A. Any contract for dance studio lessons and other services entered into in reliance upon any wilful and false, fraudulent or misleading information, representation, notice or advertisement of the dance studio shall be voidable. Any contract for dance studio lessons and other services which does not comply with the applicable provisions of this article shall be voidable.

Terms Used In Arizona Laws 44-1747

  • Action: includes any matter or proceeding in a court, civil or criminal. See Arizona Laws 1-215
  • Contract: A legal written agreement that becomes binding when signed.
  • Contract for dance studio lessons and other services: means a contract for instruction in ballroom or other types of dancing and includes but is not limited to dance competitions, olympics, single specialist projects, showcases and other services whether given to customers individually or in groups. See Arizona Laws 44-1741
  • Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
  • Dance studio: means any person who contracts directly with members of the general public to provide dance studio lessons and other services. See Arizona Laws 44-1741

B. Any waiver of the customer of the provisions of this article shall be voidable.

C. Any customer injured by a violation of this article may bring an action for the recovery of damages. Judgment may be entered for the amount at which the actual damages are assessed plus reasonable attorney fees.
