Terms Used In California Codes > Public Utilities Code > Division 10 > Part 9

  • Access shaft: means a vertical shaft used as a regular means of worker access to underground mines and tunnels under construction, renovation, or demolition. See California Labor Code 7951
  • Affidavit: A written statement of facts confirmed by the oath of the party making it, before a notary or officer having authority to administer oaths.
  • Agency: means the Labor and Workforce Development Agency. See California Labor Code 18.5
  • Amortization: Paying off a loan by regular installments.
  • Annuity: A periodic (usually annual) payment of a fixed sum of money for either the life of the recipient or for a fixed number of years. A series of payments under a contract from an insurance company, a trust company, or an individual. Annuity payments are made at regular intervals over a period of more than one full year.
  • Appeals board: means the Occupational Safety and Health Appeals Board, within the department. See California Labor Code 6302
  • Beneficiary: A person who is entitled to receive the benefits or proceeds of a will, trust, insurance policy, retirement plan, annuity, or other contract. Source: OCC
  • Board: means the Occupational Safety and Health Standards Board. See California Labor Code 7951
  • Boiler: as used in this part means any fired or unfired pressure vessel used to generate steam pressure by the application of heat subject to this part. See California Labor Code 7621
  • Building: as used in this chapter , means any building three stories or more in height, and whether heretofore constructed or hereafter to be constructed, including commercial buildings of all types, office buildings, apartment houses, hotels and buildings used for manufacturing purposes, but excluding dwelling houses occupied by not more than three families, and excluding all buildings constructed with windows that may be, and are, entirely washed and cleaned from inside the building or from a sitting position on the window sill in the manner provided by safety orders issued, or which may be issued from time to time, by the division.   • Certified competent conveyance mechanic: means any person who has been determined by the division to have the qualifications and ability of a competent journey-level conveyance mechanic and is so certified by the division in accordance with this chapter. See California Labor Code 7300.1
  • Certified qualified conveyance company: means any person, firm, or corporation that (1) possesses a valid contractor's license if required by Chapter 9 (commencing with Section 7000) of Division 3 of the Business and Professions Code and (2) is certified as a qualified conveyance company by the division in accordance with this chapter. See California Labor Code 7300.1
  • Commission: means the Public Utilities Commission created by Section 1 of Article XII of the California Constitution, and "commissioner" means a member of the commission. See California Public Utilities Code 20
  • Commissioner: means the Insurance Commissioner. See California Insurance Code 15001
  • Commissioner: means the Labor Commissioner. See California Labor Code 2671
  • Commissioner: means the Insurance Commissioner of this State. See California Insurance Code 20
  • Common law: The legal system that originated in England and is now in use in the United States. It is based on judicial decisions rather than legislative action.
  • Continuance: Putting off of a hearing ot trial until a later time.
  • Contractor: includes a subcontractor that is primarily engaged in those operations. See California Labor Code 2671
  • Conveyance: means any elevator, dumbwaiter, escalator, moving platform lift, stairway chairlift, material lift or dumbwaiter with automatic transfer device, automated people mover, or other equipment subject to this chapter. See California Labor Code 7300.1
  • Conveyance inspector: means any conveyance safety inspector of the division or other conveyance inspector determined by the division to be qualified pursuant to this chapter. See California Labor Code 7300.1
  • County: includes city and county. See California Water Code 14
  • County: includes "city and county. See California Insurance Code 14
  • Department: means the Department of Insurance. See California Insurance Code 15001
  • Department: means Department of Industrial Relations. See California Labor Code 19
  • Department: means the Department of Industrial Relations. See California Labor Code 6302
  • Deposition: An oral statement made before an officer authorized by law to administer oaths. Such statements are often taken to examine potential witnesses, to obtain discovery, or to be used later in trial.
  • Devise: To gift property by will.
  • Director: means the Director of Industrial Relations. See California Labor Code 6302
  • directors: means the board of directors of the district. See California Public Utilities Code 105003
  • Discovery: Lawyers' examination, before trial, of facts and documents in possession of the opponents to help the lawyers prepare for trial.
  • District: means the Sonoma-Marin Area Rail Transit District. See California Public Utilities Code 105003
  • District election: means every election held within the district for district purposes, but does not include a formation election. See California Water Code 71450
  • Division: means the Division of Occupational Safety and Health. See California Labor Code 7300.1
  • Division: as used in this part , means the Division of Occupational Safety and Health. See California Labor Code 7620
  • Division: means the Division of Occupational Safety and Health. See California Labor Code 7951
  • Division: means the Division of Occupational Safety and Health. See California Labor Code 6302
  • earned surplus: whenever used in this chapter means the excess of revenues from the inception of operation of the electric system over related expenses thereof, plus accumulated price-level depreciation, plus or minus any additional amounts credited to or charged against customers' equity employed in the business of the electric system, as determined in accordance with the then current accounting practice of the district. See California Public Utilities Code 13093
  • Elevator: means an installation defined as an "elevator" in ASME A17. See California Labor Code 7300.1
  • Entitlement: A Federal program or provision of law that requires payments to any person or unit of government that meets the eligibility criteria established by law. Entitlements constitute a binding obligation on the part of the Federal Government, and eligible recipients have legal recourse if the obligation is not fulfilled. Social Security and veterans' compensation and pensions are examples of entitlement programs.
  • Ex officio: Literally, by virtue of one's office.
  • Executive session: A portion of the Senate's daily session in which it considers executive business.
  • Face: means the head of the tunnel where soil is being removed, or that area in a mine where digging is underway. See California Labor Code 7951
  • Felony: A crime carrying a penalty of more than a year in prison.
  • Fingerprints: means an impression of the lines on the finger taken for the purposes of identification. See California Insurance Code 15001
  • Garment manufacturing: means sewing, cutting, making, processing, repairing, finishing, assembling, or otherwise preparing any garment or any article of wearing apparel or accessories designed or intended to be worn by any individual, including, but not limited to, clothing, hats, gloves, handbags, hosiery, ties, scarfs, and belts, for sale or resale by any person or any persons contracting to have those operations performed and other operations and practices in the apparel industry as may be identified in regulations of the Department of Industrial Relations consistent with the purposes of this part.   • Gift: A voluntary transfer or conveyance of property without consideration, or for less than full and adequate consideration based on fair market value.
  • Guarantor: A party who agrees to be responsible for the payment of another party's debts should that party default. Source: OCC
  • Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
  • Insurer: includes the State Compensation Insurance Fund and any private company, corporation, mutual association, and reciprocal or interinsurance exchange, authorized under the laws of this state to insure employers against liability for compensation under this part and under Division 4 (commencing with Section 3201), and any employer to whom a certificate of consent to self-insure has been issued. See California Labor Code 6302
  • Labor Commissioner: means Chief of the Division of Labor Standards Enforcement. See California Labor Code 21
  • Licensee: means a person licensed under this chapter. See California Insurance Code 15001
  • Life estate: A property interest limited in duration to the life of the individual holding the interest (life tenant).
  • Lower explosive limit: means the lowest concentration at which a gas or vapor can be ignited or will explode. See California Labor Code 7951
  • Material alteration: means an alteration as defined in ASME A17. See California Labor Code 7300.1
  • Mine: means any excavation or opening above or below ground used for removal of ore, minerals, gravel, sand, rock, or other materials intended for manufacturing or sale. See California Labor Code 7951
  • Misdemeanor: Usually a petty offense, a less serious crime than a felony, punishable by less than a year of confinement.
  • Muck: means excavated dirt, rock, or other material. See California Labor Code 7951
  • Passenger tramway: includes any method or device used primarily for the purpose of transporting persons by means of cables or ropes suspended between two or more points or structures. See California Labor Code 7340
  • Permissible equipment: means equipment tested and approved by the U. See California Labor Code 7951
  • Permit: means a document issued by the division that indicates that the conveyance has had the required safety inspection and tests and fees have been paid as set forth in this chapter. See California Labor Code 7300.1
  • Permit: means a permit issued by the division to operate a passenger tramway in any place. See California Labor Code 7340
  • Person: includes any individual, firm, company, association, organization, partnership, limited liability company, and corporation. See California Insurance Code 15001
  • Person: means any person, firm, association, organization, partnership, business trust, corporation, limited liability company, or company. See California Water Code 19
  • Person: means any individual, partnership, corporation, limited liability company, or association, and includes, but is not limited to, employers, manufacturers, jobbers, wholesalers, contractors, subcontractors, and any other person or entity engaged in the business of garment manufacturing. See California Labor Code 2671
  • Person: means any person, association, organization, partnership, business trust, limited liability company, or corporation. See California Labor Code 18
  • Personal property: All property that is not real property.
  • Plaintiff: The person who files the complaint in a civil lawsuit.
  • Power of attorney: A written instrument which authorizes one person to act as another's agent or attorney. The power of attorney may be for a definite, specific act, or it may be general in nature. The terms of the written power of attorney may specify when it will expire. If not, the power of attorney usually expires when the person granting it dies. Source: OCC
  • Probate: Proving a will
  • Probation: A sentencing alternative to imprisonment in which the court releases convicted defendants under supervision as long as certain conditions are observed.
  • property: includes property real and personal. See California Civil Code 14
  • Public agency: includes the state, and any county, city and county, city, district, or other political subdivision or public entity of, or organized under the laws of, this state, or any department, instrumentality, or agency thereof. See California Public Utilities Code 105003
  • Rail transit: means the transportation of passengers and their incidental baggage by rail. See California Public Utilities Code 105003
  • rail transit facilities: means any or all real and personal property, equipment, rights or interests owned or to be acquired by the district for rail transit service purposes, including ancillary bicycle and pedestrian pathways that provide connections between and access to station sites. See California Public Utilities Code 105003
  • Remainder: An interest in property that takes effect in the future at a specified time or after the occurrence of some event, such as the death of a life tenant.
  • Resale inspection: shall mean the inspection of boilers or tanks in the possession of a dealer or vendor at the request of a user who contemplates the purchase thereof. See California Labor Code 7725
  • Resident: means residing in this State, "nonresident" means not residing in this State. See California Insurance Code 30
  • Secretary: means the Secretary of Labor and Workforce Development. See California Labor Code 19.5
  • Service of process: The service of writs or summonses to the appropriate party.
  • Settlement: Parties to a lawsuit resolve their difference without having a trial. Settlements often involve the payment of compensation by one party in satisfaction of the other party's claims.
  • Sole ownership: The type of property ownership in which one individual holds legal title to the property and has full control of it.
  • Spouse: includes "registered domestic partner" as required by Section 297. See California Labor Code 12.2
  • standards board: means the Occupational Safety and Health Standards Board. See California Labor Code 7300.1
  • Standards board: means the Occupational Safety and Health Standards Board, within the department. See California Labor Code 6302
  • State: means the State of California, unless applied to the different parts of the United States. See California Water Code 18
  • State: means the State of California, unless applied to the different parts of the United States. See California Insurance Code 28
  • state of emergency: means a state of emergency or local emergency as defined in Section 8558 of the Government Code. See California Insurance Code 16000
  • Statute of limitations: A law that sets the time within which parties must take action to enforce their rights.
  • Subdivision: means a subdivision of the section in which that term occurs unless some other section is expressly mentioned. See California Public Utilities Code 10
  • Subpoena duces tecum: A command to a witness to produce documents.
  • Summons: Another word for subpoena used by the criminal justice system.
  • Tank: as used in this part , means any unfired pressure vessel, subject to this part, used for the storage of air pressure or liquefied petroleum gases. See California Labor Code 7622
  • Temporary permit: means a document issued by the division which permits the use of a noncompliant conveyance by the general public for a limited time while minor repairs are being completed or until permit fees are paid. See California Labor Code 7300.1
  • Transcript: A written, word-for-word record of what was said, either in a proceeding such as a trial or during some other conversation, as in a transcript of a hearing or oral deposition.
  • Trust account: A general term that covers all types of accounts in a trust department, such as estates, guardianships, and agencies. Source: OCC
  • Tunnel: means an underground passageway, excavated by men and equipment working below the earth's surface, that provides a subterranean route along which men, equipment, or substances can move. See California Labor Code 7951
  • Underground mine: means a mine that consists of a subterranean excavation. See California Labor Code 7951
  • United States: means the United States of America, and in relation to any particular matter includes the officers, agents, employees, agencies, or instrumentalities authorized to act in relation thereto. See California Water Code 20
  • Violation: includes a failure to comply with any requirement of the code. See California Labor Code 22
  • water: includes potable water and nonpotable water. See California Water Code 71611
  • will: includes codicil. See California Civil Code 14
  • with the consent of the board: as used in this article mean the express permission or consent of the board in each particular case, evidenced by resolution or order entered in its minutes, and granted upon application of the particular district, municipal corporation, or person desiring to obtain benefit of the provisions of this article. See California Water Code 9004
