Boundary Disputes

Boundaries to land, either public or private, may be proven by evidence of community reputation.{footnote} [3452]  FRE 803(20); Cal. § 1321-22.  {/footnote}  Only community reputation as it existed before there was any controversy is admissible, and some states further require that the reputation must go back at least thirty years.   

Presumption as to Work Performed on Real Property

Illiniois has a statutory presumption that work performed on real property which does not cause injury or property damage within six years was done with reasonable care by everyone involved.  Written guarantees are unaffected.{footnote} [3453]  Ill. sec. 8-1801.{/footnote}
