A. Service of summons in an action against any public entity or public employee involving acts that are alleged to have occurred within the scope of the public employee‘s employment shall be made pursuant to Arizona rules of civil procedure.

Terms Used In Arizona Laws 12-822

  • Action: includes any matter or proceeding in a court, civil or criminal. See Arizona Laws 1-215
  • Employee: includes an officer, director, employee or servant, whether or not compensated or part time, who is authorized to perform any act or service, except that employee does not include an independent contractor. See Arizona Laws 12-820
  • Public employee: means an employee of a public entity. See Arizona Laws 12-820
  • Public entity: includes this state and any political subdivision of this state. See Arizona Laws 12-820
  • State: means this state and any state agency, board, commission or department. See Arizona Laws 12-820
  • Summons: Another word for subpoena used by the criminal justice system.
  • Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence.

B. In an action against this state upon written demand of the attorney general, made at or before the time of answering, served upon the opposing party and filed with the court where the action is pending, the place of trial of any such action shall be changed to Maricopa county.
