(a) For purposes of this section, “local educational agency” means a school district, county office of education, or charter school.

(b) If a local educational agency intends to seek state funding pursuant to Chapter 12.5 (commencing with Section 17070.10) of Part 10, for a school modernization project for a school facility constructed before January 1, 2012, the modernization project submitted to the Division of the State Architect shall include faucet aerators and water-conserving plumbing fixtures, as defined in § 1101.3 of the Civil Code, in all bathrooms.

(c) (1) The requirements of this section apply only to those projects submitted to the Division of the State Architect three months after voters approve a statewide general obligation bond that provides funds for school facilities for kindergarten or any of grades 1 to 12, inclusive, at a statewide election occurring after November 1, 2022.

(2) The requirements of this section shall apply only to those projects that contain an existing faucet or water plumbing fixture in the space to be modernized or repaired and propose to modernize or repair the interior of a school building and do not apply to projects that only propose to repair or make alterations to the exterior of a school building, the school grounds, or the playing fields of a school.

(3) Bathrooms that already contain both faucet aerators and water-conserving plumbing fixtures, as defined in § 1101.3 of the Civil Code, at the time a modernization project is submitted to the Division of the State Architect, shall not be subject to the requirements in subdivision (b).
