At any time after the expiration of sixty days from the death of a nonresident decedent, any person indebted to the estate of the nonresident decedent or having possession or control of personal property, or of an instrument evidencing a debt, obligation, stock or chose in action belonging to the estate of the nonresident decedent may pay the debt, deliver the personal property, or the instrument evidencing the debt, obligation, stock or chose in action, to the domiciliary foreign personal representative of the nonresident decedent upon being presented with proof of his appointment and an affidavit made by or on behalf of the representative stating:

Terms Used In Arizona Laws 14-4201

  • Action: includes any matter or proceeding in a court, civil or criminal. See Arizona Laws 1-215
  • Affidavit: A written statement of facts confirmed by the oath of the party making it, before a notary or officer having authority to administer oaths.
  • Application: means a written request to the registrar for an order of informal probate or appointment under chapter 3, article 3 of this title. See Arizona Laws 14-1201
  • Decedent: A deceased person.
  • Estate: includes the property of the decedent, trust or other person whose affairs are subject to this title as originally constituted and as it exists from time to time during administration. See Arizona Laws 14-1201
  • Foreign personal representative: means a personal representative who is appointed by another jurisdiction. See Arizona Laws 14-1201
  • Local administration: means administration by a personal representative appointed in this state pursuant to appointment proceedings described in chapter 3. See Arizona Laws 14-4101
  • Nonresident decedent: means a decedent who was domiciled in another jurisdiction at the time of the decedent's death. See Arizona Laws 14-1201
  • Obligation: An order placed, contract awarded, service received, or similar transaction during a given period that will require payments during the same or a future period.
  • Person: means an individual or an organization. See Arizona Laws 14-1201
  • Personal property: All property that is not real property.
  • Personal property: includes money, goods, chattels, things in action and evidences of debt. See Arizona Laws 1-215
  • Personal representative: includes an executor, an administrator, a successor personal representative, a special administrator and persons who perform substantially the same function under the law governing their status. See Arizona Laws 14-1201
  • Petition: means a written request to the court for an order after notice. See Arizona Laws 14-1201
  • Property: includes both real and personal property. See Arizona Laws 1-215
  • State: means a state, territory or possession of the United States, the District of Columbia or the Commonwealth of Puerto Rico. See Arizona Laws 14-9101

1. The date of the death of the nonresident decedent.

2. That no local administration, or application or petition therefor, is pending in this state.

3. That the domiciliary foreign personal representative is entitled to payment or delivery.

The provisions of this section are in addition to, and are not exclusive of, any other provision of law permitting payment of an obligation or delivery of property to a domiciliary foreign personal representative.
