, operational, managerial or financial duty that a warehouse operator has regarding an agricultural product. See 24 CFR 232.897
  • Warning system failure at a pathway grade crossing: means failure of an active pathway grade crossing warning system to perform as intended. See 49 CFR 234.301
  • Wart remover drug product: A topical agent used for the removal of common or plantar warts. See 46 CFR 197.404
  • Water activity: The ratio of the water vapor pressure of the product to the vapor pressure of pure water at the same temperature. See 37 CFR 2.37
  • Watering: means the act of filling potable water systems. See 49 CFR 228.307
  • Weatherization Project: means a project conducted in a single geographical area which undertakes to weatherize dwelling units that are energy inefficient. See 41 CFR 101-26.507-4
  • Wheelchair: means a device that is designed solely for use by a mobility-impaired person for locomotion, and that is suitable for use in an indoor pedestrian area. See 43 CFR 6301.5
  • Wild horses and burros: means all unbranded and unclaimed horses and burros that use public lands as all or part of their habitat, that have been removed from these lands by the authorized officer, or that have been born of wild horses or burros in authorized BLM facilities, but have not lost their status under section 3 of the Act. See 43 CFR 4700.0-5
  • Witchweed: Parasitic plants of the genus Striga and reproductive parts thereof, including seeds. See 24 CFR 200.193
  • Work plan commitments: The outputs and outcomes associated with each work plan component, as established in the grant agreement. See 40 CFR 35.102
  • Work plan component: A negotiated set or group of work plan commitments established in the grant agreement. See 40 CFR 35.102
  • Working day: means any weekday excepting Federal holidays. See 29 CFR 4901.2
  • Working day: means any day from Monday through Friday, excluding Federal holidays. See 21 CFR 1.377
  • Working days: Days when the NRO is operating and specifically excludes Saturdays, Sundays, and legal public holidays. See 32 CFR 326.3
  • Working interest: means the interest held in geothermal resources or in lands containing the same by virtue of a lease, operating agreement, fee title, or otherwise, under which, except as otherwise provided in a unit agreement, the owner of such interest is vested with the right to explore for, develop, produce, and utilize such resources.   • Working pressure: means the pressure to which a pressure containment device is exposed at any particular instant during normal operating conditions. See 46 CFR 197.204
  • You: means a person who is subject to some or all of the requirements in this subpart. See 43 CFR 8365.1-1
  • You: means the person submitting the prior notice, i. See 21 CFR 1.276
