Terms Used In Alaska Statutes 21.40.070

  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.

The department may, under Alaska Stat. Chapter 44.62 (Administrative Procedure Act), adopt regulations necessary for the execution of the functions vested in it by Alaska Stat. § 21.40.01021.40.060, and may for that purpose classify domestic stock insurance companies, securities, and other persons or matters within its jurisdiction. A provision of Alaska Stat. § 21.40.010 and 21.40.020 imposing a liability does not apply to an act done or omitted in good faith in conformity with a regulation of the department, notwithstanding that the regulation may, after the act or omission, be amended or rescinded or determined by judicial or other authority to be invalid for any reason.
