There is no privilege under this article in:
(a) A proceeding brought by or on behalf of one spouse against the other spouse.
Terms Used In California Evidence Code 984
- Inter vivos: Transfer of property from one living person to another living person.
- Intestate: Dying without leaving a will.
- Person: includes a natural person, firm, association, organization, partnership, business trust, corporation, limited liability company, or public entity. See California Evidence Code 175
- Spouse: includes "registered domestic partner" as required by §. See California Evidence Code 215
- Testate: To die leaving a will.
(b) A proceeding between a surviving spouse and a person who claims through the deceased spouse, regardless of whether such claim is by testate or intestate succession or by inter vivos transaction.
