Terms Used In Alabama Code 41-9-655.03

  • Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
  • following: means next after. See Alabama Code 1-1-1
  • preceding: means next before. See Alabama Code 1-1-1
  • President pro tempore: A constitutionally recognized officer of the Senate who presides over the chamber in the absence of the Vice President. The President Pro Tempore (or, "president for a time") is elected by the Senate and is, by custom, the Senator of the majority party with the longest record of continuous service.
  • property: includes both real and personal property. See Alabama Code 1-1-1
  • state: when applied to the different parts of the United States, includes the District of Columbia and the several territories of the United States. See Alabama Code 1-1-1
(1) Annually, on or before February 1, the Alabama Justice Information Commission, shall submit to the Speaker of the House of Representatives, President Pro Tempore of the Senate, and Governor a written report that includes all of the following:

a. A summary of seizure and forfeiture activity in the state for the preceding fiscal year.
b. The type, approximate value, and disposition of the property seized and forfeited.
c. The amount of any proceeds received.
(2) The summary for data on seizures and forfeitures may be disaggregated by the commission. The aggregate report shall also be made available on the website of the Alabama Justice Information Commission consistent with the format of other reports posted on the commission’s website.
(b) The Alabama Justice Information Commission may include in the report required under subsection (a) recommendations to improve laws, rules, and policies to better ensure that seizure, forfeiture, and expenditures are done and reported in a manner that is fair to crime victims, innocent property owners, secured interest holders, citizens, law enforcement, and taxpayers.
