A. Subject to legislative appropriation, the department of economic security shall administer the child support enforcement program from the state‘s share of the child support collections received on public assistance cases.

  • Appropriation: The provision of funds, through an annual appropriations act or a permanent law, for federal agencies to make payments out of the Treasury for specified purposes. The formal federal spending process consists of two sequential steps: authorization
  • assistance: means any money payments made by the department that are paid to or for the benefit of any dependent child as provided in chapter 2, article 5 of this title. See Arizona Laws 46-402
  • Department: means the Arizona department of economic security. See Arizona Laws 46-402
  • Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
  • Person: includes a corporation, company, partnership, firm, association or society, as well as a natural person. See Arizona Laws 1-215
  • Services: includes social casework, rehabilitation counseling and similar services rendered to a person or persons in need as provided for in this title. See Arizona Laws 46-101
  • State: includes a state, territory or possession of the United States, the District of Columbia and the Commonwealth of Puerto Rico. See Arizona Laws 46-402
  • Temporary assistance for needy families: means assistance granted under section 403 of title IV of the social security act as it exists after August 21, 1996. See Arizona Laws 46-101
  • United States: includes the District of Columbia and the territories. See Arizona Laws 1-215

B. Monies appropriated to the department of economic security for child support purposes shall be used to administer services of the child support enforcement program pursuant to the requirements of title IV-D of the social security act (42 United States Code § 651).

C. The total amount of state monies that may be spent in any fiscal year by the department of economic security for temporary assistance for needy families from child support enforcement monies shall not exceed the amount appropriated or authorized by section 35-173 for that purpose. This section shall not be construed to impose a duty on an officer, agent or employee of this state to discharge a responsibility or to create any right in a person or group if the discharge or right would require an expenditure of state monies in excess of the expenditure authorized by legislative appropriation for that specific purpose.
