  • authority: The Shoals Economic Development Authority, an agency or instrumentality of the county and Lauderdale County created pursuant to Subpart 1 and Act 95-409, and includes its successors and assigns, if any, and any agency or instrumentality that may succeed to its functions.   • board: The civil service board created by this part. See Alabama Code 45-17A-50.01
  • city: The City of Muscle Shoals, Alabama. See Alabama Code 45-17A-50.01
  • committee: The Shoals Industrial Development Committee, an agency or instrumentality of the county and Lauderdale County, created pursuant to Part 2 (commencing with Section 45-17-91. See Alabama Code 45-17-243
  • county: Colbert County in the State of Alabama. See Alabama Code 45-17-243
  • Deed: The legal instrument used to transfer title in real property from one person to another.
  • demotion: The reassignment of a covered employee to a position of a lesser class involving less responsibility and less complex duties. See Alabama Code 45-17A-50.01
  • Devise: To gift property by will.
  • Executor: A male person named in a will to carry out the decedent
  • Fiduciary: A trustee, executor, or administrator.
  • Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
  • Gift: A voluntary transfer or conveyance of property without consideration, or for less than full and adequate consideration based on fair market value.
  • Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
  • Impeachment: (1) The process of calling something into question, as in "impeaching the testimony of a witness." (2) The constitutional process whereby the House of Representatives may "impeach" (accuse of misconduct) high officers of the federal government for trial in the Senate.
  • LAUDERDALE COUNTY: Lauderdale County in the State of Alabama. See Alabama Code 45-17-243
  • Lawsuit: A legal action started by a plaintiff against a defendant based on a complaint that the defendant failed to perform a legal duty, resulting in harm to the plaintiff.
  • Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC
  • oath: includes affirmation. See Alabama Code 30-3D-608
  • preceding: means next before. See Alabama Code 30-3D-608
  • Presiding officer: A majority-party Senator who presides over the Senate and is charged with maintaining order and decorum, recognizing Members to speak, and interpreting the Senate's rules, practices and precedents.
  • Quorum: The number of legislators that must be present to do business.
  • real property: includes lands, tenements and hereditaments. See Alabama Code 30-3D-608
  • reassignment: The promotion or demotion of a covered employee. See Alabama Code 45-17A-50.01
  • REGULAR STATUS: A condition of employment that covered employees are afforded upon completion of the established probationary period and approval by the appointing authority. See Alabama Code 45-17A-50.01
  • SHOALS ECONOMIC DEVELOPMENT FUND: That certain special or trust fund or account created pursuant to Section 45-17-91. See Alabama Code 45-17-243
  • state: The State of Alabama. See Alabama Code 45-17-243
  • STATE DEPARTMENT OF REVENUE: The Department of Revenue of the state. See Alabama Code 45-17-243
  • STATE SALES TAX: The tax or taxes imposed by the state sales tax statutes. See Alabama Code 45-17-243
  • STATE SALES TAX STATUTES: Division 1 of Article 1 of Chapter 23 of Title 40, including all other statutes of the state which expressly set forth any exemptions from the computation of the taxes levied in Division 1 and all other statutes which expressly apply to, or purport to affect, the administration of Division 1 and the incidence and collection of the taxes imposed therein.   • STATE USE TAX: The tax or taxes imposed by the state use tax statutes. See Alabama Code 45-17-243
  • STATE USE TAX STATUTES: Article 2 of Chapter 23 of Title 40, including all other statutes of the state which expressly set forth any exemptions from the computation of the tax levied in Article 2 and all other statutes of the state which expressly apply to, or purport to affect, the administration of Article 2 and the incidence and collection of the taxes imposed therein.   • Testimony: Evidence presented orally by witnesses during trials or before grand juries.
  • Trustee: A person or institution holding and administering property in trust.
  • writing: includes typewriting and printing on paper. See Alabama Code 30-3D-608
