A. If a motor vehicle claim is subject to subrogation, the insured may bring a cause of action separate and apart from the insurer seeking recovery of damages for which the insured has not been compensated by the insurer. Any settlement or judgment of the claim of the insured alone shall not affect the rights of the insurer.

  • Action: includes any matter or proceeding in a court, civil or criminal. See Arizona Laws 1-215
  • Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
  • Settlement: Parties to a lawsuit resolve their difference without having a trial. Settlements often involve the payment of compensation by one party in satisfaction of the other party's claims.
  • Writing: includes printing. See Arizona Laws 1-215

B. If requested in writing by an insured, the insurer shall report to the insured the status of the subrogated claim.
