• Access device: means any card, plate, code, account number, or other means of access, including point of sale devices, that can be used, alone or in conjunction with another access device, to obtain payments, allotments, benefits, money, goods, or other things of value, or that can be used to initiate a transfer of funds under this chapter. See 7 USC 2012
• advisory committee: means any committee, board, commission, council, conference, panel, task force, or other similar group, or any subcommittee or other subgroup thereof that is established or utilized by the Department of Agriculture in the interest of obtaining advice or recommendations for the President or the Department of Agriculture, except that such term excludes any committee which (A) is composed wholly of full-time officers or employees of the Federal Government, (B) is established by statute or reorganization plan, or (C) is established by the President. See 7 USC 2279j
• agricultural commodity: means any agricultural commodity, food, feed, fiber, or livestock (including livestock as it is defined in section 1471(2) of this title and insects), and any product thereof. See 7 USC 5602
• Allotment: means the total value of benefits a household is authorized to receive during each month. See 7 USC 2012
• Anadromous fish: means fish of the species listed in the Annex to the Convention that migrate into the Convention area. See 16 USC 5002
• Anadromous stocks: means stocks of species listed in the Annex to the Convention that migrate into the Convention area. See 16 USC 5002
• asexually reproduced: means produced by a method of plant propagation using vegetative material (other than seed) from a single parent, including cuttings, grafting, tissue culture, and propagation by root division. See 7 USC 2401
• association: when used in reference to a corporation, shall be deemed to embrace the words "successors and assigns of such company or association" in like manner as if these last-named words, or words of similar import, were expressed. See 1 USC 5
• Atlantic striped bass: means members of stocks or populations of the species Morone saxatilis, which ordinarily migrate seaward of the waters described in paragraph (3)(A)(i). See 16 USC 5152
• Authorized officer: means a law enforcement official authorized to enforce this chapter under section 5008(a) of this title. See 16 USC 5002
• basic agricultural commodity: means wheat, rye, flax, barley, cotton, field corn, grain sorghums, hogs, cattle, rice, potatoes, tobacco, sugar beets and sugarcane, peanuts, and milk and its products, and any regional or market classification, type, or grade thereof. See 7 USC 611
• basic seed: means the seed planted to produce certified or commercial seed. See 7 USC 2401
• benefit: means the value of supplemental nutrition assistance provided to a household by means of&mdash. See 7 USC 2012
• blackstrap molasses: means the commercially so-designated "byproduct" of the cane-sugar industry, not used for human consumption or for the extraction of sugar. See 7 USC 609
• Board: means the Board of Directors of the Office of Congressional Workplace Rights. See 2 USC 1301
• borrower: as used in this part shall include a parent borrower under this section. See 20 USC 1078-2
• breeder: means the person who directs the final breeding creating a variety or who discovers and develops a variety. See 7 USC 2401
• Certification period: means the period for which households shall be eligible to receive benefits. See 7 USC 2012
• coastal State: means &mdash. See 16 USC 5152
• coastal waters: means &mdash. See 16 USC 5152
• cohort default rate: means , for any fiscal year in which 30 or more current and former students at the institution enter repayment on loans under section 1078, 1078-1,¹ or 1078-8 of this title received for attendance at the institution, the percentage of those current and former students who enter repayment on such loans (or on the portion of a loan made under section 1078-3 of this title that is used to repay any such loans) received for attendance at that institution in that fiscal year who default before the end of the second fiscal year following the fiscal year in which the students entered repayment. • commerce: means commerce between any State, Territory, or possession, or the District of Columbia, and any place outside thereof. See 7 USC 182
• Commission: means the Atlantic States Marine Fisheries Commission established under the interstate compact consented to and approved by the Congress in Public Laws 77-539 and 81-721. See 16 USC 5007
• Commission: means the Atlantic States Marine Fisheries Commission established under the interstate compact consented to and approved by the Congress in Public Laws 77-539 and 81-721. See 16 USC 5152
• Commissioner: means the Commissioner of Internal Revenue. See
• Convention: means the Convention for the Conservation of Anadromous Stocks of the North Pacific Ocean, signed in Moscow, February 11, 1992. See 16 USC 5002
• Convention area: means the waters of the North Pacific Ocean and its adjacent seas, north of 33 degrees North Latitude,¹ beyond 200 nautical miles from the baselines from which the breadth of the territorial sea is measured. See 16 USC 5002
• cooperating producer: means any person (including any share-tenant or share-cropper) whom the Secretary of Agriculture finds to be willing to participate in the 1935 production-adjustment program for rice. See 7 USC 609
• corporation: includes associations, joint-stock companies, and insurance companies. See
• cotton: means (1) all upland cotton harvested in the United States, and, except as used in section 2106(e) of this title, includes cottonseed of such cotton and the products derived from such cotton and its seed and (2) imports of upland cotton including the upland cotton content of the products derived from upland cotton (other than industrial products as defined by the Secretary). • cotton-producing State: includes &mdash. See 7 USC 2116
• county: includes a parish, or any other equivalent subdivision of a State or Territory of the United States. See 1 USC 2
• Coupon: means any coupon, stamp, type of certificate, authorization card, cash or check issued in lieu of a coupon. See 7 USC 2012
• covered employee: means any employee of&mdash. See 2 USC 1301
• default: includes only such defaults as have existed for (1) 270 days in the case of a loan which is repayable in monthly installments, or (2) 330 days in the case of a loan which is repayable in less frequent installments. See 20 USC 1085
• Department: means the Department of Agriculture. See
• Department of Agriculture: means the United States Department of Agriculture. See 7 USC 2279j
• direct-consumption sugar: means any sugar, as defined above, manufactured or marketed in, or brought into, the United States in any form whatsoever, for any purpose other than to be further refined (or improved in quality, or further prepared for distribution or use). See 7 USC 609
• Directed fishing: means fishing targeted at a particular species or stock of fish. See 16 USC 5002
• domestic: when applied to a corporation or partnership means created or organized in the United States or under the law of the United States or of any State unless, in the case of a partnership, the Secretary provides otherwise by regulations. See
• domestic building and loan association: means a domestic building and loan association, a domestic savings and loan association, and a Federal savings and loan association&mdash. See
• Drug addiction or alcoholic treatment and rehabilitation program: means any such program conducted by a private nonprofit organization or institution, or a publicly operated community mental health center, under part B of title XIX of the Public Health Service Act (42 U. See 7 USC 2012
• EBT card: means an electronic benefit transfer card issued under section 2016(h) of this title. See 7 USC 2012
• Ecologically related species: means living marine species which are associated with anadromous stocks found in the Convention area, including, but not restricted to, both predators and prey of anadromous fish. See 16 USC 5002
• eligible institution: means an institution of higher education, as defined in section 1002 of this title, except that, for the purposes of sections 1077(a)(2)(C)(i) and 1078(b)(1)(M)(i) of this title, an eligible institution includes any institution that is within this definition without regard to whether such institution is participating in any program under this subchapter and includes any institution ineligible for participation in any program under this part pursuant to paragraph (2) of this subsection. • eligible not-for-profit holder: means an eligible lender under subsection (d) (except for an eligible lender described in subsection (d)(1)(E)) that requests a special allowance payment under section 1087-1(b)(2)(I)(vi)(II) of this title or a payment under section 1141 of this title and that is&mdash. • fiscal year: means an accounting period of 12 months ending on the last day of any month other than December. See
• Fish: means finfish, mollusks, crustaceans, and all other forms of marine animal and plant life other than marine mammals and birds. See 16 USC 5002

• Food: means (1) any food or food product for home consumption except alcoholic beverages, tobacco, hot foods or hot food products ready for immediate consumption other than those authorized pursuant to clauses (3), (4), (5), (7), (8), and (9) of this subsection, and any deposit fee in excess of the amount of the State fee reimbursement (if any) required to purchase any food or food product contained in a returnable bottle or can, regardless of whether the fee is included in the shelf price posted for the food or food product, (2) seeds and plants for use in gardens to produce food for the personal consumption of the eligible household, (3) in the case of those persons who are sixty years of age or over or who receive supplemental security income benefits or disability or blindness payments under title I, II, X, XIV, or XVI of the Social Security Act [42 U. • foreign: when applied to a corporation or partnership means a corporation or partnership which is not domestic. See
• guaranty agency: means any State or nonprofit private institution or organization with which the Secretary has an agreement under section 1078(b) of this title. See 20 USC 1085
• handler: means any person who handles cotton or cottonseed or, for the purposes of sections 2102, 2105(c), and 2112 of this title, any person who imports cotton, including de minimis amounts of cotton described in subsection (c), in the manner specified in the order or in the rules and regulations issued thereunder. • holder: means an eligible lender who owns a loan. See 20 USC 1085

• Incidental taking: means catching, taking, or harvesting a species or stock of fish while conducting directed fishing for another species or stock of fish. See 16 USC 5002
• including: when used in a definition contained in this title shall not be deemed to exclude other things otherwise within the meaning of the term defined. See
• independent states of the former Soviet Union: means the following: Armenia, Azerbaijan, Belarus, Georgia, Kazakhstan, Kyrgyzstan, Moldova, Russia, Tajikistan, Turkmenistan, Ukraine, and Uzbekistan. See 7 USC 5602
• Indian tribal government: means the governing body of any tribe, band, community, village, or group of Indians, or (if applicable) Alaska Natives, which is determined by the Secretary, after consultation with the Secretary of the Interior, to exercise governmental functions. See
• individual: shall include every infant member of the species homo sapiens who is born alive at any stage of development. See 1 USC 8

• live poultry dealer: means any person engaged in the business of obtaining live poultry by purchase or under a poultry growing arrangement for the purpose of either slaughtering it or selling it for slaughter by another, if poultry is obtained by such person in commerce, or if poultry obtained by such person is sold or shipped in commerce, or if poultry products from poultry obtained by such person are sold or shipped in commerce. • livestock: means cattle, sheep, swine, horses, mules, or goats&mdash. See 7 USC 182
• livestock products: means all products and byproducts (other than meats and meat food products) of the slaughtering and meat-packing industry derived in whole or in part from livestock. See 7 USC 182

• marketing: includes the sale of cotton or the pledging of cotton to the Commodity Credit Corporation as collateral for a price support loan. See 7 USC 2116
• meat food products: means all products and byproducts of the slaughtering and meat-packing industry&mdash. See 7 USC 182
• member: means a member of the Board. See
• Member of the House of Representatives: means a Representative in, or a Delegate or Resident Commissioner to, the Congress. See 2 USC 2086
• moratorium area: means the coastal waters with respect to which a declaration under section 5154(a) of this title applies. See 16 USC 5152
• moratorium period: means the period beginning on the day on which moratorium is declared under section 5154(a) of this title regarding a coastal State and ending on the day on which the Commission notifies the Secretaries that that State has taken appropriate remedial action with respect to those matters that were the case of the moratorium being declared. • mortgage loan: means an extension of credit to a borrower that is secured by the primary residence of the borrower. See 20 USC 1078-2
• national forest: means lands included in the National Forest System (as defined in section 1609(a) of this title). See 16 USC 5207
• national park: means lands and waters included in the National Park System (as defined in section 100501 of title 54). See 16 USC 5207

• packer: means any person engaged in the business (a) of buying livestock in commerce for purposes of slaughter, or (b) of manufacturing or preparing meats or meat food products for sale or shipment in commerce, or (c) of marketing meats, meat food products, or livestock products in an unmanufactured form acting as a wholesale broker, dealer, or distributor in commerce. • poultry growing arrangement: means any growout contract, marketing agreement, or other arrangement under which a poultry grower raises and cares for live poultry for delivery, in accord with another's instructions, for slaughter. See 7 USC 182
• processing: means the milling or other processing (except cleaning and drying) of wheat, rye, barley or corn for market, including custom milling for toll as well as commercial milling, but shall not include the grinding or cracking thereof not in the form of flour for feed purposes only. • producer: means any person engaged in the growing of five or more acres of potatoes. See
• public lands: means &mdash. See
• raw sugar: means any sugar, as defined above, manufactured or marketed in, or brought into, the United States, in any form whatsoever, for the purpose of being, or which shall be, further refined (or improved in quality, or further prepared for distribution or use). See 7 USC 609

• Supplemental nutrition assistance program: means the program operated pursuant to this chapter. See 7 USC 2012
• swine contractor: means any person engaged in the business of obtaining swine under a swine production contract for the purpose of slaughtering the swine or selling the swine for slaughter, if&mdash. See 7 USC 182
• swine production contract: means any growout contract or other arrangement under which a swine production contract grower raises and cares for the swine in accordance with the instructions of another person. See 7 USC 182
• tax return preparer: means any person who prepares for compensation, or who employs one or more persons to prepare for compensation, any return of tax imposed by this title or any claim for refund of tax imposed by this title. See 26 USC 7701
• taxable year: means the calendar year, or the fiscal year ending during such calendar year, upon the basis of which the taxable income is computed under subtitle A. See 26 USC 7701

• trade or business: includes the performance of the functions of a public office. See
• transaction: includes a series of transactions. See
• Tribal organization: means the recognized governing body of an Indian tribe (including the tribally recognized intertribal organization of such tribes), as the term "Indian tribe" is defined in section 5304 of title 25, as well as any Indian tribe, band, or community holding a treaty with a State government. • tuber propagated: means propagated by a tuber or a part of a tuber. See 7 USC 2401
• United States: includes each of the States, the District of Columbia, Puerto Rico, and the territories and possessions of the United States. See 7 USC 5602
• United States: means collectively the several States, the District of Columbia, and the Commonwealth of Puerto Rico. See

• variety: means a plant grouping within a single botanical taxon of the lowest known rank, that, without regard to whether the conditions for plant variety protection are fully met, can be defined by the expression of the characteristics resulting from a given genotype or combination of genotypes, distinguished from any other plant grouping by the expression of at least one characteristic and considered as a unit with regard to the suitability of the plant grouping for being propagated unchanged. • vehicle: includes every description of carriage or other artificial contrivance used, or capable of being used, as a means of transportation on land. See 1 USC 4
• vessel: includes every description of watercraft or other artificial contrivance used, or capable of being used, as a means of transportation on water. See 1 USC 3
• whoever: include corporations, companies, associations, firms, partnerships, societies, and joint stock companies, as well as individuals. See 1 USC 1
• wildlife refuge: means lands and waters included in the National Wildlife Refuge System (as established by section 668dd of this title). See 16 USC 5207
• writing: includes printing and typewriting and reproductions of visual symbols by photographing, multigraphing, mimeographing, manifolding, or otherwise. See 1 USC 1
