Terms Used In Alabama Code > Title 33 > Chapter 5A

  • agency: The Alabama State Law Enforcement Agency. See Alabama Code 16-60-111.12
  • Appraisal: A determination of property value.
  • Appropriation: The provision of funds, through an annual appropriations act or a permanent law, for federal agencies to make payments out of the Treasury for specified purposes. The formal federal spending process consists of two sequential steps: authorization
  • Deed: The legal instrument used to transfer title in real property from one person to another.
  • DERELICT VESSEL: A vessel in the waters of this state that satisfies any of the following:

    a. See Alabama Code 16-60-111.12

  • Donor: The person who makes a gift.
  • Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
  • Foreclosure: A legal process in which property that is collateral or security for a loan may be sold to help repay the loan when the loan is in default. Source: OCC
  • Gift: A voluntary transfer or conveyance of property without consideration, or for less than full and adequate consideration based on fair market value.
  • Guarantor: A party who agrees to be responsible for the payment of another party's debts should that party default. Source: OCC
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • LAW ENFORCEMENT OFFICER: An officer of a county, municipality, or any state agency, department, or subdivision thereof, who is certified by the Alabama Peace Officers' Standards and Training Commission. See Alabama Code 16-60-111.12
  • Lien: A claim against real or personal property in satisfaction of a debt.
  • Misdemeanor: Usually a petty offense, a less serious crime than a felony, punishable by less than a year of confinement.
  • oath: includes affirmation. See Alabama Code 30-3D-608
  • Obligation: An order placed, contract awarded, service received, or similar transaction during a given period that will require payments during the same or a future period.
  • person: includes a corporation as well as a natural person. See Alabama Code 30-3D-608
  • personal property: includes money, goods, chattels, things in action and evidence of debt, deeds and conveyances. See Alabama Code 30-3D-608
  • Presiding officer: A majority-party Senator who presides over the Senate and is charged with maintaining order and decorum, recognizing Members to speak, and interpreting the Senate's rules, practices and precedents.
  • property: includes both real and personal property. See Alabama Code 30-3D-608
  • vessel: Every description of watercraft, other than a seaplane, capable of being used as a means of transportation on the water. See Alabama Code 16-60-111.12
  • WATERS OF THIS STATE: Waters of this state as defined in Section 33-5-3. See Alabama Code 16-60-111.12
  • writing: includes typewriting and printing on paper. See Alabama Code 30-3D-608
