Every person is punishable by imprisonment pursuant to subdivision (h) of § 1170 of the Penal Code for 16 months or two or three years who:
(a) Procures, assists, counsels, or advises another to give or offer his vote at any election, knowing that the person is not qualified to vote.

- Election: means any election including a primary that is provided for under this code. See California Elections Code 318
(b) Aids or abets in the commission of any of the offenses mentioned in Section 18560.
