(a) Except as provided in (c) of this section, a person who violates a provision of Alaska Stat. § 18.70.010 – 18.70.100 or a regulation adopted under those sections, or who fails to comply with an order issued under Alaska Stat. § 18.70.010 – 18.70.100, is guilty of a class B misdemeanor. When not otherwise specified, each 10 days that the violation or noncompliance continues is a separate offense.

Terms Used In Alaska Statutes 18.70.100

  • Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
  • person: includes a corporation, company, partnership, firm, association, organization, business trust, or society, as well as a natural person. See Alaska Statutes 01.10.060
(b) A person aggrieved by a final order may appeal to the superior court within 30 days after the issuance of the final order. Filing of the appeal does not excuse noncompliance with the order. The court may stay the operation of the order on those terms relating to bonding or other matters that the court finds proper. A stay may not be granted or continued if the court finds that it is against the public interest.
(c) A person who violates Alaska Stat. § 18.70.095, as that section relates to carbon monoxide detection devices, is guilty of a violation. In this subsection, “violation” has the meaning given in Alaska Stat. § 11.81.900.
