  • ABC: means American Baptist Churches v. See 27 CFR 44.105
  • Act: means the FSA approved August 9, 1939 (53 Stat. See 7 CFR 201.2
  • Act: means the "Privacy Act of 1974, as amended (5 U. See 37 CFR 102.22
  • Activity: means a discrete undertaking within a project to be carried out by a recipient, directly or through a subrecipient, that is specified in an agreement and is intended to fulfill a specific objective of the agreement. See 31 CFR 380.1
  • Advance procurement: means an exception to the full funding policy that allows acquisition of long lead time items (advance long lead acquisition) or economic order quantities (EOQ) of items (advance EOQ acquisition) in a fiscal year in advance of that in which the related end item is to be acquired. See 48 CFR 217.103
  • Agreement: means a legally binding grant or cooperative agreement entered into between CCC and a recipient to implement a project under the FFPr Program. See 31 CFR 380.1
  • agricultural seeds: means the following kinds of grass, forage, and field crop seeds, that are used for seeding purposes in the United States:

  • Annual Statement: is a statement identified in 17 U. See 37 CFR 210.12
  • Appeal: means a request by an individual to review and reverse an initial denial of a request by that individual for correction or amendment. See 37 CFR 102.22
  • Assisted acquisition: means the type of interagency contracting through which acquisition officials of a non-DoD agency award a contract or a task or delivery order for the acquisition of supplies or services on behalf of DoD. See 48 CFR 217.701
  • Borrower: means a mortgagor who is an original borrower under the HECM Loan Agreement and Note. See 24 CFR 206.3
  • CCC: means the Commodity Credit Corporation, an agency and instrumentality of the United States within USDA, and includes any official of the United States delegated the responsibility to act on behalf of CCC. See 31 CFR 380.1
  • CCC-provided funds: means U. See 31 CFR 380.1
  • collection procedures: as used in this subpart , includes that series of more intensive efforts, including litigation as described in §674. See 34 CFR 674.45
  • Commissioner: means the Federal Housing Commissioner or the Commissioner's authorized representative. See 24 CFR 206.3
  • compulsory licensee: is a person or entity exercising the compulsory license to make and distribute phonorecords of nondramatic musical works as provided under 17 U. See 37 CFR 210.12
  • Contract action: means an action which results in a contract. See 48 CFR 217.7401
  • Cost sharing or matching: means the portion of project expenses, or necessary goods and services provided to carry out a project, not paid or acquired with Federal funds. See 31 CFR 380.1
  • declaration: means a written statement of a grower, shipper, processor, dealer, or importer giving for any lot of seed the kind, variety, type, origin, or the use for which the seed is intended. See 7 CFR 201.2
  • declaration of origin: means a declaration of a grower or country shipper in the United States stating for each lot of agricultural seed (1) kind of seed, (2) lot number or other identification, (3) State where seed was grown and the county where grown if to be labeled showing the origin as a portion of a State, (4) quantity of seed, (5) date shipped or delivered, (6) to whom sold, shipped, or delivered, and (7) the signature and address of the grower or country shipper issuing the declaration. See 7 CFR 201.2
  • Definitization: means the agreement on, or determination of, contract terms, specifications, and price, which converts the undefinitized contract action to a definitive contract. See 48 CFR 217.7401
  • digital phonorecord delivery: means each individual delivery of a phonorecord by digital transmission of a sound recording that results in a specifically identifiable reproduction by or for any transmission recipient of a phonorecord of that sound recording, regardless of whether the digital transmission is also a public performance of the sound recording or any musical work embodied therein. See 37 CFR 210.12
  • Direct acquisition: means the type of interagency contracting through which DoD orders a supply or service from a Governmentwide acquisition contract maintained by a non-DoD agency. See 48 CFR 217.701
  • disposal agency: as used in this part refers to GSA. See 41 CFR 102-75.5
  • domestic manufacture: as used in this subpart , are defined in the clause at 252. See 48 CFR 225.7101
  • Donated commodities: means the commodities donated by CCC to a recipient under an agreement. See 31 CFR 380.1
  • Eligible Non-Borrowing Spouse: means a Non-Borrowing Spouse who meets all Qualifying Attributes for a Deferral Period. See 24 CFR 206.3
  • FAS: means the Foreign Agricultural Service of the United States Department of Agriculture. See 31 CFR 380.1
  • FFPr Program: means the Food for Progress Program. See 31 CFR 380.1
  • Filed an application for asylum: means the proper filing of a principal asylum application or filing a derivative asylum application by being properly included as a dependent spouse or child in an asylum application pursuant to the regulations and procedures in effect at the time of filing the principal or derivative asylum application. See 27 CFR 44.105
  • FOIA Officer: means the USPTO employee designated to administer FOIA for USPTO. See 37 CFR 102.1
  • GAAP: means U. See 37 CFR 210.12
  • General rule: To be eligible for an award under this subpart, an applicant must have been named as a party to the adjudicatory proceeding and show that it meets all other conditions of eligibility set forth in paragraphs (b) and (c) of this section. See 31 CFR 380.0
  • grower: means any person who produces directly or through a growing contract, or is a seed-crop sharer in seed which is sold, offered for sale, transported, or offered for transportation. See 7 CFR 201.2
  • Hand or measuring tools: means those tools listed in Federal supply classifications 51 and 52, respectively. See 48 CFR 225.7001
  • HECM: means a Home Equity Conversion Mortgage. See 24 CFR 206.3
  • IIRIRA: means the Illegal Immigration Reform and Immigrant Responsibility Act of 1996, enacted as Pub. See 27 CFR 44.105
  • Inquiry: means either a request for general information regarding the Act and this subpart or a request by an individual (or that individual's parent or guardian) that USPTO determine whether it has any record in a system of records which pertains to that individual. See 37 CFR 102.22
  • lot of seed: means a definite quantity of seed identified by a lot number, every portion or bag of which is uniform, within permitted tolerances, for the factors which appear in the labeling. See 7 CFR 201.2
  • Military installation: means a base, camp, post, station, yard, center, or other activity under the jurisdiction of the Secretary of a military department or, in the case of an activity in a foreign country, under the operational control of the Secretary of a military department or the Secretary of Defense (10 U. See 48 CFR 217.103
  • mixture: means seeds consisting of more than one kind or variety, each present in excess of 5 percent of the whole. See 7 CFR 201.2
  • Monthly Statement: is a statement accompanying monthly royalty payments identified in 17 U. See 37 CFR 210.12
  • Mortgagee: means original lender under a mortgage and its successors and assigns, as are approved by the Commissioner. See 24 CFR 206.3
  • NACARA: means the Nicaraguan Adjustment and Central American Relief Act (NACARA), enacted as title II of Pub. See 27 CFR 44.105
  • Non-Borrowing Spouse: means the spouse, as defined by the law of the state in which the spouse and borrower reside or the state of celebration, of the HECM borrower at the time of closing and who is also not a borrower. See 24 CFR 206.3
  • Noncontiguous State: as used in this subpart , means Alaska, Hawaii, Puerto Rico, the Northern Mariana Islands, American Samoa, Guam, the U. See 48 CFR 222.7001
  • Person: means any human being and also shall include but not be limited to, corporations, associations, partnerships, trustees, receivers, personal representatives, and public or private organizations. See 37 CFR 102.22
  • Principal residence: means the dwelling where the borrower and, if applicable, Non-Borrowing Spouse, maintain their permanent place of abode, and typically spend the majority of the calendar year. See 24 CFR 206.3
  • Privacy Officer: means a USPTO employee designated to administer this subpart. See 37 CFR 102.22
  • Program income: means interest earned on proceeds from the sale of donated commodities, as well as funds received by a recipient or subrecipient as a direct result of carrying out an approved activity under an agreement. See 31 CFR 380.1
  • Project: means the totality of the activities to be carried out by a recipient, directly or through a subrecipient, to fulfill the objectives of an agreement. See 31 CFR 380.1
  • Property: means items that fall within one of the generic categories listed in DoD Manual 4140. See 48 CFR 217.7001
  • Qualifying proposal: means a proposal containing sufficient data for the DoD to do complete and meaningful analyses and audits of the--

    (1) Data in the proposal. See 48 CFR 217.7401

  • Recipient: means an entity that enters into an agreement with CCC and receives donated commodities and CCC-provided funds to carry out activities under the agreement. See 31 CFR 380.1
  • regulations: means the rules and regulations promulgated by the Secretary of Agriculture and the joint rules and regulations promulgated by the Secretary of the Treasury and the Secretary of Agriculture under the act. See 7 CFR 201.2
  • Request for access: means a request by an individual or an individual's parent or guardian to see a record which is in a particular system of records and which pertains to that individual. See 37 CFR 102.22
  • Request for correction or amendment: means the request by an individual or an individual's parent or guardian that USPTO change (either by correction, amendment, addition or deletion) a particular record in a system of records which pertains to that individual. See 37 CFR 102.22
  • Sale proceeds: means funds received by a recipient from the sale of donated commodities. See 31 CFR 380.1
  • Subrecipient: means an entity that enters into a subagreement with a recipient for the purpose of implementing in the target country activities described in an agreement. See 31 CFR 380.1
  • Target country: means the foreign country in which activities are implemented under an agreement. See 31 CFR 380.1
  • Undefinitized contract action: means any contract action for which the contract terms, specifications, or price are not agreed upon before performance is begun under the action. See 48 CFR 217.7401
  • USDA: means the United States Department of Agriculture. See 31 CFR 380.1
  • USPTO: means the United States Patent and Trademark Office. See 37 CFR 102.22
  • vegetable seeds: means the seeds of the following kinds that are or may be grown in gardens or on truck farms and are or may be generally known and sold under the name of vegetable seeds:

    Artichoke--Cynara cardunculus L. See 7 CFR 201.2

  • Voluntary committed cost sharing or matching contributions: means cost sharing or matching contributions specifically pledged on a voluntary basis by an applicant or recipient, which become binding as part of an agreement. See 31 CFR 380.1
