Terms Used In Alaska Statutes 47.55.080

  • Beneficiary: A person who is entitled to receive the benefits or proceeds of a will, trust, insurance policy, retirement plan, annuity, or other contract. Source: OCC
  • department: means the Department of Family and Community Services. See Alaska Statutes 47.55.900
  • Executor: A male person named in a will to carry out the decedent

  • state: means the State of Alaska unless applied to the different parts of the United States and in the latter case it includes the District of Columbia and the territories. See Alaska Statutes 01.10.060

If a beneficiary under this chapter dies leaving an estate in the state, the attorney general or the Department of Family and Community Services shall file with the executor or administrator, or with the probate court, the claim of the state against the estate, and the attorney general shall take the steps necessary to enforce and collect the claim. Money collected shall be paid into the treasury of the state.
